As you informed rne today that the Bnard of Trustees failed the inspection of the above-
referenced property, we are hereby respectfully requesting an amendment to our permit tbr the
[bllowing:
To allow for a 35 foot buffer;
To allow for the paved driveway with the installed drywells.
We had been previously advised by the Southold Building Department that the paved
driveway would be acceptable if we installed drywells for drainage. This was completed and our
final inspection was passed by the Building Department on April 6'h. (Copy enclosed fbr your
easy reference). We were told everything else was in order in the file tbr a certificate of
occupancy. As you know these are very hard times. We are currently in a position of
tremendous hardship and in dire need ora certificate of occupancy for this house as a closing is
scheduled in early May. We have been trying to sell it for over two years. We would greatly
appreciate your consideration in granting this amendment as soon as possible and getting on the
earliest next inspection, which you advised was May 6th. Our check for $50.00 for the amended
permit is enclosed herewith. Please advise me if there is anything else we can do to expedite this
situation to obtain our certificate of occupancy. I await your advices.

Dear Mr. Anderson:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, January 18, 2006 regarding the above matter:
WHEREAS, Bruce Anderson as agent for JOSEPH FARRELL applied to the Southold
Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town
Code, the Wetland Ordinance of the Town of Southold, application dated December 16,
2005, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on January 18, 2006 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the
Southold Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of JOSEPH FARRELL
to construct a 1,196 sq.ft. Single-family dwelling, pervious driveway, sanitary system, with the
conditions of a hay bale line and snow fencing during construction to designate that area to not
be cleared and to protect the waterway from debris and runoff, a 50' non turf, non disturbance
buffer, dryweIIs to contain roof runoff, and all as per plans surveyed by Hands on Surveying,
dated December 3, 2001, received by the Board December 16, 2005, revised with haybales and
snow fencing, and approved January 18, 2006.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

At the meeting of the Southold Town Conservation Advisory Council held Wed., January
11,2006, the following recommendation was made:

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approved the application of Joseph Farrell for a
Wetland Permit to construct a 1,196 square foot +/- (footprint) private single family dwelling,
driveway sanitary system and private well with the stipulation that the sanitary system will be
100 feet or greater from the delimitation line and also a non-turf buffer line on the back of the
house, as per plan submitted.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Fee must be paid, if applicable and permit issued within six months of the date of this
notification.
If inspections are required, at a fee of $5.00 per inspection (See attached schedule).

The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is generally CONSISTENT with the Policy Standards and therefore is
CONSISTENT with the LWRP provided that the following standard best management practices
are implemented to further the intent of Policy 5: Protect and Improve Water Quality in the
Town of Southold
1. Require erosion and sediment controls (haybales, silt fencing) to protect the
wetland system to thc north of the property.
2. Require that the driveway be pervious.
Require native disease-resistant and drought-tolerant landscaping to minimize
irrigation and fertilizer applications. Additionally, retain ali large trees outside
of the building envelope.
The survey identifies a proposed clearing and ground disturbance line, however,
no conditions beyond that are proposed (i.c labeled as a undisturbed buffer)
Due to small size of the parcel require the maximum width attainable for a non-
fertilized/non disturbed buffer to minimize lawn areas adjacent to the wetland
system.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its whtten determination regarding the consistency of the proposed action.
