James F, King, President Jill M, Doherty, Vice-President Peggy A Dickerson Dave Bergen Bob Ghosio, Jr, Town Hall 53095 Route 25 P,O, Box 1179 Southold, New York 11971-0959 Telephone (631) 765-1892 Fax (631) 765-6641 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD August 22, 2007 Mr. AI Strazza P,O, Box 345 New Suffolk, NY 11956 RE: 1180 GRATHWOHL RD., NEW SUFFOLK SCTM#117 -1-16 Dear Mr. Strazza: The following action was taken by the South old Town Board of Trustees at their Regular Meeting held on Wed., August 22,2007: WHEREAS, AL STRAZZA applied to the South old Town Trustees for an Amendment to Wetland Permit #5132 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated July 27, 2007, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, in accordance with Chapter 268, said application was found to be Exempt from the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Permit #5132 to add one (1) cross-bracing on the seaward end of the existing dock, and as depicted on the plan prepared by AI Strazza received on February 29, 2008. . 2 This is not a determination from any other agency. SCTM#117- 1-16 The addition of cross bracings on an existing previously permitted dock is an exempt Minor Action and not subject to LWRP review pursuant to Chapter 268-3; Items A and B ofthe Town of South old Town Code. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of South old Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the L WRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is exempt from review pursuant to Chapter 268-3, Exempt Minor Actions, item B, which states: A. Maintenance or repair involving no substantial changes in an existing structure or facility; B. Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including upgrading buildings to meet building or fire codes, except for structures in areas designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated or reconstructed without a permit . . On or about October 6, 2000, I hired Proper -T Permit Services (Jim Fitzgerald) of'Cutchogue to prepare for me a permit to build a simple homcowncr's fLxcd dock and s~mtfing float on my propcrty which/s adjacent to West Crcck in New Suffolk and to follow, expedite, and obta/n the numerous permits required for a wetland. After rc~,iewing his inkial permit sketch, I requested changes for both strength and safer}, reasons. On March 24, 2001, I was notified by Mr. Fitzgerald that my permit was approved but that the swimming float had to be moved approximately 30' by 25' from thc dock in order to obtain approval from thc Board of Trustees. Since I considered this change to be unsafe to boaters and individuals crabbing at night, I decided not to build the float. On or about August 18, 2001, I hired Rccvcs Dock Build~'s to build my dock and nutificd thc various government d~partm~ Dcpt of Army CeE, NYSDEC, and the Sonthold Town Board. I also decid~ not to conduct their first inspection, and [ was told to complete the docl{,J~ 9/12/0 I, the entire Southold Toga Board of Trustees and secretary arrived at my dock unannounced, with icc cream cones in hand, in an unmarked van. Not knowing who they were, I asked them and was informed that they were the as, the dock was the ' ugliest thing the}' ever saw", that I used an ins~'ticid¢ to kill the x~gctation an>und my dock (completely untrue and unfounded), that I was ruining the pristine cnviroameat of West Creek by having safety rails, and that I had ruined the "berm" by placing a slightly inclined ~alk, and had violated my pcn~. I tried to tell tbera that I had small graml-chil&~ and ~s pcmm~emly handicapped which was the reason for the walk and safety rail. They told me that the dock without the safety rail was safer than one ~4th a rail. ginc~ thc-re was no reasoning with them and I considered them to be tntally unpro£cssional and authorilative power hungry bullies, rather than knowledgeable or experienced, ! requested that they issue their ,iolations in writing for my review and that I wonld resubmit a revised pcrmit. As we were working, the bay constable (SBC Dzenkowski ) arrived with the complaint in hand, and performed an inspection. He k~sued a ticket for a permit ~5olafion for thc safety mil only. He found no other viohtions. Jim Fitzgerald later informed me that he did not make the changes that I requested because the Board of Trustccs would only approve a low profile dock, and hc apologized for not informing mc of his decision. I asked on what basis the board based their renews and decisions since I conld not find a town code for a homco,~aer dock or lev, profile only. I was informed by Mr. Fitzgerald that there is no town code that he is a;~are of and that a Iow profile dock is a relatively new requirement of the Board of Trnsteos and if you want a dock, yOu don't buck city hall. This arbitrao, subjective attitude and apparent abuse of power by the Board of Trnstees was mind boggling to me so I pleaded "Not Guilt3.," and requested a "Waiver Hcanng" which was granted and held on October 24, 2001. I came in from California v, berc I am working as an Engineering Consultant to attend this hearing. At this hearing, I informed the Board that I ;~as unaware that I had violated the permit but was not using that fact as an excuse. I notified them that I was a Pcmmrtcntly Disabled Person with proper documentation and that they were violating the ADA (Americans Disability Act) and general safety regulations by denying mc a dock vdth a safct~ rail. I also informed them that I had placed a water stop in front ofm.~ dock to prex~nt rain and street run-off from going into the creek as a result of my dock, which was more that the town has done to its boat slip at thc comer of George Rd. and C-rathwoM Rd. I also told them if thc}, were really concerned with the pristine environment of the creek, why ~ts the town slip in such disrepair and not built with provisions to catch rain and street runoff to prevent pollution. Thc board did not know what a water stop g'as, which was strange since Board member Mr. Sm/th was a plumber. I asked him if as a plumber, he knew what a check valve was,( he did), and informed him that a gatcr stop served thc same purpose. At this meeting it was noted that certain members did not know how to read a sketch properly, so I showed them how to properly read a drawing, and also that my dock was built within standard engineering tolerances for a strncture of this type. To my amazement, the Southold Board of Trnst~s did not know ginat the ADA was and all had to be told by thc Town Attorney. In addition, I informed thcm that thc5 wcrc violating standard building codcs in that if you build a house deck, you must have a safety rail or if you put in a swimming pool, .you must have a fence and gate arOund thc pool. Thc), told mc that they set thc rules for what was required, pcdad. Thc Town Attorney asked me why I did not sabrait a revised permit and I informed him that the Board had told mc during thc inspection that thc~ would not approve a revised permit, period. He told mc to submit a revised permit which I did at a cost of $40.00, and as stated by the Board, they denied my revised permit. Thc Term Attorney' also determined that I needed to come to town hall for a pm-trail conference. Thc tow established December 2 I, 2001 for this meeting. Again I traveled from California, arrived for the meeting only to find out that thc Tow Attorney had decided to take thc day off Another non professional in a position of authority. At this point, the lack of professionalism and the inconsideration of my traveling situation can only be considered abusive and harassing.
