This Permit is issued by the United States Environmental Protection Agency ("EPA" or
"Agency") under authority of the Resource Conservation and Recovery Act ("RCRA") of
19'76, Subtitle C, 42 U.S.C. Sections 6921-8931, the Hazardous and Solid Waste
Amendments ("HSWA") of 1984, and EPA regulations promulgated pursuant thereto, to
Chemicat Pollution Control, Inc. of New York in which 21st Century Environmental
Management Company (the Owner) and CPC, Inc. (the Operator) (hereina~er
collectively referenced as the "Permittee"), to operate a hazardous waste storage
facility located at 120 South Fourth Street, Bay Shore, New York.
· In accordance with HSWA, this Permit requires the Permittee to:
Submit a Hazardous Waste Reduction Plan (HWRP) that describes the technical
and administrative procedures and programs designed to minimize hazardous
waste generation;
2. . Comply with applicable land disposal restrictions;
Comply with all federal regu[atian~ which pertain to the management of Toxicity'
Characteristic (TC) waste in cootafners; and tanks;
Comply with organic a~eemissions

requirements; and
Comply with any other applicable statutory or regulatory requirements imposed
pursuant to RCRA and HSWA.
'Fhis Permit, in conjunction with the 6 NYCRR Part 373 Permit issued 'Sy the State of
New York, constitutes the RCRA permit for this facility.
The Permittee must comply with all terms and conditions of this Permit. This Permit
c~nsists of the conditions contained herein Module I pages I-1 to 1-12, Module II page
I[-1, Modute Iil pages I[l-1 to III-2, Module IV pages W-I to IV-2, Module V pages V-1 to
V-3, Module VI pages VI-1 to VI~, Module VII page VII-1 to VII-4, and the applicable
regulations contained in 40 C.F.R. Parts 124, 260 through 264, 266, 268, and 270 as
specified in this Permit. Applicable regulations are those which are in effect on the
date of issuance of this Permit, except as provided in 40 C.F.R. § 124.86(c) for RCRA
permits being processed under Subpart E or F of Part 124 (see 40 C.F.R. § 270.32(c)).
A permit may be modified, however, to incorpora!e new regulations pursuant to
40 C.F.R. § 270.41(a)(3) and 40 C.F.R. § 270.32(c).
This Permit is based on the assumption that the information provided in the Permittee's
Part B application, submitted on March 31, 1995, as modified by subsequent
amendments d.~ted June 28, 1995 through July 24, 1995 is accurate Further, this
Permit is based, in pert, on the provisions of Sections 206,212, and 224 of HSWA,
which modify Sections 3002, 3004 and 3005 of RCRA. The Permittee's failure in the
applica(ion or during the permit issuance process to disclose futly all re!event facts, or
tt'~e Permittee's misrepresentation of any relevant facts at shy time may be grounds for
the termination, revocation and reissuance, or modification of this Permit (see
,4.0 C.F.R. § 270.41,270.42 and 270.43) and potential enforcement action. The
Permittee must inform EPA of any deviation from or changes in the information in the
application which would affect the Permittee's ability to comply with the applicable
regulations or permit conditions.
'i'his Permit is effective as of occobe.,- 14, L997 , end shall remain in effect until

