As part of the Building Permit review, a DRAINAGE PLAN prepared by this office was submitted. Mr. Richter, Town Engineer requested additional drainage for the parcel to take into account the deck area. Subsequently, the overall project was extended and considerably down-sized and a Permit Amendment was granted by your Board on June 18, 2008 for what is specifically proposed to be built. I am advised by your staff that the permit is to expire on December 21, 2009 but that I may apply for the final one-year extension of the permit. By way of this correspondence, (request that the in-force permit be extended by an additional one year. The permit expiration date would be December 21. 2009. According to the Notice To Adjacent Property Owner received by my clients, this application is scheduled for a Public Hearing on Wednesday, June 18, 2008 at 6:00 p.m. While my clients do not have any particular objection to the application, they do want to make clear that any access to the subject premises is not off of Bird's Eye Road. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. a. No development is permitted in natural protective feature areas, except as specifically allowed under the relevant portions of 6 NYCRR 505.8. b. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. The proposed use is residential and therefore is not a "water dependent use". Due to the depth of the lot. there is ability to relocate the residential structure landward of the CEHA area to maximize the distance from the "hazard area" and minimize the potential of future structural loss. 2. Avoid reconstruction of structures, other than structures that are part of a water-dependent use, damaged by 50% or more of their value in coastal hazard areas. The proposed use is residential and therefore is not a "water dependent use". 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast or in coastal waters. b. water-dependent uses which cannot avoid exposure to hazards. c. sites in areas with extensive public investment, public infrastructure, or major public facilities. c. sites where relocation of an existing structure is not practical. The proposed action does not meet the above reasons to warrant "maintaining existing development" within this erosion hazard area. In the event that the action is approved to further Policy 5: Protect and Improve Water Quality in the Town of Southold and Policy 6; Protect and Restore the Quality and Function of the Town of Southold Ecosystem the following is recommended: 1. Require a natural vegetated buffer landward of and inclusive of the Coastal Erosion Hazard Area. A sample definition is included below. NATURAL VEGETATED BUFFER --Aland area of a certain length and width where existing vegetation occurs prior to the commencement of any grading or clearing activity. Vegetation shall be maintained to achieve a minimum percentage of ground cover of 95%. To achieve the percentage of ground cover, indigenous, drought-tolerant vegetation shall be planted. Survival of planted vegetation shall be 90% for a period of three years. Maintenance activities within the buffer are limited to removing vegetation which is hazardous to life and property, trimming tree limbs up to a height of 15 feet to maintain viewsheds, replanting of vegetation and establishing afour-foot-wide access path constructed of pervious material for access to the water-body.
