The Board of Town Trustees took the following action during a Regular Meeting, held on
January 22, 2003 regarding the above matter.
WHEREAS, Eh-Consultants, Inc. on behalf of Martha & James Baker applied to the
S outhold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town
of Southold, application dated December 27, 2002
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
January 22, 2003 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code.
WHEREAS, the Board has determined that the project as proposed will not affect the health,
Safety and general welfare of the people of the town.
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approved the application of MARTHA & JAMES
BAKER for a Wetland Permit to clear (as necessary) portion of property within 100 feet of tidal
wetlands and install pervious driveway and public water service.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Fee must be paid, if applicable and permit issued within six months of the date of this
notification.
If inspections are required, at a fee of $5.00 per inspection (See attached schedule).

At the meeting of the Southold Town Conse~ation Advisory Council held Wednesday,
January 15, 2003, the following recommendation was made:
Moved by Melvyn Morris, seconded by Tom Schlichter, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH
A CONDITION of the Wetland Permit application of MARTHA & JAMES BAKER to
clear (as necessary) portion of property within 100' of tidal wetlands and install pervious
driveway and public water service. Construction of a dwelling and other site
improvements are located more than 100' from the tidal wetlands.
Located: 1600 Grathwohl Rd., New Suffolk. SCTM#117-4-4
The CAC recommends Approval of the application, however a violation should be
issued for the trees that were taken down within 100' of the wetlands.
The CAC recommends that the large tree between the house and the garage remain.

Dear Mr. Krupski:
I received a copy of a letter from Evelyn Daskin, the easterly adjacent neighbor, indicating that the site plan
we originally submitted incorrectly identifies her property as being connected to public water. We
understand Ms. Daskin's claim to be correct.
Because the surveyor did originally believe Ms. Daskin's property to be connected to public water, we
situated the proposed sanitary, system as close to her property as possible in order to achieve the greatest
possible setback t~om the wetlands located across Grathwohl Road. In light of this new information,
however, the Bakers have completely redesigned their site plan to situate the sanitary system in the front
yard, where it would be situated as far as possible from Ms. Daskin's well yet still more than 100 feet from
the nearby wetlands and beyond the Board's jurisdiction. Three (3) copies of a revised site plan depicting
these changes are attached hereto, and the property will be staked accordingly prior to your January 20tn
inspection to confirm the validity of our non-jurisdiction request.
Though emplacement of the sanitary system and all new construction will in fact be located beyond your
jurisdiction anyway, we do wish to assure the Board that there will be no future need to submit a permit
application to place the sanitary system within your jurisdiction because the Suffolk County Department of
Health Services Board of Review has already granted variance approval to the prior owners for an almost
identically situated sanitary system (copy attached). Despite its nonconforming separation distance, the
proposed sanitary system is located significantly downgradient from Ms. Daskin's property, rendering
impossible its ability to adversely impact her well.
