Meeting held on Wednesday January 18, 2006:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Permit #5728 to construct a new wood bulkhead in kind/in place of existing to a vinyl sheathed
bulkhead in-place with (2) two returns, with the condition of a 15' non turf buffer landward of the
bulkhead, and non CCA treated wood to be used during construction in order to make it
consistent with thee LWRP, and all as depicted on the plans prepared by Suffolk Environmental
Consulting, Inc. last revised March 10, 2003.
This project will need a final inspection. See attached schedule of fees.
This is not a determination from any other agency.

The Board of Town Trustees took the following action during a Regular Meeting, held on March
18th, 2003 regarding the above matter.
WHEREAS, Suffolk Environmental Consulting, Inc. on behalfofLo/s T. Anderson applied
to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the
Town of Southold, application dated January 31, 2003
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
March [8th, 2003 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code.
WHEREAS, the Board has determined that the project as proposed will not affect the health,
Safety and general welfare of the people of the town.
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approved the application of LOIS T. ANDERSON for
a Wetland Permit to construct a new wood bulkhead in kind/in place to construct (to replace
existing) Fiberglas sheathing bulkhead 132' +/- secured by dead men 8" round at 8' intervals;
and two (2) retums 5' long each, and to remove the existing pilings securing the existing wood
bulkhead.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Fee must be paid, if applicable and permit issued within six months of the date of this
notification.
Inspections are required at a fee of $5.00 per inspection. (See attached schedule).

As you know, this Firm represents Mrs. Anderson, owner of the above referenced
property, who is seeking final approval bom your Department to replace the existing
timber bulkhead with a fiberglass sheathing bulkhead.
Pursuant to the requests of your Board during the meeting of February 26, 2003,
concerning this proposal, please find enclosed herewith:

Revised Site Plan/Cross-Sectional Plan for the proposed
replacement bulkhead, prepared by Suffolk Environmental
Consulting, Inc., last dated March 10, 2003 (two [2] copies).
Please note that we have revised subject proposal by eliminating the two foot (2.0')
westerly extension to connect with the neighboring westerly adjacent parcel's existing
bulkhead, and indicated a fifteen foot (15.0') wide non-disturbance/non-fertilization buffer
landward of the bulkhead. However, this office wishes to address the request of your
Board to remove the existing timber bulkhead altogether, instead of installing the
fiberglass sheathing directly to the face of said timber bulkhead, during the following
scheduled Trustees hearing concerning this matter.
In the interim, kindly continue the final review of this proposal. Should you have any

My wife and I vehemently object to applicant's request to construct a new wood
bulkhead in front of her existing bulkhead within 18" seaward for the following reasons:
Undermining and weakening the foundations and stability of our bulkhead,
which is adjacent to hers.
Both Mrs. Anderson's and our bulkheads are in excellent condition - so why
disturb what is working well and take a chance on uncertain ecological
developments to Jockey Creek.
Her request to extend the proposed bulkhead 18" seaward is an unjustified
encroachment on public/county property and waters. We strongly object to
that. It would set a bad precedent for others to follow.
There is currently a moratorium on building new bulkheads in our town. One
may repair existing bulkheads NOT rebuild, and certainly not going out into
the cretk. This would be kicking out part of the moratorium.
We therefore expect to see a denial of her unreasonable thoughtless request,
which again would set a negative precedent for others.

The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Toxvn of Southold Toxvn Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, the information stated by the applicant in a October 24, 2005
telephone conversation, as well as the records available to me, it is my recommendation that the
proposed action is generally CONSISTENT with the Policy Standards and therefore is
CONSISTENT with the LWRP provided that:
1. No CCA is used in the construction of the dock facility.
2. The bul rkhead is replaced in-place and in-kind.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing

Pursuant to my conversation with Ms. Lauren Standish of your Department this afternoon,
please note that it is our understanding that the above referenced property currently benefits
from an in-force Town of Southold Board of Trustees Wetlands Permit (No. 57~8) to replace
the existing timber sheathed bulkhead thereon, and replace "in-kind/in-placg' with a fiberglass
sheathed bulkhead, which apparently was extended in February, ~005 for an additional one (1)
year. In the interim, this office submitted to your attention a new application for same, dated
December 15, ~005, on the belief that the original Board of Trustees Permit (No. 57~8) had
expired, which it had not. In addition, this office wished to modify this permit to replace the use
of fiberglass bulkhead sheathing with vinyl bulkhead sheathing.
Accordingly, this office wishes to withdraw our pending new application concerning this
matter, and request both an additional one (1) year extension and modification of the Board of
Trustees Wetlands Permit (No. 57~8) to incorporate vinyl sheathing rather than the previously
approved fiberglass sheathing. Please utilize all submitted documentation within our
submission of December 15, ~005 (i.e. application, plans, etc.) to fulfill all necessary application
requirements.

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of uach policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits

Applicant proposes to reconstruct the existing timber
bulkhead thereon, "in-place', with the following:
(1) VINYL SHEATHING (12.0' Long);
(2) TIMBER TOP CAP (2.0" x 18.0");
(3) TIMBER WALERS (6.0" x 8.0") ~ top & bottom/
butt blocked every 16';
(4) TIMBER PILINGS (10.0" <I> x 14.0'); and
(5) TIMBER DEADMEN (8.0" <1>).
Applicant proposes to additionally construct two (2) bulkhead returns
measuring 10.0' in length each including the following:
(1) VINYL SHEATHING (12.0' Long);

As you know, this Firm represents Mrs. Lois Anderson, owner of the above referenced
property, who benefits from a Town of South old Board of Trustees Wetlands Permit to replace
the existing bulkhead thereon.
Please note that, after further review of this proposal, and in light of this properties' exposure
from the east, we wish to extend the approved-for bulkhead returns to ten feet (10.0') rather
than five feet (5.0'). Accordingly, please find enclosed:
(1) Site Plan/Cross-Sectional Plan for the proposed vinyl sheathed bulkhead,
prepared by Suffolk Environmental Consulting, Inc., last dated January 30, 2006
