on July 13, 2005.

1283 regarding the destruction and erosion on the right of way to the beach. His office is
located in the Southold Town Hall on the Main Road in Southold.
Mr. McMahon is working with Mr. Goggins regarding the restoration of this area.

Dear Mr. Harris:
I have three problems,two old, one new, all needing to be addressed by the Town Highway
Department: the destruction and erosion at the 5th Avenue Beach in New Suffolk goes on and on
and on. I discussed this problem with you almost a year ago, and yet the approach to the beach is
worse than ever. Large vehicles continue to tear up the property.
I find it disgraceful that the Town of Southold is allowing this to happen at one of the community's
public beaches. As you can see by the enclosed photos,this situation needs immediate attention
and action taken by the Town.
Another problem we discussed concerns road damage in front of my home at 6065 New Suffolk
Avenue (location address, not my mailing address), corner of Blossom Bend and New Suffolk
Avenue in Mattituck. There are a series of ruts in the black top that cause a loud rumble eve 'me
a car passes by. This is most annoying. You are welcome to come by anytime and listen. May I
look forward to having this repaired soon?
Again, a roadway problem. This time, at the New Suffolk Avenue entrance to Handy Pantry in
Mattituck. A large rut and broken curb need repair by the Highway Department.
It would be appreciated if these problems were corrected as soon as possible.
Its nice to have faith in local government, but with situations like these, one has to wonder.

Wetland Permit to add top soil to site for regarding purposes due to replacement of
septic system, install a 6' wide deck parallel to the bulkhead on the upland side of the
bulkhead and remove the turf under the deck, install a 6' wide deck parallel to the house
24' in length and remove the turf under the deck to provide for drainage, replace the
bulkhead inkind/inplace with the same elevation with vinyl, renovate the existing
dwelling and add gutters and drywells to contain roof run-off, replace existing +/-61.5'
jetty with a vinyl low profile jetty, with the condition the white picket fence on top of the
jetty is removed within 30 days from the date of this permit and the boat racks must be
stored above high water landward of the bulkhead, and plans submitted for the low
profile jetty before the work begins on the jetty, and all as depicted on the plan surveyed
by Stanley Isaksen, Jr. dated May 4, 1998 and the site plan submitted by Mr. Goggins
and received in the Trustee Office October 1, 2004.

Dear Mr. Goggins:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, September 22, 2004 regarding the above matter:
WHEREAS, WILLIAM GOGGINS applied to the Southold Town Trustees for a permit
under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance
of the Town of Southold, application dated August 23, 2004, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 22, 2004, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of WILLIAM C.

Re: Defacement of town property at Lowes Beach
Sirs:
The homeowner to the east of Lowes beach at the end of Fifth Street in New Suffolk has
used the beach access to bring heavy construction vehicles onto his property. This
machinery has destroyed the ground cover and grass leading down to the beach, leaving a
muddy mess and a serious erosion problem. He has also put his discarded fenceposts on
the beach land and there is a trailer next to his fence. We are asking that the ground
cover be restored and the debris removed from the beach.

reinforce some of our verbal comments made at that meeting.1) The fence on the jetty prevents access along the beach at high tide. At low tide the jetty is diffid there is no
access above the high tide line, due to the fence in question.
2)While the jetty may pre-date the regulations governing such structures, the fence on top of it was installed within the last ten years, by
the previous property owner.
3) Within the last year, the fence within the Trustee's jurisdiction has been significantly altered; a section replaced with six foot stockade,
and portions on the jetty replaced. It is our understanding that there was no permit for this work.
4) It is our understanding that, since the jetty was initially installed before permits were necessary, it cannot be altered or even maintained
("not a nail")without your approval. We are prepared to document its condition and report back to you and the Bay Constable if we note
inappropriate activity.
5)We understand that any permit from the Trustees will allow only a jetty whose top is "flush"with the beach, and that no fence will be
allowed.
6) If recent upland filling within the Trustees jurisdiction was done under an "emergency" sanitary replacement permit, it is our
understanding that the permit will need to be revised to include the filling activity, with an appropriate public hearing on the matter. We
believe that such an occasion would provide an opportunity to address the public access issue.

In reference to the above application, please recall the Petition of concerned New
Suffolk residents submitted to you protesting the blockage of legal littoral access at Mr.
Goggins property along Great Peconic Bay. Access is blocked by a fence located on
his groin, which often forces beach walkers into the bay to pass, and was erected
without a permit and in violation of your regulations and the law.
While I have no opinion on the merits of this application, I am confident that you will
give it the scrutiny it merits. Assuming you eventually approve a permit, I respectfully
propose the following permit conditions for your consideration:
1) Prohibit fence on top of groin, now and in the future, at least seaward of the face
of the bulkhead.
2) Require the reconstruction of the existing groin. Despite recent patching of the
sheathing with plywood, this structure is less "functional' than the bulkhead sought to
be replaced. Per current regulations, the new jetty should be flush with the level of the
beach; the extra height of the structure has no benefit in erosion control, and only acts
to block public access.
3) Require the removal of the Sunfish rack located on the high tide line: Mr.
Goggins is not running a yacht club, and the rack intrudes on the public domain. It will
continue to block access when the fence is removed.

