Dear Mr. Lohn:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., September 21,2005 regarding the above matter:
WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of the ESTATE OF
GRACE R. EDSON applied to the Southold Town Trustees for a permit under the
provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the
Town of Southold, application dated August 5, 2005 and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 21, 2005, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of the ESTATE OF
GRACE R. EDSON to construct a single-family dwelling, attached deck, pervious
driveway, and sanitary system, with the condition of a 50' non-disturbance buffer
landward of the wetland line and a 4' wide path through the buffer, a split-rail fence is
installed along the landward side of the 50' buffer, drywells and gutters are installed to
contain the roof run-off, and the temporary placement of a hay bales and silt fence
before the project begins, and all as depicted on the survey prepared by Joseph A.
Ingegno last revised November 10, 2005.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Located: 355 Midway Rd., Southold.

GRACE R. EDSON requests a Wetland Permit to construct a single-family dwelling, swimming
pool, attached decking, driveway, sanitary system and public water. The proposed residence is
mostly located in Flood Zone AE el 8, an area of Special Flood Hazard 100 year flood. The
parcel proposes public xvater supply.
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is generally CONSISTENT with the Policy Standards and
therefore is CONSISTENT with the LWRP provided that the following standard best
management practices and Policy directives are implemented.
1. To further the intent of Policy 4.1 "Minimize losses of human life and structures
from flooding and erosion hazards." The following management measures to
minimize losses of human life and structures from flooding and erosion hazards
are recommended:
A. Minimize potential loss and damage by locating development and structures away
from flooding and erosion hazards.
Manage development in floodplains outside of coastal hazard
areas so as to reduce adverse environmental effects, minimize
the need for future structural flood protection measures, or
expansion of existing protection measures and to meet federal
flood insurance program standards.
If the action is approved and to further the intent of Policy 5, require surface
~vater quality, protection measures for areas generating runoff (gutters,
downspouts, dry wells and pervious driveways).
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

improve upon a vacant lot situated in a neighborhood qonsisting primarily of similarly-sized single-family dwelling~
wit.h..in similarly-sized properties. The proposalt as designed, will not result in .a~verse effects to the surrounding
environment in that the proiect has been designed in such a way as to maximize all requited regulatory setbacks
associated wi~h improving on a lot situated in proximity to the surface waters situated contiguous to subject property.
In addition, the surrounding neighborhood is comprised of older residential dwellings which have existed

subiect lot. Furthermore, this policy could not preclude the legal creation of this property as a building lot.
