The following action was taken at the Southold Town Board of Trustees Regular Meeting on
July 25, 2001
RESOLVED, that the Southold Town Board of Trustees grant a one year extension to Permit
#5040 to construct a single-family residence, driveway, decks and sanitary system with a
condition that there be a 20'non-disturbance buffer from edge of deck - seaward.
However, this determination is not a determ'mation from any other agency.

Dear Mrs. Baer:
The Southold Town Board of Trustees reviewed the survey dated
April 22, 1997 and received in our office on March 7, 2000, and
determined that the the construction of a two-car garage
attached to the southwest corner of the dwelling, 140' from the
wetlands line, to be out of the Wetland jurisdiction, under
Chapter 97 of the Town Wetland Code.
However, any activity within 75' of the Wetland line would
require permits from this office.
This determination is not a determination from any other agency.

part of the consideration for the issuance of the Permit does understand and prescribe to the fol-
lowing:
1. That the said Board of Trustees and the Town of Southold sxe released from any and
all damages, or claims for damages, of suits arising directly or indirectly as a result of any oper-
ation performed pursuant to this permit, and the said Permittez will, at his or be~ ~r. vu expens~
defend any and all such sults inltiated by third parties, and the said Permittee assumes full li.~llity
with respect thereto, to the complete exclnsion of the Board of Tmste~ of the Town of So~thold
2. That this Permit is valid for a period of 24 mos. which is considex, ed to be the

3. That this Permit should be retained indefinitely, or as long as the said Permitme wishes
to maintain the structure or pcoject involved, to provide evidence to anyone concerned that auth-
orization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein au'thotlzed.
6. That there shall be no interference with the right of the public to pass and repass along
the beach between high and low water m~rks.
7. That if future operations of the Town of $oorhold require fl~e removai and/or aiteca0loms
in the location of the work herein authorized, or if~ in the opinion of the Board of Trustees, the
work shall cause unreasonable obstrucoon to free navigation, the said Pennittee will be re,Ired,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of SoutholcL
8. That the said Board will be notified by the Permittee ot the completinn of the work auth-
orized.
9. That the Permittee will obtain all other permits and consents that may be required sup-
plemental to this permit which may be subject to revoke upon failure to obc. ain same.

Dear Ms. Steelman:
The following action was taken by the Board of Town Trustees
during its regular meeting held on August 25, 1999 regarding the
above matter:
WHEREAS, Samuels & Steelman Architects on behalf of HAROLD &
DOTTIE BAER applied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated July 20, 1999 and,
WHEREAS, said application was
Conservation Advisory Council
recommendations, and,
referred to the Southold Town
for their findings and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on August 25, 1999, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
HAROLD & DOTTIE BAER to construct a single-family residence,
driveway, decks, and sanitary system with a 20' non-disturbed
buffer as per approved plans dated July 7, 1999.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

1999, the following recommendation was made:
