THIS INDENTURE, made this lO~L~- day of May, two thousand and one BETWEEN VIRGINIA COCHRAN RUSCH, residing at New York, NY 100~5 as executor of the last will and testament of JOHN B. RUSCH (a/k/a JOHN BARTHOLOMEW RUSCH), late of Southold, New York who died on the 13~h day of August, two thousand party of the first part, and VIRGINIA COCHRAN RUSCH, residing at 285 Riverside Drive New York, NY 10025, and DEREK MICHAEL RUSCH, residing at 1066 66.h Street Oakland, CA 94608 as Trustees of the JOHN B. RUSCH TRUST under LW&T dated 7/25/97, residing at 285 Riverside Drive, New York, NY 10025, party of the second part, WITNESSETH, that the party of the first part to whom permanent letters testamentary we& issued by the Surrogate's Court, Suffolk County, New York on September 8, 2000, and by virtue of the power and authority given in and by said last will and testament, and/or by Article 11 of the Estates, Powers and Trusts Law, and in consideration of NONE (-0-) dollars, paid by the party of the second part, does hereby grant and release unto the party of the second part, the distril~utees or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Southold, Town of Southold, ,County of Suffolk and State of New York, bounded and described as follows: BEGINNING at the southwesterly coruer of thc northerly one-half of Lot #13, Block C, shown on "Ma, p of Reydon Shores, Bayview, L.I.N.Y.", and filed in the Suffolk County Clerk's Office; RUNNING THENCE along the rear line of lots 13, 14,15, 16, and 17 on said map, South 20° 11' 20" West, 135.0 feet to the southwesterly comer of Lot #17; THENCE westerly at right angles to said rear line, I~orth 69° 48' 40" West, a distance of 146.6 feet to the easterly line of a private road; THENCE along said easterly line of said private road North 19° 06' 50" East, 135.02 feet; THENCE easterly again at right angles to said rear line a distance of 149.20 feet to the point of BEGINNING. TOGETHER with a right of way over the private road adjacent to said premises to the northwest of said premises to and from North Bayview Road on the south and to and from that portion of Peconic Bay known as Town Harbor on the north to high water mark thereof. SUBJECT to covenants and restrictions of record affecting said premises. BEING AND INTENDED TO BE the same premises described in the deeds of the parties of the first part herein by deed from VIRGINIA C. RUSCH, dated 7/21/00, recorded in the Suffolk County Clerk's Office on 8/1/00, in Liber 12060, Page 098 and the deed from MARGARET LOUISE HANNON and WILLIAM ROY SCHWINDT, dated 4/21/82, recorded in the Suffolk County Clerk's Office on 6/I/82, in Liber 9190, page 487. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of the decedent's death in said premises, and also the estate therein, which the party of the first part has or has power to convey or dispose of, whether individually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the distributees or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said incumbered in any way whatever, except as aforesaid. Subject to the trust fund provisions of section thirteen of the Lien Law. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
