Dear Ms. Moore:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., August 24, 2005 regarding the above matter:
WHEREAS, Patricia C. Moore, Esq. on behalf of LEWIS & HELAINE TEPERMAN
applied to the Southold Town Trustees for a permit under the provisions of Chapter 97
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated June 28, 2005 and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on August 24, 2005, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of LEWIS AND
HELAINE TEPERMAN for four foot wide stairs and one 4'x4' platform in the middle with
the condition that the bluff be replanted after construction and all as per plans drawn by
Creative Environmental Design dated January 2006.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per ~nspection. (See attached schedule.)
This is not a determination from any other agency.

At the meeting of the Southold Town Conservation Advisory Council held Wed., July 13,
2005, the following recommendation was made:
Moved by Jennifer Mannino, seconded by Don Wilder, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH
CONDITIONS of the Wetland Permit application of LEWIS & HELAINE TEPERMAN to

In accordance with the last meeting, the existing stairs to the
beach require immediate repairs and/or replacement. The house is a
summer home and the stairs to the beach are the only access which are
used extensively in the summer.
We have requested an emergency permit because the stairs are
unstable, the stairs sway and the runs are rotten. The stairs are
extremely dangerous.

Unstable/Poorly Designed Bluff Stairway
1225 Aquaview Avenue (Teperman Residence)

Dear Ms. Moore,
On August 6, 2005, we visited the subject property to survey the existing bluff stairway. The
stairway is of wood construction; contains four (4) straight flights (flights vary in height); five
(5) landings; and, yields a total height of approximately 40 feet. We have attached six (6)
photographs for your reference.
Flight 1 - The riser:tread ratio is 80 and the angle of pitch is 43°. The preferred ratio between
the riser and tread ora stairstep is between 72 and 75; the preferred angle of pitch is between
280 and 36°. The angle of pitch which a stair is considered to be uncomfortable or unsafe is 50°.
The columns and/or footings of this flight are unstable; the entire flight and its lower landing
wobbles as you ascend or descend the stairway.
Flight 2 - The tread of each stairstep varies between 9-inches and 12-inches and the riser of
each stairstep varies between 7-inches and 9-inches. The riser:tread ratio varies between 63 and
108 and the average angle of pitch is 40°. In addition, the rail height varies between 28-inches
and 35-inches.
The columns and/or footings of this flight are unstable; the entire flight and both landings
wobble as you ascend or descend the stairway. The upper landing is pem~anently shifted
toward the east (Photo #3) and the top rail has pulled away from the rail post (Photo #6). In
addition, the lower landing has a 0.08 slope (Photo #4) and it appears that minor repairs have
been conducted in the past (Photo #5).

Flight 3 - The riser:tread ratio is 110, the angle of pitch is 45°, and the rail height varies
between 24-inches and 35-inches. The upper landing is common with the lower landing of
flight #2; its existing condition is described above.
Flight 4 - The tread o£each stairstep varies between 10.5-inches and 13-inches and the riser of
each stairstep varies between 7-inches and 11-inches. The riser:tread ratio varies between 73.5
and 143 and the average angle of pitch is 42.5°. In addition, the rail height vas/es between 26-
inches and 30-inches.
It is our opinion that the entire bluff stairway is unsafe and its condition justifies the need for
emergency repair or replacement. ~

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
