Dear Mr. Hermann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, November 16, 2005 regarding the above matter:
WHEREAS, EmConsultants as agent for 343EI8,LLC applied to the Southold Town
Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code,
the Wetland Ordinance of the Town of Southold, application dated October 11,2005,
and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on November 16, 2005 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of 343E18,LLC to
demolish the existing dwelling and abandon the existing septic system, with the
condition that haybales and a silt fence be placed during construction, and all as
depicted on the plans surveyed by John C. Ehlers last dated 9/19/2005.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
This is not a determination from any other agency.

Regarding the variance being filed by applicant 343E18, LLC (Andrew Lowry): residence at
115 east side Avenue.
I am a neighbor of this individual and I reside at 450 Harbor View Avenue.
I have the following concern to submit to the trustees for consideration tonight at the
hearing:
On the survey is shown South Lagoon Lane which is state owned property. My understanding
is that some residents have a deeded right of way to this road that provides access to the
water. Further it is used by residents to gain access to the inlet. My concern is that
this somehow becomes incorporated in the construction project proposed and residents then
lose access to the road or are made to feel that they are having to go across someone's
lawn to get to the water. Is there any way that the town can more clearly segregate this
from the proposed project or that the road become more clearly marked? Perhaps plantings
can be used to more clearly delineate it.

Dear Mr. Herrmann:
The Southold Town Board of Trustees reviewed the survey prepared by John C. Ehlers
last dated September 19, 2005 and determined the proposed construction of a new
dwelling and associated improvements to be out of the Wetland jurisdiction under
Chapter 97 of the Town Wetland Code and Chapter 37 of the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, or within 25' landward from the top of the bluff, without
further authorization from the Southold Town Board of Trustees pursuant to Chapter 97
and/or Chapter 37 of the Town Code. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and
Coastal Erosion Hazard Area, which may result from your project. Such precautions
may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay bale berm.
However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion
Hazard Area would require permits from this office.
This determination is not a determination from any other agency.

(LWRP) Policy Standards. Based upon the information provided on the LWRP

installed. The CAC questions whether or not the existing boat ramp is permitted and
