Dear Mr. Edson:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., September 21,2005 regarding the above matter:
WHEREAS, LEWIS L. EDSON applied to the Southold Town Trustees for a permit
under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance
of the Town of Southold, application dated August 30, 2005 and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 21,2005, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of LEWIS L. EDSON to
construct a single-family dwelling, garage, and deck, with the condition drywells and
gutters are installed to contain the roof run-off, and the area seaward of the 12' contour
will remain as a non-disturbance buffer, and as depicted on the survey prepared by
Joseph A. Ingegno last dated September 28, 2005.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

WHEREAS, at the meeting held on September.21,2005 the Board of Trustees advised
the applicant that a sanitary system is not allowed under Chapter 37 in a BEACH area,
under 37-15D and, that Chapter 37 would not allow a permit to be granted for this portion
of the project, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 21,2005, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, this application is for a sanitary system within the Coastal Erosion Hazard
Area, as defined in Chapter 37, and,
WHEREAS, under Chapter 37, sanitary systems are not permitted within the Coastal
Erosion Hazard Area, and,
WHEREAS, the proposed sanitary system is to be installed in the BEACH area adjacent
to Long Island Sound, and,
WHEREAS, under Chapter 37-15D "All development is prohibited on beaches unless
specifically provided for by this Chapter" and,
WHEREAS, a sanitary system in a BEACH area is not specifically provided for under
Chapter 37, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
NOW THEREFORE BE IT RESOLVED, that the Board of Trustees DENY WITHOUT
PREJUDICE the application of LEWIS EDSON to install a sanitary system within the
Coastal Erosion Hazard Area because of the above reasons and determinations,
BE IT FURTHER RESOLVED that this determination should not be considered a
determination made for any other Department or Agency, with may also have an
application pending for the same or similar project.

Dear Mr. Edson:
On May 6, 1994, the New York District, U.S. Army Corps of
Engineers, received a copy of your Joint Application for Permit
requesting authorization to construct a single-family dwelling
above the spring high tide line of Long Island Sound, at Orient,
Town of Southold, Suffolk County, New York.
Our review indicates that since the proposed work does not
appear to include dredging or construction activities in or over
any navigable waters of the United States, the placement of any
dredged or fill material in any waters of the United States
(including coastal or inland wetlands) or the accomplishment of
any work affecting the course, location, condition or capacity of
such areas, a Department of the Army permit will not be required.
Care should be taken so that any fill or construction
materials, including debris, do not enter the waterway to become
a drift or pollution hazard. You are to contact appropriate
state and local government officials to ensure that the subject
work is performed in compliance with their requirements.

in reference to the above application, I have reviewed it for completeness
and advise that the application be accepted for filing. I understand that the
requisite filing fee ($250) was included with the application.
Please note that the applicant does not appear to have submitted the
application within the mandatory thirty (30) day time period. However, inasmuch
as the applicant has requested that the Town Board waive this time period, I
suggest the Town Board decide whether and how it shall hear the appeal.
Please transmit a copy of the appeal to the Commissioner of the DEC in
accordance with Section 37-35(B).

Dear Mr. Edson:
On December 17, 2004 the Depat h,ent received a Coastal Erosion Hazard Area (CEHA)
Designation Appeal completed by you for property located on Stephenson Road in the Town of
Southold. The pmpv~ty is found on CEHA Map 18 of 49 maps that cover the CEHA jurisdiction
in the Town of Southold.
Coastal Erosion Management Regulations (6 NYCRR Part 505) subpart 505.10 lists the
criteria for appeals of erosion hazard areas. As stated in 6 NYCRR Part 505.10(e),
The sole acceptable basis for an erosion hazard area designation appeal
is technical information indicating that:
(1) the long-term average annual rate of shoreline recession was
incorrectly established; or
(2) the subject area wa~ erroneously identified as a natural
protective feature area.
The appeal challenges the det~mdnation of the subject area as a natural protective feature
since there are no long-term average annual rates of shoreline recession established for this area.
After visiting the site, it is apparent that the subject area was erroneously identified and that the
CELIA Frae needed to be moved to reflect the appropriate landward limit of the natural protective
feature. The pmpen'y located to the east of your lot contains a bluff for which the CEHA line is
placed accordingly. The property to the west contain.q a beach as the most landward natural
protective feature. Your property transitions from the low lying beach ama located to the west on
up to the beginning of a bluff that continues along the shore to the east.
The mapped CELIA line that traversed your property picked up an inland feature that is
not considered a bluff. The new line represents the appropriate setback for a beach, the most
landward natural protective feature found on the property. The fronting beach contains an area of
debris with inte~-trdttent and sparse vegetation that is temporary in nature. Towards the back of
the beach is the line of permanently established vegetation from which a 100 foot setback has
been used for the placement of the revised CEHA linc. The CEHA line is now properly located
per the definition of beach as found in town code and as per 6 NYCRR Part 505.2(c). This line
follows the setback for the beach until it picks up the bluff setback to the east.

