EDSON 405 CEDAR POINT DR., SOUTHOLD SCTM#90 -2 -27 Dear Mr. Lohn: The Board of Town Trustees took the following action during its regular meeting held on Wed., September 21,2005 regarding the above matter: WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of LEWIS & LEFFERTS EDSON applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated August 5, 2005 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on September 21, 2005, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of LEWIS L. & LEFFERTS P. EDSON to construct a single-family dwelling, swimming pool, attached deck, detached garage, pervious driveway, and sanitary system, with the condition of a 50' nomdisturbance buffer landward of the wetland line and a 4' wide pathway through the buffer, a split-rail fence is installed along the landward side of the 50' buffer, drywells and gutters are installed to contain the roof run-off and the pool backwash, and the temporary placement of a hay bales and silt fence before the project begins, and all as depicted on the survey prepared by Joseph A. Ingegno last revised November 10, 2005. Permit to construct and complete project will expire two years from the date the permit is signed. The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is generally CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that the following standard best management practices and Policy directives are implemented. 1. Require erosion and sediment controls (haybales, silt fencing). 2. To further the intent of Policy 4.1 "Minimize losses of human life and structures from flooding and erosion hazards." The following management measures to minimize losses of human life and structures from flooding and erosion hazards are recommended: ,4. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. Manage development in floodplains outside of coastal hazard areas so as to reduce adverse environmental effects, minimize the need for future structural flood protection measures, or expansion of existing protection measures and to meet federal flood insurance program standards. 3. To further the intent of Policy 5, require surface water quality protection measures for areas generating runoff (gutters, downspouts, dry wells and pervious driveways). Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