Dear Waste Transporter:
The New York State Department of Environmental Conservation has instituted an
interim restructuring of the waste transporter permitting program. These are temporary
measures designed to provide immediate relief to the industry and are based, in fargo part,
on recommendations from the industry. The requirements of the interim program are
effective as of July 31, 1996 and remain in effect until further notice.
The requirements are as follows:
1. ALL CURRENTLY VALID WASTE TRANSPORTER PERMITS ARE AUTOMC, TICALLY
EXTENDED UNTIL FURTHER NOTICE. By virtue of this letter, all permits are considered to
be automatically renewed at the end of the current permit term. Until further notice
transporters do not need to submit an application for renewal. Instead, carry a copy of the
most recent permit and a copy o¢ this letter in each vehicle transporting waste.
2. AT THIS TIME, TRANSPORTERS DO NOT NEED TO MODIFY A PERMIT TO ADD
SPECIFIC WASTE RECEIVING FACILITIES. Transporters may take waste to any authorized
facility. It is the responsibility of the transporter to ensure that the waste delivered
conforms to the operating requirements of the receiving facility and to maintain records of
the amount of each waste type delivered to each faciliw. Transporters no longer need to
modify the existing waste transporter permit to add specific receiving facilities or waste
types.
3. TRANSPORTERS MUST CONTINUE TO NOTIFY THE DEPARTMENT OF VEHICLE
CHANGES. Transporters must continue to submit written application which will serve as
notice of vehicle additions or deletions. However, the transporters no longer need to wait
until they receive an amended permit beforausing added vehicles. Instead, carry in each
new vehicIe a copy of the written request submitted to the Department. This will serve as
temporary authorization to carry waste in the vehicles listed.
4. TRANSPORTERS MUST CONTINUE TO PAY REGULATORY FEES.. Transporters
will continue to be billed for the regulatory fee based on the number of vehicles included on
the' permit. Providing' the Department with up-to-date notification regarding the vehicles
used will help ensure that billing is accurate. For this reason, notification of deletions is as
important as notification of additions.

GENERAL CONDITIONS
The permittee must:
Carry a copy of this waste transporter permit in each vehicle authorized to transport waste.
Failure to produce a copy of the permit upon request is a violation of the permit.
Display the full name of the transporter on both sides of each vehicle and display the
five-character waste transporter permit number on both sides and rear of each vehicle
containing waste. The displayed name and permit number must be in characters at least
three inches high and of a color that contrasts sharply with the background.
Transport waste only in authorized vehicles. An authorized vehicle is one that is listed
on this permit.
WASTE TRANSPORTER PERMIT NUMBER: IA-042
4. Submit to the Department a modification application for additions/deletions to the
authorized fleet of vehicles. The permittee must wait for a modified permit to be issued
before operating the vehicles identified in the modification application.
5. Submit to the Department a modification application to add a new waste category or to change
the current waste category. The permittee must wait for a modified permit before transporting
new waste types.
6. Submit to the Department a modification application for change of address or company name.
7. Comply with requirements for placarding and packaging as set forth in New York State
Transportation Law as well as any applicable federal rules and regulations.
8. Contain all wastes in the vehicle so there is no leaking, blowing or other discharge of waste.
9. Use vehicles to transport only materials not intended for human or animal consumption unless
the vehicle is properly cleaned.
10. Comply with requirements for manifesting hazardous waste and regulated medical waste as set
forth in the New York State Environmental Conservation Law and implementing regulations.
11. Deliver waste only to transfer, storage, treatment and disposal facilities authorized by
the host state to accept such waste. Permittee must demonstrate that facilities are so
authorized if requested to do so.
12. Maintain liability insurance if transporting hazardous waste or regulated medical waste.
The insurance requirements are:
> $5 million for manifested hazardous waste
> $1 million for unmanifested hazardous waste
> $100,000 for regulated medical waste
13. Maintain records of the amount of each waste type transported to each receiving facility on a
calender-year basis. The transporter is obligated to provide a report of this information to
the Department or any law enforcement officer if requested to do so.
14. Pay regulatory fees on an annual basis. Non-payment may be cause for revocation or suspension
of permit.
15. Submit renewal applications no les¢ than 30 days prior to the expiration date of the permit to:

STATEMENT OF INTENT AND SPECIFICATIONS
CHEMICAL WASTE SERVICES TO TOWN OF SOUTHOLD
FOR REMOVAL OF HOUSEHOLD HAZARDOUS WASTE