Dear Mr. Krupski:
Enclosed you will find a new Coastal Erosion Map delineating the revised Coastal
Erosion Hazard Area (CEHA) boundary line for the Town of Southold (Map 18 of 49).
In accordance with 6NYCRR Part 505.10, local property owner Lou Edson appealed the
CEHA designation ora natural protective feature mapped on a portion of his property. After
reviewing the appeal and visiting the site, it was determined by the NYSDEC Region 1 Coastal
Erosion Representative, Eric Star and myself, that the subject area was erroneously identified as a
bluff. The most landward natural protective feature on Mr. Edson's property is a beach. Because
them is not a bluff or a primary dune landward of the beach, the amended CEHA line is now one
hundred feet from the line of permanent vegetation, which is the landward limit of such a beach
as defined in 6NYCRR Part 505.2 subdivision (c).

On December 17, 2004 the Department received a Coastal Erosion Hazard Area (CEHA)
Designation Appeal completed by you for property located on Stephenson Road in the Town of
Southold. The property is found on CEHA Map 18 of 49 maps that cover the CEHA jurisdiction
in the Town of Southold.
Coastal Erosion Management Regulations (6 NYCRR Part 505) subpart 505.10 lists the
criteria for appeals of erosion hazard areas. As stated in 6 NYCRR Part 505.10(e),
The sole acceptable basis for an erosion hazard area designation appeal
is technical information indicating that:
(1) the long-term average annual rate of shoreline recession was
incorrectly established; or
(2) the subject area was erroneously identified as a natural
protective feature area.
The appeal challenges the determination of the subject area as a natural protective feature
since there are no long-term average annual rates of shoreline recession established for this area.
After visiting the site, it is apparent that the subject area was erroneously identified and that the
CEHA line needed to be moved to reflect the appropriate landward limit of the natural protective
feature. The property located to the east of your lot contains a bluff for which the CEHA line is
placed accordingly. The property to the west contains a beach as the most landward natural
protective feature. Your property transitions from the low lying beach area located to the west on
up to the beginning ora bluffthat continues along the shore to the east.
The mapped CEHA line that traversed your property picked up an inland feature that is
not considered a bluff. The new line represents the appropriate setback for a beach, the most
landward natural protective feature found on the property. The fronting beach contains an area of
debris with intermittent and sparse vegetation that is temporary in nature. Towards the back of
the beach is the line of permanently established vegetation from which a 100 foot setback has
been used for the placement of the revised CELIA line. The CEHA line is now properly located
per the definition of beach as found in town code and as per 6 NYCRR Part 505.2(c). This line
follows the setback for the beach until it picks up the bluff setback to the east.

Enclosed you will find a new Coastal Erosion Map delineating the revised Coastal
Erosion Hazard Area (CEHA) boundary line for the Town of Southold (Map 18 of 49).
In accordance with 6NYCRR Part 505.10, local property owner Lou Edson appealed the
CEHA designation ufa natural protective feature mapped on a portion of his property. After
reviewing the appeal and visiting the site, it was determined by the NYSDEC Region l Coastal
Erosion Representative, Eric Star and myself, that the subject area was erroneously identified as a
bluff. The most landward natural protective feature on Mr. Edson's property is a beach. Because
there is not a bluffor a primary dune landward of the beach, the amended CEHA line is now one
hundred feet from the line of permanent vegetation, which is the landward limit of such a beach
as defined in 6NYCRR Part 505.2 subdivision (c).

LEWIS L. EDSON requests a Wetland Permit & Coastal Erosion Permit to construct a single-
family dwelling, deck, and sanitary system. The property fronts Long Island Sound and also lies
within the FEMA Flood Insurance Rate Map Zones VE el 15, VE el 13 and AE el 11. The
proposed residence is located in Flood Zone AE el 11 and southeast of the Coastal Erosion
Hazard Area. The parcel proposes a private well for water supply.
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is generally CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP provided that the following standard best
management practices and Policy directives are implemented.
To further the intent of Policy 4.1 "Minimize losses of human life and structures
from flooding and erosion hazards." The following management measures to
minimize losses of human life and structures from flooding and erosion hazards
are recommended:
.4. Minimize potential loss and damage by locating development and structures away
from flooding and erosion hazards.
Avoid development other than water-dependent uses in coastal hazard
areas. Locate new development which is not water-dependent as far
away from coastal hazard areas as practical.
a. No development is permitted in natural protective feature
areas, except as specifically allowed under the relevant
portions of 6 NYCRR 505.8.
b. Avoid hazards by siting structures to maximize the distance
from Coastal Erosion Hazard Areas.
Provide sufficient lot depth to allow relocation of structures and
maintenance of required setbacks over a period of thirty years.
Manage development in floodplains outside of coastal hazard
areas so as to reduce adverse environmental effects, minimize
the need for future structural flood protection measures, or
expansion of existing protection measures and to meet federal
flood insurance program standards.
In the event that the application is approved, to further the intent of Policy 5,
require surface water quality protection measures for constructed areas
generating runoff (gutters, downspouts, dry wells and pervious driveways).
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.
