The Board of Town Trustees took the following action during its regular meeting held on
Wednesday November 16, 2005 regarding the above matter:
WHEREAS, Suffolk Environmental Consulting, Inc. as agent for ROBERT FOX CIO
KIMOGENOR POINT COMPANY applied to the Southold Town Trustees for a permit
under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance
of the Town of Southold, application dated August 29, 2005 and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on November 16, 2005 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of ROBERT FOX CIO
KIMOGENOR POINT COMPANY to reconstruct 151' of existing timber bulkhead in place
situated along the northern shoreline of subject property, extend the western terminus of the
bulkhead by 10' and extend the eastern terminus of the bulkhead by 6', both with vinyl
sheathing with the condition there be no turf landward of the bulkhead, and all as depicted on
the plan drawn by Suffolk Environmental Consulting, Inc. dated December 13, 2005.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
This is not a determination from any other agency.

I met with Chris Pickerell on site to look at the location of the low sill bulkhead. These
are our concerns and recommendations.
Project Description:
Suffolk Environmental Consulting, Inc. on behalf of ROBERT FOX cio KIMOGENOR
POINT CO. requests a Wetland Permit to reconstruct 151' of existing timber bulkhead
situated along the northern shoreline of subject property, extend the western terminus of
the bulkhead by 6' and extend the eastern terminus of the bulkhead by 6', both with vinyl
sheathing. Construct an additional Iow-sill vinyl sheathing bulkhead off the northern
shoreline measuring 145' and measuring 1.75' in top elevation. Deposit 100 cy. of clean
fill within the section of the property directly to the north of the existing frame building to
match the top elevation of the bulkhead (4.0'EL). Deposit 40-50 cy. clean fill where
necessary along the landward side of the proposed Iow-sill bulkhead and the edge of the
existing vegetation therein to provide a more uniform grade, and actively vegetate this
area with Spartina alterniflora planted on 6" on center. Located: Kimogenor Point Rd.,
Cutchogue. SCTM#116-6-24.1
1. The Iow sill bulkhead as proposed will disrupt the fiddler crab habitat and the
Spartina alternifiora marsh. The sheathing for the Iow sill should be moved to the
east at the MLW and put in the ground to grade in order to allow full tidal flow
over the marsh.
2. What elevation is the Iow sill set at? Will it be put at MLW?
3. The Iow sill bulkhead needs to be put on the hydrographic survey.
4. The proposal has pilings on either side of the Iow sill bulkhead. Check with the
builder/engineer if pilings just on the outside are sufficient.
5. The Peconic Estuary Program and the Nature Conservancy recommend no
further hardening of the shoreline. This proposal is in an area of healthy marsh
grass and bog. The food chain depends on the peat from the bog as it breaks off
and enters the estuary. While Iow sill bulkheads do allow for transport of water
and materials between the marsh and the water the proper location and elevation
is necessary. Also, while erosion is a natural process I didn't see erosion along
this shoreline by looking at aerial photographs from the past 3 years. There is
very little to no wave action or energy in this protected area and not enough fetch
to be causing erosion.
6. Specify on the Permit No CCA.
7. No fill behind the Iow sill bulkhead.
8. The plans/survey should indicate the locations of Spartina alterniflora (Saltwater
Cordgrass), Spartina patens (saltmeadow Cordgrass), and Distichlis spicata
(Spikegrass) landward of the existing bulkhead and the location of a non turf
buffer landward of the proposed reconstructed bulkhead; and limit the amount of
fill placed behind the bulkhead.
9. Document with photographs the location of all of the existing marsh before
construction.

