Notary Public LEGAL NOTICE NOTICE TO BIDDERS NOTICE IS HEREBY GIVEN, in accordance with the provisions of Section 103 of the General Municipal Law, that sealed bids are sought and requested for the the sale of excess Town-owned gravel, mined from property adjacent to the capped landfill in Cutchogue. The gravel was screened from sand mined in the development of the Town compost facility in 2002 - 2003. It is unwashed. It has been stored on site, but must now be moved to accommodate Town operations. SPECIFIC FEATURES AND AMOUNTS There are two (2) sizes of gravel available, as follows: 1 ) Large Gravel, having a predominant size of 3A" - 3" diameter: there is approximately 400 cubic yards of Large Gravel available: and 2) Small Gravel ("pea gravel") having a predominant size of 3A'' - or less in diameter; there is approximately 1,000 cubic yards of Small Gravel available. The Town makes no express gurantee on the exact amount of gravel available. PROCEDURES The Town seeks bids for the purchase of both sizes of gravel IN PRICES PER TON, Volume based prices will NOT be accepted. Weights shall be as determined by the truck scales at the Cutchogue Transfer Station (a.k.a., "landfill"). The Town makes no warrant prior to receiving bids as to the weight by volume of the gravel, although bidders are free to come to the facility and weigh a representative sample of the gravel in their own vehicle at no charge. Bidders are not required to bid on both sizes, but bidders warrant that they will take ALL of the available gravel of the size being bid. Bidders agree that ALL available gravel of the size they bid on will be removed from the landfill not later than December 31, 2005. Bidders may station their own equipment for the purposes of loading their own trucks, HOWEVER THE TOWN WILL LOAD BIDDERS' TRUCKS at no additional charge to the bidder. NONETHELESS, The Town does not gurantee the specific availablity of loading equipment at specific times for this purpose. The gravel will be available for loading/removing six (6) days per week, Thursday through Tuesday, from 7:00 am - 5:00 or check by the close of each business PRICE FOR GRAVEL MAY NOT ! The sealed bids, together with a Non-Collusive Bid Certificate and bank draft or certified check in the amount of $100.00, will be received by the Town Clerk of the Town of Southold, at the Southold Town Hall, Po Box 1179, 53095 Main Road, Southold, New York, until 10:00 A,M., Thursday, November 17, 2005, at which time they will be opened and read aloud in public. The Town Board of the Town of Southold reserves the right to reject any and all bids and waive any and all informalities in any bid should it be deemed in the best interest of the Town of Southold to do so.
