Ehlers last dated February 10, 2005 and determined the proposed construction of a single- family dwelling, in-ground swimming pool, and associated improvements to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the Town Code. Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, without a permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may ir~clude maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion Hazard Area would require permits from this office. Over the last year I have developed plans to construct a single family residence on that parcel. That project has now entered the permitting process. Earlier this year I applied to the Suffolk County Department of Health Services for the necessary permit to utilize the property's existing water supply well and to construct a sewage disposal system. A copy of the site survey and proposed construction is enclosed. Yesterday I received a notice (copy also enclosed) from the County that my application was incomplete in part because I failed to provide a copy of a Preliminary Approval with respect to Town Wetlands/Drainage/Zoning When I originally applied to the County, I was also advised to request a Letter of Non- Jurisdiction for the project from the State DEC. I made that request and subsequently received the enclosed Letter of Non-Jurisdiction from them. I was also advised that, since the proposed construction is set back a minimum of 14 feet from the top of the property's waterside embankment and 116 feet from the mean high water line, the project was situated beyond the limits of your jurisdiction and therefore no permit would be required from the Town Trustees. Consequently I have not previously contacted your office with respect to this proposed construction. If the advice I was initially given regarding the need for a permit from your Board is correct, may I then request a letter or statement of non-jurisdiction from you so as to satisfy the County's requirement? In the event the advice was erroneous, I would appreciate knowing what permit or permits I will need from your board and the application process that must be followed to obtain them. The portion of the referenced property landward of the topographic crest of the bank in excess of 10 feet in elevation, shown as the top of slope on the survey prepared by John C. Ehlers last revised on 6/26/01, is beyond the jurisdiction of Article 25 (Tidal Wetlands). Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6 NYCRR Part 661) no permit is required under the Tidal Wetlands Act. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction which may result from your project.