At the meeting of the Southold Town Conservation Advisory Council held Wed.,
September 14, 2005, the following recommendation was made:
Moved by Jack McGreevy, seconded by Tom Schlichter, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Wetland Permit application of ROBERT FOX cio KIMOGENOR POINT CO. to

The action is located in West Creek a listed New York State Department of Environmental
Conservation Critical Environmental Area. The detail "timber" to be used has not been
identified and therefore, cannot be assessed to the LWRP policies.
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is INCONSISTENT with Policy Standards 5.3, 6.1, 6.3 (A, B3, C1
and C3), 8.3 (A, B) and more specifically 11 which states:
"Habitat protection and restoration must include an active program of protecting existing
wetlands and preventing further loss of wetlands (and other habitat) to inappropriate
bulkheading or other shoreline hardening structures"
Therefore the construction of a low sill bulkhead proposal and associated filling is
INCONSISTENT with the LWRP.
Please consider conditions on any approvals that would make the proposed action further
consistent with the above listed Policy Standards or advise the applicant of the necessary
amendments to the proposed action to achieve greater consistency to the greatest extent practical.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

PROJECT DESCRIPTION concerning the
KIMOGENOR POINT COMPANY Application
Situate: Kimogenor Point Road; Cutchogue; Town of Southold, NY
SCTM #: 1000 - 116 - 06 - 024.1
Applicant proposes to reconstruct the 151.0' + of existing timber bulkhead situated along the
northern shoreline of subject propmty and WEST CREEK by removing the existing external pilings
seaward of the existing timber sheathing & wales; re-facing the existing bulkhead with vinyl
sheathing; installing new wales and top-caps seaward of the vinyl sheathing; and installin8 new
timber pilings seaward of the new bulkhead. The resultant new bulkhead will extend less than 18'
seaward than the odginal bulkhead. "
Applicant proposes to extend the western terminus of the bulkhead by six feet (6.0') +, and extend
the eastern terminus of the bulkhead by six feet (6.0') ±, both with vinyl sheathing.
Applicant proposes to construct an additional Iow-sill vinyl sheathing bulkhead off the northeastern
shoreline of subject property, rneasurin8 145.0' ± in overall length, and measuring 1.75' in top
elevation to allow for tidal inundation during the daily high tide cycles.
Applicant proposes to deposit clean flu (100 cubic yards ±) within the section of property directly to
the north of the existing frame building to match the top elevation of the bulkhead (4.0' EL). Fill to
be obtained from an upland source.
Applicant proposes to deposit clean fill (40 - 50 cubic yards ±) where necessary along the landward
side of the proposed Iow-sill bulkhead and the edge of the existing vegetation therein to provide a
more uniform grade. In addition, applicant proposes to actively vegetate this area with 5part]na
alterniflora, planted on 6.0' o/c.

thereon. In order to do so, approval from your Board is required. Enclosed herewith
please find a completed Wetland Permit Application. Application contents are as
follows:

last dated May 13, 2005 (two [2] copies); and
(7) Plans of subject proposal, prepared by SUFFOLK ENVIRONMENTAL

covering the requisite application fee.

A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the m~'lmum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, i.t shall not be undertaken.

DEVELOPED COAST POLICY
Policy 1. Foster a pattern of development in the Town of Southold that enhances eemmunity character,
preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and
minimizes adverse effects of development. See LVe3~P Section HI - Policies; Page 2 for evaluation
criteria.

Subject proposal is consistent with the policy in that the siting and utilization of the improved erosion-control facilities
(i.e. reconstructed bulkheading/Iow-sill bulkheading) will maintain the character of the surrounding neighborhood~
which currently consists of many similarly-improved lots with similar accessory structures (i.e. bulkheading along
West Creek). In addition, subject proposal will be in harmony with the '...beneficial use ufa coastal location...' in
that subject waterfront lot will be enhanced & improved by the upgrading of the existing bulkheading and the
inclusion of the proposed Iow-sill bulkheading in order to control the erosion along the shoreline of said property.
Accordingly, we believe that this project is consistent with this policy.

character of this section of waterfront~ and which apparently does not adversely effect the visual quality and scenic
resources in and around the immediate ama. Accordingly, this proposal will comply with Policy 3.

daily during high tide, and which will establish and increase the amount of vegetated tidal wetlands within subiect
