SOUTHOLD TOWN BOARD AT A REGULAR MEETING HELD ON SEPTEMBER 17, 1996:
RESOLVED that the Town Board of the Town of Southold hereby amends
resolution no. 23, adopted on September 3, 1996, with regard to the
removal of Scrap Tires from the Disposal Area, by authorizing the removal
of the tires to JBH Tire Recycling, Inc. of Medford if possible, or to
Oxford Tire of Connecticut when necessary, based on the determination
by Solid Waste Coordinator Bunchuck; said authorization shall remain in
effect until such time as the Town Board adopts a new contract with
respect to Scrap Tire removal.

On September 3, the Town Board authorized me to send scrap tires to Oxford
Tire in Connecticut in the event JLJ Recycling Contractors of ~rooklyn failed
to fulfill the terms of their contract with the Town to remove the tires.
To date, 2 loads of tires have been sent to Oxford, at~a cost of $700 per
icad, plus expenses. After calculating ferry costs, driver's time (9-hour
round trip), fuel, etc., I estimate the cost to send a truckload of tires to
Oxford to be in the neighborhood of $1,150.
Yesterday I was told about, ann today confirmed, that a Long Island tire
recycler is ready, willing, and able to accept scrap tires from the Town at a
cost o~ $75/tcn delivered. This would have amounted approx. $975 for the last
truckload ~en~ to Connecticut. The company is JBR ?ire Recycling, Inc, ob
Medford. It would be well worth the savings in time and fuel to start
sending tires to JBH as soon as possible.
As a hedge against any problems that may develop with JBN {or Oxford, for that
matter), I request the Board consider the following resolution:

the removal of Scra~ Tires from the Disposal Area to JBR Tire Recycling,
Inc. of Me,ford if possible, or to Oxford Tire of Connecticut when

Dear Sirs:
You are under contract with the Town of Southold to remove scrap tires from the
Town's Transfer Station upon one week of being notified by the Town. Three
times in August you received calls from our Solid Waste Coordinator, Jim
Bunchuck, to remove the accumulation of tires pursuant to the contract. On
September 3, 1996, you arrived and removed two loads, with a promise to
remove two more loads on September 6, 1996.
This letter is to advise you that the accumulation of tires must be removed by
September 10, 1996 at 4:00 p.m. In the future, the Town will expect you to
remove the tires regularly as provided for under the terms of our contract.
Failure to remove the tires promptly will be deemed a breach of contract and the
town will terminate the contract immediately. Should that occur, you would be
responsible for all damages ensuing from that breach of contract and the town
will use all legal remedies. Furthermore, the town would not consider any bids
from your company, for future contracts with the town for waste removal, for a
period of ten years. Any failure to perform will be a demonstration that you will
not be a responsible bidder on any town contract.

SUBJECT: Scrap Tire Removal
At the last Town Board work session I informed the Board of the failure of JLJ Recycling
to remove the growing pile of scrap tires from the landfill, despite repeated calls to them
over the last couple of months, not to mention their obligation to do so under their
contract with the Town. I have therefore looked into arranging removal of the growing
pile of scrap tires through another vendor. According to the Town Clerk, the only one
other bidder on tire removal for 1996 is Tri-State Recycling of Lindenhurst, NY. I met
with the president of Tri-State who told me they are unable to accept tires right now, but
may be ready to in about 3 weeks. He also indicated that most scrap tire vendors in the
northeast are having trouble moving their tires. I then contacted Oxford Tire in
Connecticut, the last vendor with whom the Town had a tire removal contract. They are
able to accept tires, but only if they are ~eliver~d to them. Due to numerous
commitments, they will be unable to send trailers to Southold for tire removal at this time.
Oxford is located approx. 30 miles north of New London, off Route 95.
Oxford last bid on Southold's tire removal contract in 1995. At that time they offered a
price of $700 per trailer load delivered. (The current price from JLJ is $948 per load).
Oxford will honor that price through the end of this year. I estimate the cost of delivering
a load of tires to Oxford's facility to be $500 (including $200 in ferry fare). This would
make the total cost $1,200, or $250 more than JLJ's contract price.
There are approx. 5 trailer-loads of tires currently on the ground at the landfill. I suggest
we arrange to start delivering tires to Oxford as soon as possible. Once the pile is cleared
up, we can expect to average about 1 trailer load every 3 weeks to a month through the
end of the year.

now poses a health and safety threat to the town.
This letter is a final demand that you remove the tires immediately pursuant to
the terms of our contract. Failure to remove the tires by noon on Friday,
September 6, will be deemed a breach of contract and the town will terminate
the contract immediately. You will be responsible for all damages ensuing from
that breach of contract and the town will use all legal remedies. Furthermore,
the town will not consider any bids from your company, for future contracts with
the town for waste removal, for a period of ten years. Your failure to perform will
have demonstrated that you will not be a responsible bidder on any town
contract.

Scrap Tire Removal
The Town has a one year (1996) contract with JLJ Recycling Contractors of Brooklyn, NY to
haul scrap tires from the landfill for recycling and/or disposal. Under the terms o£the contract,
JLJ is to send a trailer for loading within one week of being called to do so. On July 16, 1996,
JLJ was called to come pick up a load of tires. They have been called each week since then as
well, yet have still not shown up. On at least one occasion, I was told that, given disposal prices
they (JLJ) must pay, they are having trouble removing our tires at the price they agreed. Clearly,
that is not and should not be the Town's problem. At present, there are approximately 3 or 4
trailer loads of tires at the landfill awaiting removal. In addition to being unsightly, the pile has
become a fire hazard, a mosquito breeding ground, and a violation of DEC regulations.
In my last call to JLJ (Tuesday, August 13) they were told that failure to pick up tires by Friday,
August 16, would result in my recommendation to the Board to cancel the JLJ contract and seek
the services of the next lowest bidder. I hereby make this recommendation.

It is our intention to secure the bid for the removal of scrap tires from
the Southold Town disposal Area, Cutchogue, N.Y. for the calendar year
1996. Our bid is as follows:
1. Tri-State Reccyling Co. will deliver a 100 Cubic Yard push-out trailer or
a 100 Cubic Yard walking floor trailer at said location upon 24 hours
notice. Upon arrival, Tri-State Recycling Co. driver will remain on site
while Town of Southold personnel loads said trailer. The cost to the Town
of Southold for removal of scrap tires will be ....... $1225.00 per load.
2. Tri-State Recycling Co. will accept a 100 Cubic Yard trailer load of scrap
tires delivered by the Town of Southold using town-owned truck & push-out
trailer at our facility located at 685 N. Queens Ave., Lindenhurst, N.Y.
at a cost to the Town of Southold of ................ $950.00 per load.
The hours of delivery are 8:00 a.m. to 5:00 p.m. Monday thru Friday. In case
of emergency arrangements can be made for a Saturday delivery.
