JACOBS Superintendent Highway Department Town of Southold Peconic Lane Peconic, N.Y. 11958 Tel. 765-3140 '734-5211 November 13, ~998 To: Southold Town Board I am requesting the Town Board consider awarding the gasoline and diesel fuel bid to Petro as the price difference between bids is minimal, (enclosed)' The reason behind this request being All American in the past was awarded the bids and did not adhere to the contract on numerous occasions, Phone calls had to be made for deliveries and on one occasion gas had to be purchased from Tuthill-Magee during bad weather conditions because All American did not respond. The accounting department has had many incidences of billing problems, danice will verify this. I have enclosed past correspondence for your review. Petro was awarded the bid for the year 1998 and ful- filled the contract without a flaw. I would consider them the most responsible bidder. >~n~d L. (letter to accounting enclosed) Many repeated calls had to be made by my stock clerk to check on deliveries each time. (note enclosed) Not one delivery was made within the eight hours required. My stock cierk was also toId by Juiie from the office of Aii American that they did not want to deiiver Iess than nine hundred gaiions of diesei at a time. The contract caiis for a guarantee of two hundred fifty gaiions, The truck driver told my stock cierk to order one hundred gaiions iess than we need each time because he can't return with any product on the truck. This is not in the contract. The most~ecent problem was between snow storms on February 9th and 14th. An order was piaced at 8:00 a.m. on Wednesday, February 9. This delivery was not made until Thursday, February 10 at 11:00 a.m., twenty-seven hours after the order. At 3:30 p.m. on February 10 another order was placed, At 11:00 a.m, on February 11 my Oeputy received a caii from Ali American stating they could not make the delivery a totai of nineteen and a half hours after the phone order. During that afternoon we were dangerously iow on gas and involved in a serious snow storm. I calied TuthiliMagee and they delivered within two hours - filiin9 our tanks. RE: Purchase of gasoline pass the December 31, 1993 date from Tuthiii/Magee and not Ail American who had been awarded the bid for the year 1994 All American was called to make a delivery on January 6th at 9:00 AM. The response from their secretar~ was that they would get back to us. After no response by 3:00 P.M. another call was made to them with the same answer. They never returned our call. Ne were halfway through a snow storm and our gasoline supply was gett$$g very low. Friday, January 7th at 8:00 A.M. I called All American and asked to speak with someone in charge, the answer to this was that he is out of town. I then asked when we might expect a delivery. Again, the answer was she would get back to me. At 11:00 A.M. this date, I called and explained we were almost out of gasoline and to cancel our order. Box 954 Syosset, NY 11791 Re: Contract with Town of Southold Dear Mr. Kovac: Per your request, I have checked with the Highway Department regarding their request that you repair the broken meter pursuant to your contract. As you know, the contract provides that "Vendor receiving award must supply sen/ice for any and all repairs or replacements on town owned pumps'. Contrary to your pricr understanding, the meter you have been asked to repair has not been broken since you assumed the contract. It has had breakdowns, but the t~as aided you by correcting the problems and the meter has been running. The current breakdown is beyond the town's capacity to repair, so you are called upon to perform the repair as mandated by the terms of the contract. The broke.0 meter is on a pump which is used primarily when the highway department is very busy. A functioning meter is necessan/so that we can tract the fuel being used at that time. A busy time will begin on November 17, 1997 and the repair must be effected by that date. Please provide sen/ice to the broken meter prior to November 17, 1997 as mandated by the terms of your contract. Irregardless of how lon9 it has been inoperable, according to the 1997 contract awarded your company, you are responsible for the repair. Please review your 1997 contract. If you do not intend to abide by the contract and make the necessary repairs immediately, advise me without delay so I can proceed further. Box 1935 Syosset, NY 11791 Re: Fuel Oil Contract with Town of Southold Dear Mr. Kovac: There is a contract between the Town of Southold and All American Fuel for the supply of fuel to the Town. Nick, in the Accounting Department of RAD Oil Inc., has advised the Town that he intends to breach the contract by refusing to provide fuel after February 20. Be advised that the Town objects to any discontinuation of service and will treat any such action by All American as a breach of contract, and will obtain fuel elsewhere. The following is a summary of the Town's position. The Town was not billed for the fuel delivered in January. On February 8, Town Account Clerk, Connie Solomon, called All AmeFican to request an invoice. She was told they would make inquiries. On February 13, Nick of RAD Oil called for payment of the bill. He appeared unaware of the prior request to All American and asked for written confirmation of the request for a bill. Ms. Solomon confirmed that request in a letter to Nick dated February 13. On February lU~, an invoice was received by Federal Express delivery. The invoice was incomplete since it failed to provide verification of the rack price used. On February 15, Ms. Solomon requested Nick to provide that verification. He said that the Town was responsible for getting that information. Ms. Solomon called Jay at All American, and was told that it would take time, but the information would be provided. On February 20, Nick from RAD called and threatened to discontinue service if the bill was not paid immediately. Be advised that the fourth paragraph of the Bid Specifications clearly provides that "verification of the rack price used by the bidder must be supplied by the biddeF to the Town upon request." Until All American complies with this requirement, the Town will not make payment. I suggest you consult with your billing department to correct this error and to ensure proper communication in your internal accounting procedures. Any refusal to provide service in the interim will be treated as a termination of the agreement between the Town and All American.
