RESOLVED that the Town Board of the Town of Southold hereby accepts
the bid of Oak Tree Farm Dairy, Inc. in the amount of $.1495 per 1/2 pint
for supplying Homogenized Pasteurized Whole Milk to the Southold Town
Human Resources Center for Calendar Year 1997, all in accordance with
their bid proposal.

Dear Supervisor Cochran:
We were informed yesterday morning by the Town Clerk's office that the Director of
Human Services, Venetia McKeighan, has recommended that the Milk bid for the
Nutrition Center be awarded to Arschamomaque Dairy. We have read Ms. McKeighan's
recommendation and find her economic anaiysis to be incorrect.
Oak Tree's bid was not $.03 per half-pint lower than Arschamomaque's, as Ms.
McKeighan claims; it was $.0605 lower. Based on the bid specifications of 250 half-pints
per day, 365 days per year, Oak Tree's bid would save the town $5,520.63.
While the bid specifications state that milk is required "365 days a year" it is silent as to
how many deliveries per week are required. Realizing that the town could not possibly
require 365 deliveries per year, Oak Tree contacted the Nutrition Center and was
informed by a woman who identified herself as the Cook, that the Nutrition Center
currently is on a three day-a-week delivery schedule - Monday, Wednesday and Friday.
In its bid, Oak Tree offered "2 (or 3) day delivery: Tuesday, Thursday (Saturday if
needed)." It is not clear from Ms. McKeighan's letter why the "Arschamomaque Dairy
[delivery schedule] meets Town specifications" any better than the Oak Tree delivery
schedule. However, even if Oak Tree's delivery schedule is less convenient than
Arschamomaque's, Ms. McKeighan does point out that the town could accommodate
Oak Tree's delivery schedule by making a one time purchase of additional equipment that
would cost "approximately $1,200 or more." Clearly, making this purchase of additional
equipment is in the town's best interest because so doing would allow it to take advantage
of over $5,500 in saving over the next year alone!

Finally, as to Ms. McKeighan's concern that Oak Tree charges a $2.00 case deposit,
(which as she points out is refundable and thus at no real economic consequence), it is
important for the town to realize that milk case deposits are required by New York
State law (a copy is attached). That Arschamomaque Daix~y does not charge case deposits
and thus is in violation of the law, is hardly a rationale for penalizing Oak Tree Dairy.
It is our understanding that the Town of Southold has done business with Arshamomaque
Dai~3~ for over 15 years and that for most of those years there were no other bidders for
the milk contract. To now reject Oak Tree's bid will seriously undermine our confidence
in the competitive bid process; it will cost the town over $5,000 in the short mn and more
in the long mn.

also charge a $2.00 deposit fee per case for the milk
carriers, which is refundable, but there is no such charge

NOTICE TO BIDDERS
NOTICE IS HEREBY GIVEN, in accordance with the provisions of
Section 103 of the General Municipal Law, that sealed bids are sought by
the Town of Southold for the following for calendar year 1997: the
purchase of 1/2 pints of Homogenized Pasteurized Whole Milk, 250 - 1/2
pints a day, more or less as may be needed, 365 days a year, delivered
to the Southold Town Human Resource Center, Sound Avenue and Pacific
Street, Mattituck, New York. Specifications may be obtained at the Office
of the Town Clerk, Town of Southold, Town Hall, 53095 Main Road,
Southold, New York 11971.
The sealed bids, together with a Non-Collusive Bid Certificate, will
be received by the Town Clerk at the Southold Town Hall, until 10:00
A.M., Thursday, November 7, 1996, at which time they will be opened and
read aloud in public. The Town Boarcl of the Town of Southold reserves
the right to reject any and all bids and waive any and all informalities in
any bid should it be deemed in the best interest of the Town of Southold
to do so.

SPECIFICATIONS
HOMOGENIZED PASTEURIZED WHOLE MILK
Approximately 250 half pints of Homogenized Pasteurized Whole Uilk, delivered
daily for 365 days to the Southold Town Human Resource Center, Sound Avenue
and Pacific Street, Mattituck, New York, during calendar year 1997.
Delivered to the Human Resource Center refrigeration between 7:30 a.m. and 8:30
a.m. as required during the year. Contractor shall agree to pick up and credit
unused milk.
Milk shall be delivered in paper containers meeting the sanitary requirements of
health laws.
The Town of Southold accepts no responsibility for loss of or breakage to
containers, cases or baskets.
All milk supplies shall contain not less than 3.5 butter fat by test and must be
from sources approved by the State and/or County Health Department. Bidder
must hold a regular permit from the Health Officer covering the grades to be
supplied and a license as required by the State Department of Agriculture and
Markets.
The Town of Southold reserves the right to cancel the contract if, in the iudgment
of the Town Board, the milk is deficient in butter fat or is received in an
unsanitary condition.
All milk cases delivered to the Human Resource Center will be subject to a per
case surcharge. All milk cases made available to a delivery person at any time
shall be credited against such surcharge account. The surcharge account balance,
debit or credit, will be issued in conjunction with each monthly billing for milk
and milk products. Should a delivery person fail to remove from the premises any
or all cases made available by the Human Resource Center, in no event later than
the next delivery, such cases will be credited as returned and become the financial
and physical responsibility of the milk dealer.
NON-COLLUSIVE BID CERTIFICATE
The undersigned bidder certifies that this bid has been arrived at
by the bidder independently and has been submitted without collusion
with any other vendor of materials, supplies or equipment of the type
described in the invitation for bids, 'and the contents of this bid have
not been communicated by the bidder, nor, to its best knowledge and
belief, by any of its employees or agents, to any person not an employee
or agent of the bidder or its surety on any bond furnished herewith
prior to the official opening of the bid.
