September 28, 1964 at-7:30 P.M. in the Greenport High School., Main Street, ~ree~port, N.Y. at which time all interested persons were given an opp~rt-unity to be heard, and WHEREAS, this.Board deems it in the best interest that Local~Law _92 be enau~ed, NOW,~ T~EREFORE, BE IT RES~L~ED: .That teh following Local Law 92 - Year 1964 is~ enacted: TOWN OF SO~P~HOT~ LOCAL LAW. 92 -: YEAR ~964 A IO'=al:~ law'-relating to. the establishment of a police department for the Town of S~uthold 91. ESTABLISHMENT OF POLICE DEPARTMENT There is hereby establishe~ a police department for that portion of.the-town of Southold outside the incorporated village of Greemport. There shall be in such police department, a chief of police and~e~h~r~nu~Dere~-'~eutenants, sergeants, patrolmen, Watchmen, special po~ice;.and other officers and employees as shall be determined-by the tOWn board. When appointed, such policemen shall be peace %~fficers and shall have all the powers and be subject to all the duties and liabilitie~s~ Qf a~ ~onst~_ab!e .of the town in all criminal actions and pro- ceed£ngs/~ a criminal' hat'e, and such additional pOWers, not incon- sistent .with law, as shall ~e 'conferred upon them by the Town The compensation of the members .of such department shall be a town charge,- and the manner of payment thereof shall be fixed and deter- mined by the town board. The town shall pay for the cost of the. ~nif-orms and necessary equipment of such policemen. 92 . POLICE COMMISSION. The town board, at any time by resolution, may establish a board of police commissioners for the town and ap~point one or three police commissioners who shall at the time ok ~eir appointment and throughout'their ~term of off!ce be owners of record of real property in and electors of the town, and who .shall serve without compensation,, and at the pleasure of the town board. If the town board shall appoint only one such police commissioner, it shall in addition designate two members of the town .board to serve as members of such police commission. The town board m~ also by- resolution designate the, supervisor .to serve as police commissioner, and when so designated, such supervisor have all the powers of a~d.perform the duties of such board .of p?.!ice commissioners. When either of;such boards of police uommissione=s~:shal!' have been established or the supervisor designated as ~police ~commi..s~T ioner, such board of police commissioners or. police_ commissioner have and exercise all the powers relative to police matters conferred upon the town board by. this local law. The town board may b~ resolution at any :time abolish such police cemmission~ or revoke the deSignation of such supervisor as police commissionerand thereup_on the town~ bgard only shall' exercise the powere conferred upon.it by this l~cal ]aW. ~3. ~ALIFX~ATIONS Except as. otherwise provided by ~law, the mem~e.rs of. the police department shall be appointed, and promote~ from an eligible civil service list. Except as otherwise provided: by law, no person shall be~ appointe~ a member of the police department, nor continue as a m~mber thereof, who shall not be a citizen ~ the United States, who has~b,een convicted of a felony, who shall be unable to read and write.understand- ably the ~English language or who shall' not have resided within the : State of New York one year and in,the coun_t~: of Suffolk for six mgnt~s~ next preceding his appointment. Provided, however, that at the time of the. organization of such police department~, appointments thereto shall b'e made, first from-among constables and/or police officers.rhea . employed~ by the town of S~uthold, if such persons possess all. of the_.-. q~alifications h~einbefore in this. section .set forth~ Each member.~of' the police department shall hold office during good ~ehavior. ~ SPECIAL POLICEMEN - - The to~..n board may employ, temporary, police offi. cers'~ from time to time as ~he town board may determine their services neces~s- ary. S~ch police officers sh&ll be known as~ "special policemen.:. "and.~. shall have. al-1 the powers and authority conferre~upon constables by.. the~ge~ oral laws of the state and s~Lh additional-powers, not incons-is~en~ with law, as. shall be conferred upon them by the town board'. The~ s~all be subject to the general authority and directio~ of the town b~ard and to such orders and regulations as the town b~rd may prescribe, not inconsistent with law. Such special policemen shall serve at. the~ ~ pleasure of the town board and the town board~ shall fix their compen- sation and may pmrchase uniforms and equipment therefor within the budget appropriation therefor~ Such specia~l:~_police shall ~ot~be e~igib!e-t~ appointment unless they- shall have passed an examination held by the appropriate civil service commission at the time of-t heir appointment. Provided, however, and notwithstanding ~the foregoing provisions of this section, the town board may, .when in its judgment :it deems it'~: _. necessary for the preservation of. the public peace during any .emergency period of sixty days or less,, appoint and at-pleasure remove.within such period additional special policemen not exceeding five in_ without ~examination. ~ ~ ~-; $5. ADMINISTRATION : ~:~' The town .board~ may from~ time to time make, adopt and~ enforce rules, orders and regulations for the go=ernment, discipline, administration and diSp~sitio~ of the police department and the members thereof..Any such rules and regulations ore.any amendments theret,o shall be in written form and a copy of.the same ~istributed to each member of the department and posted in a conspicuOuS place in the headquarte~s of the police department. 369 %6. DISCIPLINE A_NB ~CHARGES The town board shall have the power and authority, to adopt-, and: make rules and regulations for.- the .examination, hearing, in~S't'~gation~ and determination 'of charges, made or preferre~ .agaimmt any~ember or members of the police department. Except as otherwise. provided by law, no member or members of the police department shall be f:i~d,: reprimanded, removed ~ dismissed' until written 'charges shall have been examined, heard ,and investigated in such man~er or such procedure, practice, examination and investigation as the town board by rules and. regulations from tLm__e to time,.may prescribe, such ~h~ge~S-shall not be'~b~ought more than sixty days after the ~time wh~ 'th~ facts upon which such char~ges are based are. known to the %o~n b~ard~~ ~y member '. of~ the p~lice department at the time of the he~a~i~g, or-~ial ef .such .charges shall have therright to~ a public hearing and ~rial and to be. 'r~presented by counsel; n~ person who sha~.:~aVe preferred 'such cha~ges or amy part of the same shall sit as judge upon.-such~hearing or trial. Witnesses .upon the trial of such charges shall testify., thereto under ~ath. No member of such department who shall~ have been dismissed~sha11 be reinstated unless he shall, within tWelve months~of his dismissal, file with the town boar~ a written application for a rehearing of the charges upon which he was dismissed. The town b~ard shall have the ~er to rehear .~su~h charges'and, in' its .discretion,~ ma~y..reinst~te a member of the dep~tment~ after he has .filed such written application t~'~ref~r. Any member of such depa~ment found ~uilty iupon charges, after~five days'~ notice and an-opportunity to be heard in his defense, of neglect or dereliction in~the performance of official duty, or of vi~a~ion of rules or regulations or disobedience~ or .of incompetency to perform official dmty, or of an act of delinquency seriously affect- ing ~is'~ general, character or .fitness for office, may be punished by the town board, by reprimand, by forfeiture and withholding of salary. or compensation for a .specified time not exceeding twenty days, by, extr&~tours or hours ofduty ~during a specified t/me not exceeding twenty days, .by suspension fr~m duty .for .a specified time not exceed- ing twenty days an~ the withholding of salary ~or compensation during such suspension, or by dismissal from the department.