I. INTENT
The intent of this bid proposal is to secure one (1) chemical waste hauler
contractor to provide household hazardous ~waste removal services to the
Town of Southold.
l'b~ Town seeks bids for each of two alternatives: ALTERNATIVE #l is a bid for removal of HHW
collected through the Town's existfllg Permanent Household Hazardous Waste Facility. ALTERNATIVE
#2 is a bid to handle, remove, and dispoac of I-IHW on one or more specially designated 'STOP DAYS'
(hercioa~er called 'Events') should thc Town decide to hold such events.
II. DEFINITIONS
Contractor - The chemical waste hauler who is providing the services
for the Permanent Household Hazardous Waste Storage Facility
(PHHWSF). '
HHW - The acronym for Household Hazardous Waste and is the term
which shall include all pesticides and other chemicals or otherwise
harmful or potentially harmful wastes originating only from
residential homes as defined in 6 NYCRR Part 366. Such HHW
items shall only be accepted from residential generators, not from
commercial establishments.
C. PHHWSF - The acronym for Permanent Household Hazardous Waste
Storage Facility, which is where the HHW will be stored. It is
located at the Landfill Site, CR a,8, Cutchogue, New York.

prepare, log, pack, load, remove, and dispose of HflW delivered to the contractor by residents at a time
and place to be determined by the Town.
E. RCRA - The acronym for the Resource Conservation and Recovery Act
of 1976 and subsequent amendments and re-authorizations.
III. SCOPE - ALTERNATIVE t1: SERVICING SOUTHOLD'S PERMANENT FACILITY
HANDLING PROCEDURES AND ASSURANCES.
The Contractor shall guarantee to provide all the professional services,
including, but not limited to, super.vision, labor, equipment and
materials necessary to:
Revise the existing manual of "Standard Operating Procedures"
which will include emergency procedures so that any potential
problem regarding a chemical hazard can be quickly and
efficiently taken care of.
Inspect and remove the drums of HHW at intervals depend on the
rate of collection.
Transport and dispose of said drums of HHW to the appropriate
hazardous waste treatment, storage, or disposal facility (TSDF)
in accordance with all Town, County, NYS-DEC, US Department
of Transportation, and US Environmental Protection Agency
standards, rules and regulations.
Guarantee that all containers supplied to the PHHWSF and used
for packaging and transporting of HHW received are fully in
accordance with US Department of Transportation (DOT)
regulations governing the transport of hazardous materials.
Guarantee to come and pick up all of the filled drums within five
15) working days of being notified by the Town.
Guarantee the presence of qualified employees trained in the
proper handling at the time of removal of the HHW at the Town's
designated site.
Provide on or before two (2) weeks prior to the execution of
contract, proof of all necessary local, state and federal permits
and identification numbers pursuant' to the handling,
transportation, disposal of HHW.

