Project Description
Applicant proposed to construct a single family dwelling, associated sanitary
system, concrete patio, pool and asphalt driveway, with no off-site fill required
and with a 50' non-disturbed buffer area to align with neighbors on both sides.
All proposed structures shall be located a minimum of 60' landward of existing
tidal wetlands. A line of staked haybales or snow fencing shall be placed at a
point 50' landward of the existing tidal wetlands line prior to and maintained
during construction. The project as proposed shall result in 20.07% lot coverage
at the adjacent area.

Based on the information you'have submitted, the New York State
Department of Environmental Conservation has determined that the
property landward of the staked haybale line as showTn on the survey
prepared by Kenneth F. Abruzzo, dated November 15, 1996, is beyond
A~ticle 25 j~sdiction.
Therefore, in accordance with the current Tidal Wetlands Land Use
Requlations (6NYCRR Part 661) ~o permit is required under the Tidal
Wetlands Act. Please be advlsed, however, that no construction,
sedimentation, or dist~r~ange ~f any kind may take pla~e seaward of
the tidal wetlands jurisdictional boundary, as indicated above,
without a permit. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlands Jurisdiction which may result from your
project. Such precautions may include maintaining adequate work
area between the tidal wetland jurisdictional boundary and your
project (i.e. a 15' to 20' wide construction area) or erecting a
temporary fence, barrier, or hay bale berm.
Please be further advised that this letter does not relieve you of
the responsibility of obtaining any necessary permits or approvals
from other agencies.

Dear Mr. & Mrs. Hoag:
On December 31, ~996, the New York District, U.S. Army Corps
of Engineers, received a copy of the Joint Application for Permit
you recently submitted to the New York State Department of
Environmental Conservation requesting authorization to construct
a single-family dwelling landward of the spring high tide line
and wetlands adjacent to an unnamed creek. The site is
identified as Lot 10, "Harbor View at Mattituck", at Mattituck,
Town of Southold, Suffolk County, New York. The delineation of
state-regulated tidal wetlands as shown on the survey prepared by
Young & Ygung~ dated November 15, 1996 appears accurate on the
basis of topographic information shown on said survey.
Our review indicates that since the proposed work does not
appear to include dredging or construction activities in or over
any navigable waters of the United States, the placement of any
dredged or fill material in any waters of the United States
(including coastal or inland wetlands) or the accomplishment of
any work affecting the course, location, condition or capacity of
such areas, a Department of the Army permit will not be required.
Care should be taken so that any fill or construction
materials, including debris, do not enter the waterway to become
a drift or pollution hazard. You are to contact appropriate
local government officials to ensure that the subject work is
performed in compliance with their requirements.

with no off-site fill required, and a 50' non-disturbance buffer area to align with neighbors on

Dear Mr. & Mrs. Hoeg,
The following action was taken by the Board of Town Trustees
during a Regular Meeting, held on July 21, 1999, regarding the
above matter:
WHEREAS, MARY KIRSCH applied to the Southold Town Trustees for
a permit under the provisions of the Wetland Ordinance of the
Town of Southold, application dated June 3, 1999 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on July 21, 1999, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
JAMES & KAREN HOEG to construct a single family dwelling,
sanitary system, concrete patio, pool and driveway with no
off-site fill required and a 50' non-disturbed buffer are~ to
align with neighbors on both sides, and a line of staked
haybales or silt fencing shall be placed at a point 50' landward
of the existing tidal wetlands line, with condition that
drywells be placed for pool. Located; 350 Willis Creek Drive,
Mattituck.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

At the meeting of the Southold Town Conservation Advisory Council held Monday, July 19,
1999, the following recommendation was made:
Moved by Melvyn Morris, seconded by Richard Smith, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITIt A
STIPULATION the Wetland Permit Application of JAMES E. & KAREN A. HOEG 115-17-
17.10 to construct a single-family dwelling, associated sanitary system, concrete patio, pool and
asphalt driveway, with no off-site fill required and with a 50' non-disturbed buffer area to align
with neighbors on both sides. All proposed structures shall be located a minimum of 60'
landward of existing tidal wetlands. A line of staked haybales or snow fencing shall be placed at
a point 50' landward of the existing tidal wetlands prior to and maintained during construction.
The project as proposed shall result in 20.07% lot coverage at the adjacent area.

The CAC recommends Approval with the Stipulation that drywells be installed for the pool
backwash.
