Box 1179 Southold, NY 11971 Re: Belvedere Property Management, LLC Robins Island, New Suffolk Site Permit #4346 Dear Mr. Kmpski: It's hard to believe, bm it has been approximately five years (1994) that we started seeking your assistance with the improvements that were necessary to allow for the safe operation of the landing crat~ and transient boats between New Suffolk and Robins Island. I believe the first permit the Trustees issued was for the chain-link fence that now surrounds the property (#4346). Following this approval, the Board approved a waiver for the geoweb access ramp. Subsequently "temporary" approval for dolphins, floats, jetty reconstruction and floats was issued. Over the course ora four-year period, these improvements were approved by amendments and merged into the original permit #4346. Throughout this four-year period, the permit seemed to have become "temporary" through various resolutions approving additional structures. Even though the fence, piles, dolphins, floats, etc. were already installed, the access site became temporary in 1995 when the Board approved an amendment to relocate pilings to secure the landing craR and install buffer piles on the outside of the boxed-in bulkhead for stabilization (copy enclosed). The Board then granted an extension in 1997 which allowed the fence, geoweb access ramp, jetty, floats, etc. (copy enclosed). In May of 1998, the Board granted the last one-year extension for the construction of these structures (copy enclosed) which will expire May 28, 1999. Please note that all thc structures are constructed and presently exist on the property. Albert J. Krupski, Jr., Pres March 30, 1999 Page 2 of 2 I am sure the Board will agree that it is very important to maintain accessibility between New Suffolk and Robins Island until a permanent plan is established. The site presently provides a direct route for those needing to access the island, whether it is personnel, government officials, emergency vehicles/technicians, etc. As noted above, thc utiliTation and activities between the sites have declined considerably, but access remains necessary. Belvedere Property Management LLC has requested our assistance in obtaining approval to cont'muc utilizing this area until a more permanent plan can bc established. Thc concentrated activities on Robins Island have declined considerably and Belvedere is presently formulating plans for their New Suffolk holdings and/or exploring additional sites for their future and permanent use. They anticipate formulating these plans during 1999 at which time any and all necessary p~,~,its will be applied for. We ask that you give this matter your professional review and we respectfully request that you grant the minimum of a one-year extension to the permit (which includes the alternate northerly ramp), ffyou require additional information, please don't hesitate to contact me or George. To better clarify Special Condition #1 so as to avoid this situation in the future you must contact NYSDEC prior to a dredge event to determine if there are any public uses for the dredge material. NYSDEC will coordinate this determination with the Town Trustees. If there is no public need for the material then it can be trucked to an approved private location. The indented boat slip consisting of 15' c 2U,'c 31' 24, 10' will be removed and replaced in kind. The remaining two sections, 20' and 10' return will be replaced within 18~'. At the. inlet to the creek, the 70' groin on the west side of the inlet, will be re-piled and repaired and extended 50'. The 160' section of bulkhead immediately to the north of the groin will be removed and replaced in kind and in place. The final northerly section of bulkhead will be left in place and a new [[0' section, plus 10t return will be constructed landward of the marsh that has grown behind the existing bulkhead. I was totally remiss in that I did not realize a permit was necessary because of the type of work that was involved in this project (it being temporary and low key). As you know, our office employs Sue Long for the sole purpose of obtaining the necessary permits so that we don't encounter the type of problem we experienced yesterday. We strive to comply with all governing rules and regulations and we consider our company to be very reputable. The permit sign enclosed with the permit shall be protected from the weather and posted in a conspicuous location at the work site until all authorized work has been completed. The permittee shall require that any contractor, project engineer, or other person responsible for the overall supervision of this project reads, understands, and complies with this permit and all its general, special, and supplementary special conditions. Any failure to comply precisely with all of the terms and conditions of this permit, unless authorized in writing, shall be treated as a violation of the Environmental Conservation Law. If any of the permit conditions are unclear, the permittee shall contact the Division of Regulatory Affairs at the address on page one or telephone (516) 444-0365. If project design modifications become necessary after permit issuance, the permittee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modifications. The permittee is advised that substantial modification may require submission of a new application for permit. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of the permitted work, the bottom portion of that form shall also be signed and returned, along with photographs of the completed work and, if required, a survey.
