THIS INDENTURE, made the ay of April, 2001 ~'
BETWEEN ELENI RAPANAKIS, residing at 3 Rivihite Street, Roslyn Heights, NY 11733
party of the first part, and DANIEL WILCENSKI and MELISSA WILCENSKI, husband and wife, both residing at
115 Hobart Road, Southold, NY 11971
party of the second part,
WITNESSETH, that the party of the first part, in consideration of TEN and no/100ths ($10.00) dollars paid by
the party of the second part, does herbby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Southold, in the Town of Southeld, County of Suffolk and State of New York, bounded and
described as follows:
BEGINNING at a concrete monument set in the easterly Pine of Boisseau Avenue at the south corner of land
now or formerly of Krukowski, said point also being distant 1156.89 feet southerly as measured along the
easterly line of Boisseau Avenue, from the point or intersection of the easterly tine of Boisseau Avenue with
the southerly line of Yennecott Drive;
RUNNING THENCE from said point or place of beginning along land now or formerly of Krukowski, South 87
degrees 21 minutes 40 seconds East 200.00 feet to land now or formerly of William Moffat, Jr. and a set
concrete monument;
THENCE South 2 degrees 38 minutes 20 seconds West 174.19 feet to land now or formerly of Knutson
Marine and a set concrete monument;
THENCE along said land and land now Codan and later along lands now or formerly of Tomicic, North 89
degrees 54 minutes t0 seconds West 199.79 feet to the eastedy line of Boisseau Avenue;
THENCE along the easterly line of Boisseau Avenue. North 2 degrees 30 minutes 40 seconds East 183.05
feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first pad by deed made by
Stamatios Rapanakis and Eleni Rapanakis, his wife, dated November 14, 1991, and recorded on December
17, 1991 in Liber 11387 cp 421.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appur[enances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
