easterly from the easterly end of the arc of a curve connecting the southerly side of
Budd's Pond Road and the easterly side of Bay Home Road;
RUNNING THENCE easterly along the southerly side of Budd's Pond Road, the following
three courses and distances:
1) North 50 degrees 45 minutes 00 seconds east, 51.75 feet;
2) Along the arc of a curve bearing to the right having a radius of 469.26 feet a
distance of 90.09 feet;
3) North 61 degrees 45 minutes O0 seconds east, 23.29 feet;
THENCE south 10 degrees 15 minutes 00 seconds east98.00 feet to the Canal;
THENCE along the canal the following three courses and distances:
1) South 80 degrees O0 minutes 10 secdnds west, 12.15 feet;
2) South 62 degrees 05 minutes 30 seconds west, 54.80 feet;
3) South 20 degrees 05 minutes 40 seconds west, 43.66 feet;
THENCE north 39 degrees 15 minutes 00 seconds west 90.00 feet to the easterly side of
Budd's Pond Road, the point or place of BEGINNING.
Said premises being known as and by the street address: 400 Budd's Pond Road,
Southold, County of Suffolk, New York.
TOGETHER with alt right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anytl~ing
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
