THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2006-127 WAS SCHEDULED
AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON JANUARY 17, 2006:
RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Suoervisor Scott
A. Russell to execute an a~reement with New Suffolk Shipyard at Cutchogue Harbor Marina in the mount of
$3,375.00 for the term April 1, 2006 through October 31, 2006, for dockage of the Bay Constable boat, all in
accordance with the approval of the Town Attorney.

2006 Dockage Agreement w/New Suffolk Shipyard
For your records, attached is the original 2006 Agreement between the
Town of Southold and New Suffolk Shipyard which has been executed by the
Supervisor. I am also including a copy of the resolution authorizing the
Supervisor to sign this document.

2006 MARINA RESERVATION
April 1st to October 31st

TERMS AND CONDmONS OF RENTAL
1. All reasonable precautions will be taken by NEW SUFFOLK SHIPYARD (hereinafter referred to as "MARINA") to
secure Boat Owner's property and safety. However, the Madna assumes no responsibility for loss or damage due
to storm, fire, theft, vandalism or any other cause, and the bt:at owner agrees to hold NEW SUFFOLK SHIPYARD free
and harmless in the event of such occurrences. Facilities are leased with the understanding that the Madna is not
liable for property damage or bodily injury. Boat owners are advised to protect themselves with adequate insurance.
2. It is advisable to provide the Marina with a duplica,t6 set of cabin and ignition keys, Boats will only be boarded by
Marina pemonnel for emergency service; othe~/,,s4, only with permission of the boat owner.

3. The Madna reserves the dght to property tie up', pump out or othemtise secure any boat at the dock which it feels is
improperly secured. Labor for such services will be charged to the boat owner.
4. Boat owners will not engage outside con~ctors or service men to work on their boats while at the Marina without
prior written permission of the yard rrfal~ger. NEW SUFFOLK SHIPYARD resen/es the exclusive right to pedorm all
sen/Ices on boats docked or stored in the Marina other than work performed by the boat owner personally.
5. The Madna reserves the dght to use or rent any vacant berth in the absence of the regular boat owner. Seasonal
rates are quoted with this in mind. OWNERS MUST NOTIFY THE YARD OF ABSENT PERIODS,
6. Dlecharga of toilets, oil or dumping of refuse into Marina area and waters is stdctly prohibited.
7. No owner's "For Sale" signs are allowed on boats berthed or stored at the Marina. It is requested that any boat for
sale be listed with NEW SUFFOLK SHIPYARD, who is hereby designated the exclusive broker to offer for sale said
boat while berthed or stored, Standard brokerage rates prevail.
8, Swimming, diving or fishing is not permitted from the docks or boats in the Marina.
9. The use of open flame cookers is not permitted outside of boats in the Marina. Please use barbecue grills in desig-
nated areas.
10. Children and pets must be controlled to insure the peace and privacy of other Marina occupants. Owners must clean
up after their pets.
11. No obstruction of any type will be allowed on docks without prior permission of the yard manager.
12, Rental space is non-transferable; no refunds will be made.
13. ALL YARD BILL MUST BE PAID IN FULL PRIOR TO SPRING LAUNCHING.
I ACCEPT AND AGREE TO ABIDE BY THE TERMS OF THIS AGREEMENT AS STATED ABOVE.
