Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, December 21,2005 regarding the above matter:
WHEREAS, En-Consultants, Inc. as agent for MEARS/COUSE applied to the Southold
Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town
Code, the Wetland Ordinance of the Town of Southold, application dated November 30,
2005, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on December 21,2005 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of MEARS/COUSE to
remove the existing wood steps; construct an attached wood deck and steps onto an
existing one-story, one-family dwelling, install drywells, place hay bales during
construction, and all as depicted on the survey prepared by Stanley J. Isaksen, Jr. last
dated October 25, 2005.
Permit to construct and complete project will expire two years from the date the permit is
signed. Fees must be paid, if applicable, and permit issued within six months of the date
of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Wetland Permit to remove the existing wood steps; construct an attached
wood deck and steps onto an existing one-story, one-family dwelling; and
install drywells. Located: 1050 Dean Dr., Cutchogue. SCTM#116-5-12
The proposed action has been reviewed to Chapter 95, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront
Revitalization Program (LWRP) Policy Standards. Based upon the information
provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that
the proposed action is generally CONSISTENT with the Policy Standards
and therefore is CONSISTENT with the LWRP with the following conditions:
1. Placement of ha.y~ales during construction.
2. Drywell for the~._oSb~ackwash and drywells to contain roof runoff.
Pursuant to Chapter 95, the Board of Trustees shall consider this
recommendation in preparing its written determination regarding the consistency
of the proposed action.

Before answering the questions in Section C, the preparer of this form should review the exempt

Attached please find an LWRP Consistency Assessment Form being submitted in association
with an application for a Town Wetlands Permit being filed with the Board of Trustees, to alloxv
for the removal and replacement of an existing bulkhead and incidental dredging to recover lost
backfill up to 10 feet offthe bulkhead.
I have indicated that all policies are "Not Applicable," because pursuant to §95-5(A) and the
corresponding definitions of "action" and "minor action" by §95-3, the submission of a LWRP
Consistency Assessment Form is not required for the bulkhead replacement, and I cannot
determine how any of the listed policies would be applicable to the incidental dredging of lost
backfill.
