Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) I have discussed the intended project with Michael Verity and we have come to the following conclusions that the applicant may wish to consider. The existing use is a pre-existing non-conforming use in the R-40 Zoning District, as such, any increase or change in intensity of this use would not be permitted without the benefit of a Zoning Board Variance. In addition, should a variance be granted, a Site Plan approved by the Planning Board would be required. It is requested that you inform the applicant of these matters and advise them to contact Michael Verity to discuss an avenue for compliance. These issues do not have a bearing on the Trustees actions on this application, as your approval would be required also. It is the applicant's choice to choose which approval to seek first, however it is important that they realize that other Town approvals may be required before the project can begin. We would be to take this opportunity to corrrnert regarding the pending pemrt to create naw docks and dredge a portion of Schoolhouse Creek in New Suffolk.We believe the now Chapter 971Netads and Shoreline'dearly discarage this project The new code refers to"rich heritage of scenic,historic and natural resources";"Protection of the erhharorrnerht;"Twin waters and h>abitals have been negatively impacted ; docks"have some effect on pthysicat,biologist,mem findions and values,development patterns and the aesthetic character d the neighborhood";"minimize damage from erosion,turbidity or sf ation 1;and" that new growth in the form of new structures on existing waterfront lots and kndervvaler lards pose a similar potential to impw the Town's unique environment,geology and hydrology'. There are numerous reasons why the project should not be allowed.They include the following: 1) The parcels are zoned Residential R-40. Commercial docks are not allowed in a residential zone. There is no residence on the lard in consideration so a dock as an accessory structure is rot allowed. 2) The new Chapter 97 under 97-27 Constnxtim and Operation Standards, Section C. In Water ; (2)Docks, (a)Standards for Residential and Commercial Docks;General Rule 8 it states that any application for a dock to be constructed at the end of a right of way or commonly held land requires to written consent of all parties having an interest in the right of way arc, etc.. The application contains no indication of any written consent of the owners of parcel 15 of which the deed includes a right of way access to the lot as well as common access to the right to maintain a dock. 3) The dredge spoils will be stored in dose proximity to the domestic water well for parcel 15. 4) The dredge spoils placed at the end of Old Harbor Lae will wash into the bay as the road drains to rainfall from the area through the drain at the end of tie mond( Picture attached) In the past there were grolhs in place between the end of Old Harbor Road and Schoolhouse Creek that contained the runoff. 5) The application is titled as bekV "Maintenance Dredging". In Chapter 97 Ordinary and Usual Maintenance requires that the action be approved or requwW by permit. Where is the evidence of the approval or permit? Also Mainterhaoe Dredging requires documentary • Page 2 April 21,2004 evidence that previous dredging was performed. There appears to be no existence of this required evidence. 6) The definitions of Marina, Residential and Residential Dods in Chapter 97 do not support the granting of the right to build docks on this plot. 7) Have requests been submitted to the DEC and Army Corp of Engineers for Permits for this project? Have they been granted? Also have the same permits been granted for the permit granted to Lary Tuthill by the Trustees on 523/2003 as per the request to amend Permit# 4700 heard at the 5212003 Board of Town Trustees Public Hearing? 8) As per Chapter 97-22 (Fee) it is requested that the applicant pay a Consuttad fee to insure that there is no contamination or environmental concerns with the dredge spoils. As per the requirements of the Code the applicant should be required to submit proof that there are no toxins in the spoils. 9) The lands at Schoolmse Creek presently under the stewardship of the Tuthill family represent nothing shat of a garbage dump as witnessed by copies of photographs submitted with this letter. Considering the preface to Chapter 97; excerpts of which are outfined in the second Paragraph of this letter are the Trustees inclined to allow this deplorable situation to expand? 10) When we personally submitted requests for permits for dredging we were required to keep the spoils landward of the high tide line.This application dearly shows placing the dredge spoils in Cutdrogue Hobo. The sift in the spoils will deaty upset the balance of the environmental conditions of the Harbor.The spoils will also be quickly washed into the Habr by the drain pipe at the end of Old Harbor Road. ff the 150 yards of spoils are placed landward of the high water mark at the end of Old Harbor Road the pile of spoils will be fifteen feet high! This does not include the spoils which the Trustees authorized to be placed in the same spot with their clandestine grantvg of the permit late on the night of the May 21,2003 public hearing.