8. The Contractor shall:
a)
Indemnify, save and hold harmless the Town of Southold and
any and all individuals present at the PHHWSF from any and
all liability for bodily injury, property damage, and pollution
contamination arising directly from the Contractor's activities.
b)
Provide the Town of Southold with a Certificate of Insurance
on or before two (2) weeks prior to execution of contract,
which indicates Contractor's insurance coverage for its
employees, equipment and all incidents related to handling,
transport and disposal of household hazardous wastes in an
amount satisfactory to the Town of Southold.
c)
Be in compliance with the insurance requirements of the Motor
Carrier Act of 1980 for the transportation of hazardous wastes
(if applicable) and provide the Town with a Certificate of
Insurance naming the Town as an additional insured on any
policy required by the Act.
TRAINING
Provide eight (8) hour update training for the Town's existing
operators of the facility, and forty (40) hour training for any new
operators designated by the Town. Ail training will include the
proper procedures for:
a) identifying and segregating the in-coming HHW;
b) labeling and preparing the drums of HHW for inspection by
chemical waste hauler prior to shipment; and
c)
completing the forms for the corresponding waste collected within
the fifty-five gallon storag~ drums.
Training for the Town's personnel shall be provided pursuant to State
Department of Labor and Federal OSHA regulations. It shall include
the technical procedures for handling all waste that is accepted as well
as the proper use of the safety eq~.ipment in a manner that is
protective of the public health and welfare and the environment.
EQUIPMENT INVENTORY
The Contractor shall take an inventory of all items and equipment
associated with the Town's existing household hazardous waste
(S.T.O.P.) program and shall determine if such equipment is adequate
to meet current applicable permit and regulatory requirements.
Inventory shall be taken of items including, but not limited to, all
safety and protective equipment, spill control material, necessary signs
and notices, hazardous substance lists, and record-keeping forms.
The Contractor shall provide additional inventory as needed and
requested to meet applicable requirements.
ADDITIONAL SPECIFICATIONS
The Contractor shall review all operating plans and procedures
associated with the Town's existing S.T.O.P. program for compliance
with all applicable permit and regulatory requirements, including those
requirements that may have been enacted since the Town received its
current $.T.O.P. operating permit in June of 1994.
The Contractor will inform the Town of any and all revisions to
current operating procedures that may be necessary to meet revised
permit requirements enacted since the Town received its current
S.T.O.P. operating permit.
While the Contractor and the Town agree that the Federal Resource
Conservation and Recovery Act (RCRA) specifically exempts household
waste from classification as a hazardous waste, both parties agree that
all HHW accepted by the Contractor pursuant to this program will be
handled, transported and disposed of to the extent required of
contractors handling HHW from under NYS-DEC as if such waste was
classified as hazardous or acutely hazardous waste.

Since the PHHWSF is only for collection of household hazardous waste
received from the residents of the Town of Southold and will not be
the recipient of any commercial wastes, the facility is exempt from the
requirements of the NYS Solid and Hazardous Waste Facility permits
pursuant to 6 NYCRR 373-1.1(d)(1)(xvii). All HHW collected shall
be manifested as "exempt" wastes on Hazardous Materials Shipping
Order Form #8-BLS-C4 ("red manifests") pursuant to Title 40 CFR
Section 261.5. The Contractor shall enter the words "Exempt per 40
CFR 261.5" in the space for "shipper's no.".
Duties include the following:
1. Initial preparation of the facility includes supplying:
a. twenty empty fifty-five gallon drums;
"Standard Operating Procedures" Manual that will give
details regarding the proper procedures the operators
shall follow in handling all acceptable material; and
c. proper forms for compliance with State and Federal regula-
tions.
2. RCRA Duties:
a. to complete necessary RCRA paperwork for the disposal
of the drums.
3. Disposal Duties:
inspecting contents of drums to assure proper packaging
labeling of drums as well as to properly seal the drums
for transport.
b. loading drums on truck for removal.
replacing filled drums with empty ones.
providing the Town with the appropriate shipping forms
as well as the final method of disposal and the designated
disposal site for each drum.
Handlin~ Procedures And Assurances.
The contractor will guarantee to provide all services, including but not limited to supervision,
labor, equipment, materials, and other resources necessary to:
Provide for complete, safe, and efficient mobilization, conduct, and de-mobilization of
one or more STOP Events to be given on Town property at a time and place to be
determined by the Town.
Receive, prepare, log, pack, load, remove, and dispose of I-IHW delivered to the
contractor at an Event.
Ensure that all containers used to transport HHW collected at an Event a~e fully in
accordance with US Department of Transportation (DOT) regulations govenfing the
transport of hazardous materials.
Transport and dispose of said containers of HHW to/at the appropriate ha?ardOUS waste
treatment, storage, or disposal facility (TSDF) in accordance with all Town, County,
State, US DOT, and US Environmental Protection Agency (USEPA) standards, rules,
and regulations.
Guarantee the presence at each Event of a sufficient number of qnalified employees,
includin~ the necessa~ supervisory personnel, trained in the proper handikqg of HHW
materials to be collected at an Event.
Provide proof of all necessary local, state, ~.d federal penints and identification
numbers pursuant to the handling, management, Wansportation, and disposal of HHW