We are referring to the new home construction at the southeast end of New Suffolk Road
(Fifth Street)in New Suffolk. We have confirmed that this new home construction is
occurring without the proper permits. Permits dated from 2003 encompass only a new
pool and small porch facing Jackson Street. This home has been demolished and is being
built anew. Why is this permitted? We understand that the law states a builder who
knowingly conducts work of this magnitude without the proper permits can lose his
license. Why do these builders have immunity? What is the owner—William Goggins'
relationship with the Town and/or the Trustees which allows him to circumvent the law?
It is disturbing that Mr. Goggins,a prominent attorney in the Town of Southold with
apparent connections within the building department and the Board of Trustees,receives
favorable treatment from the Town to construct an illegal residence above his garage, and
build a new home(with an additional floor),without the proper permits.
Another flagrant disregard for your office and the approval process is the initial
construction of a third floor bayside sun deck. While plans for two other bayside decks
have been submitted for review by the'trustees at their 8/1 g meeting,this third structure
has not been accounted for.
The foregoing facts give the impression that knowing the right people in the Southold
Town Building Department gains privileges that the rest of the taxpayers do not enjoy.

As a resident of New Suffolk and a Bay Watcher, I have, for fourteen years, walked the
beaches of New Suffolk several times a day in exercise of my littoral rights and delight of
the shore. During the past winter, the sand was washed away from the bulkhead that is at
the southwestern end of Fifth Street, making it impossible to climb over the five foot
wooden barricade that has resulted. During the winter and early spring,being unable to
cross the bulkhead even at low tide,I would walk through the edge of the Goggins' yard,
acting with what I thought was tacit permission,to reach the beach on the Fifth Street
side. But as spring came, I felt more and more uncomfortable about interrupting their
family affairs to walk through the yard. I tried to suggest a solution(please see attached
# 1) which would have meant taking down two small sections of the fence that Rich
Goodale put there in 2000, but I received a rather angry response (please see attached
#2).
I answered Ms. Goggins'letter(see attached# 3)and sent the attached pictures to
illustrate the impairment to the public right of way that is imposed by the bulkhead,but I
have received no response.
Some action must be taken to allow people like me to walk the beach freely between the
New Suffolk Town Beach and Kimogenor Point. I am soliciting your help and advice for
this matter.

Dear Mr. and Mrs. Goggins:
1 have tried several times to talk to you in person, but have found only the younger
members of the family or no one home when I have been to your house.
As a resident of New Suffolk and a Bay Watcher, I walk the beaches of New Suffolk
several times a day. When I reach your bulkhead,I find that,most of the time, I must
climb the bulkhead and jump down four plus feet into water or 1 must walk around
through your yard, which I do not like to do(and one of your daughters has asked me not
to do). Unfortunately,the fence which blocks the way for walkers (built by Rich
Goodale)has become an illegal fence in the last winter because it blocks the littoral way
which provides for all to be able walk the beaches below the high water mark.
The easiest solution, it seems to me, is to cut the fence back by two sections,making the
walk-way legal,but reminding the public that your privacy begins at the high water mark.
If you would like to discuss this further, or if you have any questions, I am at home much

Dear Ms. Goggins:
I'm sorry you chose to respond as you did to my letter of June 25. I was trying to reach
a neighborly accommodation to a situation that I believe allows for compromise.
First, as I indicated in my letter, it is not my wish to trespass on your property, and I am
sorry you feel a need to threaten criminal prosecution.
Second, I do not believe we are in violation of the Town's leash law, which requires only
that a dog be in the control of an adult. I also do not believe she has ever defecated on
your property. In any event, I always carry a plastic bag and pick up after her wherever
she does her business. When we are permitted to exercise our right of free passage
along the beach below high water mark, it will be easier for me to ensure that neither I
nor my dog trespass on your property.
Third, I have no idea who, if anyone, is guilty of"attempting to loosen and damage
[your] picket fence." It is not my style to engage in such activity. Instead,I wrote what
I thought was a friendly letter.
Finally, as for the fence itself,you correctly state that it does not proceed past the mean
high tide water mark. Unfortunately,the bulkhead does impede public access to and from
the adjacent public beach. The enclosed photographs should help to establish this point.
I appreciate your past courtesy, which I assumed was to allow us to trespass only because
you have restricted public access to and from the beach west of your property.
I hope we can reach an amicable settlement of this issue.
