The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wed., August 22,2007:
RESOLVED, that the Southold Town Board of Trustees APPROVE the request for a Transfer of
Permit #6279 from Steven losquadro to Steve & Linda Figari, as issued on January 18, 2006,
and Amended on May 17, 2006, and,
BE IT FUTHER,
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Permit
#6279 to install a new French drain from the northeast corner of the property to a new drywell to
be installed at the southwest corner of the property, and add 50 cy. of fill and topsoil at the
northeast and east side of dwelling, and as depicted on the plan prepared by Creative
Environmental Design received on July 31,2007.
This is not a determination from any other agency.

Dear Members of the South old Board of Trustees,
This is in reference to the application for amendment to permit #6279 by Steve & Linda
Figari at 1150 Fanning Road in New Suffolk (SCTM #1000-117-06-33). We are the
adjacent property owners to the east of the referenced property. During the 34 years
that we have lived in our home, we have experienced a variety of flooding conditions in
our immediate area. We have had flood waters from the creek come up and over the
road into the wetland area on our side lot and flow back into what is now Figari's
property. We are concerned that adding 40 cu. yards of fill to the wetlands along our
property line will block the natural flow of flood waters and cause our lot to incur more
severe flooding than we have had in the past. We are neither engineers nor wetland
experts, but trust that you will be our "safety net" when you consider this request.
Please carefully examine the possible outcomes of any changes to the land elevation
as it effects the surrounding properties especially during times of heavy rain or coastal
flooding.
We are certainly not opposed to our new neighbors landscaping their property to their
satisfaction as long as it doesn't cause a hardship for others as a result. We look
forward to hearing the outcome of your review of the proposal and thank you for your
service to our town.

The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, May 17, 2006:
RESOLVED, that the South old Town Board of Trustees APPROVE the Amendment to
Permit #6279 to allow for the placement of 982 cy. of fill for the septic system and all as
per plans prepared by Burton, Behrendt, Smith and approved May 10, 2006 by James
F. King with the conditions that water from digging the septic system be pumped into the
foundation, the fill on the eastern property line be regraded away from the Phragmites,
and there be an inspection by the Trustees after the final grading has been completed.
This is not a determination from any other agency.

Dear Mr. King,
I received a call from Heather Cusak of your agency who informed me of
neighborhood complaints relating to fill being placed upon the lot referenced
above. The proposed dwelling benefits from a Building Permit issued by the
Town and a Wetland Permit issued by your Board.
While not specified in the filed survey with your office, the overall project
featured a raised septic system surrounded by a retaining wall. This is a septic
design required by the Health Department and its purpose is to insure that the
septic leaching rings are suitable elevated above groundwater.
In any event, I have been assured by Manzi Homes that no fill will be
brought to the site until the Trustees grant the appropriate authorization to do so.
I have also requested that the surveyor provide an amendment the survey to
make clear any issues relating to proposed grading and a fill calculation. The
survey will be filed with your office as a permit amendment. This should resolve
any concerns the Town and neighborhood may have regarding this project.

The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, May 17, 2006:
RESOLVED, that the Southold Town Board ofTrustees APPROVE the Amendment to
Permit #6279 to allow for the placement of 982 cy. of fill for the septic system and all as
per plans prepared by Burton, Behrendt, Smith and approved May 10, 2006 by James
F. King with the conditions that water from digging the septic system be pumped into the
foundation, the fill on the eastern property line be regraded away from the Phragmites,
and there be an inspection by the Trustees after the final grading has been completed.
This is not a determination from any other agency.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, January 18, 2006 regarding the above matter:
WHEREAS, Bruce Anderson as agent for STEVE LOSQUADRO applied to the
Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold
Town Code, the Wetland Ordinance of the Town of Southold, application dated
December 22, 2005, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on January 18, 2006 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,

Dear Ms. Tetrault,
As requested by Mr, Anderson of this fin'm, I have recently inspected the above referenced property for the
presence of wetlands. While there is a small stand of Phragmites adjacent to the subject property, which is
apparently intermittently flooded by storm water runoffdirected from a street drain, I am of the opinion that
it does not constitute a freshwater or tidal wetland. The mere presence of Phragmites does not necessarily
constitute a wetland. Phragmites is a facultative wetland species that grows well in upland areas as well as
wetlands. In the subject case, the Phragmites is the only wetland indicator present, and there are other
upland species growing within and mound the Phragmites. Further, a brief inspection of the underlying soil
indicates that it is not hydric, and there are no indicators of wetland hydrology (stained leaves, water stains
on the Phmgmites, etc.)
Therefore, while the adjacent property may be intermittently flooded by the existing street drain, it is our
opinion that the soils are not saturated long enough f~r ~he stand of Phragmites to identified as a wetland.
In addition, there are no freshwater wetlands depicted on the NYSDEC freshwater wetland maps in the
vicinity of this property.
By way of this correspondence, 1 request that you place this matter before the Board during its work session
on August 24th, 2005.

Dear Mrs. Tetrault,
Enclosed herewith please find a site plan prepared by this office dated
May 6, 200,5 for the property referenced above. I was requested to inspect the
property for the presence of freshwater wetlands. I did so and am of the opinion
that there are no freshwater wetlands on or adjacent to the property.
I observed the presence of a street drain at the corner of New Suffolk
Avenue and Fanning Road which is indicated on the site plan. There is an area
which extends westwards from the street drain that contains Phragmites and
invasive early successional field growth. That area is shown on the site plan.
There is no doubt that significant disturbance has taken place in this area. I

Dear Mr. Krupski,
As you know, this Firm represents Mr. Losquadro, owner of the above referenced
property, who is seeking all required regulatory permits to improve thereon. Monzi
Homos, the contractor on this project, applied for and received a Town of Southold
building permit. Subsequently, upon project commencement, a stop work order was
issued to Monzi Homos on the basis that Monzi Homos conducted clearing adjacent
to a "wetland' area without benefit ora permit from your Board. It is our position that
the "wetland" area is essentially a monoclonal stand of Phragrnites and does not
constitute a "freshwater wetlands". The Phragmites also surrotmds a street drain whose
purpose is to capture stormwater runoff and discharge it into the surface waters of School
House Creek to the east, Brace Anderson of this Firm has inspected the discharge
culvert, and believes that the discharge culvert may have partially collapsed causing
water to back up to the street: drain. An application was received by your Board on the
December 16th for clearing of approximately 360 square feet of Phragrnites on subject
parcel. In a meeting on December 19th with Ms. Tetrault, it was indicated that an
application including the proposed dwelling was needed based on the contention that the
eastern area of subject parcel contains a "wetland". It remains our contention that this
area of Phragmites is simply that and not a freshwater wetland. In any event, please find
enclosed herewith a completed Southold Town Board of Trustees Wetlands Application.
Application contents are as follows:
