Box 2003 Bridgehampton, NY 11932 RE: GREGERSEN'S KEEP, LLC - LOT 1 GULL POND ROAD, GREENPORT SCTM# 35-3-12.6 Dear Mr. Anderson: The Board of Town Trustees took the following action during its regular meeting held on Wednesday December 21,2005 regarding the above matter: WHEREAS, Suffolk Environmental Consulting, Inc. as agent for GREGERSEN'S KEEP, LLC applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated September 15, 2005 and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on December 21,2005 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold Town Code, 2 WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, RESOLVED, that the Board of Trustees approve the application of GREGERSEN'S KEEP, LLC- LOT 1 to construct a single-family dwelling, pervious driveway, deposit 700 cy. of clean fill from an upland source, and maintain the existing wood frame and canvas building within subject property, with the conditions that all runoff be contained in drywells, French drains to be constructed to contain runoff from fill, haybale line be placed during construction, and a 50' non- disturbance, non-turf buffer from the wetland line landward, and remove the fence around the property, and all as depicted on the plans surveyed by John Metzger and last dated November 1,2005. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) The main reason we wanted to move to the North Fork was the Southold towns zoning policies and property preservation laws. We grew up in Northport which use to be potatoe farms and vacant land, up until the 60's. Then the "building boom" arrived and we saw first hand, how a pristine area can be ruined by over development and improper planning. When we bought our home on Gull Pond, we were aware of a 2 acre vacant lot next door which was zoned 2 acre for one house. We realized someday a house would be built. What we don't understand is how a 2 acre lot can be subdivided with the Board's policy on land preservation and 2 acre zoning. Because of the configuration of the 2 lots and the sizes of the proposed homes, this will require over 1900 cubic yards of fill to be brought in to enable the requirements by the Board of Health for their septic system. Whereas, one home which was already approved will have enough area to put in a shallower cesspool system and will require no fill. Page 2 As I have an engineering degree and over 30 years of experience designing, developing and building residential homes, the grades of the 2 proposed houses raised 5' or more above the existing grade poses a serious potential for flooding. Already the end of Gull Pond Lane floods in heavy rains. With ground water only at elevation 3.4 there can be a serious problem installing enough drainage to contain the run off from a storm such as we just experienced 2 weeks ago. We also understand that the property can not be bulk-headed in any fashion. So will we have run off going into the Pond? Who will be responsible if we have flooding in our basement, pool or property? Since this subdivision requires so much fill and requires putting decks with less than 100' set backs from the water I believe the planning board should review this subdivision with all its problems with the Board of Trustees before making a bad decision. John Braider, the former owner approached the Board sometime ago requested a subdivision on this piece of property and was told "This will not happen". Why would you change your minds now?
