SCTM#'s 1000-102-4-6.2 & 7.1
Is there anyone here who would like to speak on behalf of this application?
Abi(~ail Wickham: I'd like to say timing is everything, having just walked in. You are
familiar with this project: it is a Iow-density application involving less than 50% density
even after the family sold about 50 acres of development rights to the Town of
Southold. We have agreed with the Town on protecting the woodland strip that runs
through the middle and have also in conjunction with this application worked with the
Highway Dept. of the Town in helping to resolve some of the drainage on Alvah's Lane
coming from other properties. So, if the Board has any questions, I will be glad to
answer them. Mr. Kaloski (inaudible) is here and if you have any questions we will be
glad to answer them. Thank you.
Chairperson Woodhouse: Thank you. Is there anyone else who would like to speak on
behalf of this application? Hearing none, I will entertain a motion to close the hearing.
Georqe Solomon: So moved.
Ken Edwards: Second.
Chairperson Woodhouse: All in favor?
Ayes: Ms. Woodhouse, Mr. Cremers, Mr. Edwards, Mr. Sidor, Mr. Solomon.
Chairperson Woodhouse: Opposed? The hearing is closed. Would you please read
the resolution?
Martin Sidor: I would like to offer the following:
WHEREAS, this proposal will subdivide a 8.30-acre parcel, SCTM#1000-102-4-6.2, into

A106-56 of the Southold Town Code. The property owner agrees not
to clear the property except to the extent permitted by the Southold
Town Code and, in addition such limits, to remove such trees and
vegetation that are dead or extensively diseased or damaged. The
clearing restriction shall not apply to those portions of the property that
are in active agricultural production.
B. A portion of Lot 1 is encumbered with a Drainage and Conservation
Easement granted to the Town of Southold as shown on the approved
map and is subject to the terms and conditions of the filed agreement
C. Paragraph 4 should be revised to indicate that the Covenants and

Is there anyone who would like to speak on behalf of this application?
Southold Town Planninci Board Paqe Five September 12, 2005
Arthur Foster: Good evening. I'm the applicant. I think you are all familiar with it.
We've been going over this for a while. If anybody has any questions I'll be happy to
answer them.
Chairperson Woodhouse: Is there anyone else who would like to speak on behalf of
this application?
James Goodwin: I have the property next to his. I would just like to know if he's going
to be running a brush dump there, or is it gonna be just his stuff coming in, and the
hours.
Chairperson Woodhouse: Mr. Foster, would you like to respond to that?
Arthur Foster: No, we're not going to be running a brush dump. We're gonna make
mulch, as is expressed on the plan, and the hours will be normal business hours.
Chairperson Woodhouse: Could you state what those hours are?
Arthur Foster: No. Because in the summer when we have Daylight Savings Time, we
work long hours, that's what Daylight Savings Time is all about. Will we be making
mulch at 8:00 at night? I seriously doubt it. But in the interest of completing work,
many times we work after the normal 4:00 p.m. work day to avoid having to go back
and set up the following day and lose another half day. So, will we be working long
hours? Possibly. I don't want to stand here and tell you "no" because in my 35-year
history of running that business, in the summertime I work sunup to sundown. But it
isn't necessarily all going to be isolated to that spot. That spot is basically to stockpile
fill, mulch, topsoil, equipment from time to time, precast materials for a job, and we
have a tub grinder there that we bought from the Town and we will be using that to
reprocess the mulch.
James Goodwin: My question too is: "are you going to be taking in landscaper stuff,
leaves, grass clippings, stuff like that?"
Arthur Foster: No leaves, no grass clippings, brush from our own clearing jobs, and
that's what the tub grinder is for.
James Goodwin: I appreciate that. Thank you.
Chairperson Woodhouse: Thank you. Is there anyone else who would like to address
the Board on this application? Hearing no comments, I will entertain a motion to close
the hearing.
Ken Edwards: So moved.
