York, on.Tuesday, November 9, 1965. The meeting was called to order.at 3:00 P.M. with the following present: supervisor Albertson; Councilmen Demarest and 'Valentine; Justices Tuthill and .Clark; Supt..of.Highways ~rice; Town Attorney Tasker and Town Clerk Richmond.. Moved by Justice Tuthill; seconded by Councilman Valentine; RESOLVED.: That the Southold..Town Board approves the planning Board Proposed Amendments, Rules and Regulations. for the.Subdivisions of. Land, Town of South~ld, to wit:.-- PROPOSED AMENDMENTS RULES & REGULATIONS FOR THE SUBDIVISION OF LAND -- TOWN OF SOUTHQLD ~. AMEND section .on "PROCEDURE-~ in regard to fee. for applications: 10 Acres or less - base.fee ($50.00) fifty dollars; over t0 -. acres - base fee plus-five ($5.00) dollars for each additional acre:or fraction thereof in excess of ten acres. ALSO by adding a new paragraph under the fee: In addition, a highway inspecti~f~ of fifty ($50.00) per mile · or fraction thereof will be charged, Oh'-page 2:, under "PROCEDURES",. paragraph 3 shall be. amended to read~ as follows: At a regular meeting, the Planning Bcard will review the repDDt consider all phases of'the proposed subdivision and either approve or disapprove the tentative layout, whereupon the developer will be notified of.the approval or disapproval of the tentative layout as submitted. 3. B!~,amending section 5 "IMPROVEMENTS", Subsection 2, item (b) by- adding a new item to be item b-2. Section 5, subsection 2, Ite~ by2; Ail highways terminating at tidewater, must have a width of nottess than 100 feet for a dis- tance of 100 feet back from the ordinary highwater mark of such tidewater. 4. By Amending section 5'~.'~IMPROVEMENTS" subsection: 2, item (e), to read as follows: ,~/ Sectfon 5, subsection 2 item (e); A width of. not less than of the.b~unds of thehighway .shall be hereinafter known as the highway area~.from which all trees,_ brush, rocks, stumps., and other obstructions shall be thoroughly cleared and all such material shall be removed from the bounds of the highway. 5. By amending section 5 "IMPROVEMENTS:" subsection 2~ item (g) by making (g) become (g-l} and.adding a' new item (g~2), to read as follows: Section 5, subsection 2, item g-2; Where_the surface is heavy loam or clay, remove to sandy subsoil and replace with bank run to grade. Sandy loam shall be used for the top six (6) inches as in subdivision g-1 above. 6. By amending Section 5 "IMPROVEMENTS", subsection 2, item (j) to read as follows: SeCtion 5,~ subsection 2~item (j)~; Afte~i-the/highway area has_ been properly graded, rolled and shaped to the approval of the S_uperintend- ent .of. Highways.,. the twenty, four (24) foot section in th~ c~nter of the highway area (hereinafter referred to as the road 'section) shall be stabi,tized with an application of (1) one gallon 0~ SC=i. bitUmin- ous cut back per sc/mere yard mixed to a depth of (4) four inches. Within two months, and not less than~ one (!) month after stabilization, the road section shall be rolled and properly ~prepared and an applic- ation of one half (½) gallon of Mc-2 bituminous cutback ~per s_~uare yard s~all be applied with sufficient sand to absorb the excess oil. In case of dry weather, the ~s~Lbgrade. shall be w~t down befor~ the~,oil is applied. 7.. Amend section 5 ~IMPP~VEMENTS", subsection 2, item (m), to~-read as follows: - _ .... Section 5, subsection 2, item (m): Sidswalks shall be .standard four (4) foot in width, four (4') inches thick except in driveways where they must be not less than six~ (6)~ inches, thick. . ~ All curbs and gutters to be built to standard forms as they may be directed by.~the superintendent of highways. On existing TOWn highways the iTown will, furnish the necessary engineering, grading, filling and labor; the property owners shall furnish the necessary ready mixed concrete and shall deliver such concrete to the site as directed .by the Superintendent of highways. The amount of sidewalk construction throughout the Town shall be determined by the Town Board. 8. By amendLng section 5 "IMPROVEMENTS", by adding a new section to be subsection 4. Section 51 ~subsection 4~..A construction inspector retained bY. the, TOWn s~atl inspect.all improvements while in the process · of--- con~truct- ion and it shall be the duty of the subdivider to notify the Planning Board when the improvement is to be commenced and subs~quently~ before it is completed. 9. B~ amending section 5 '. "IMPROV~EMENTS'", by' adding, thereto a-new sub- sec%ion to be subsection 5, to read as f~ollows: .... ~'. ~ Section 5, s~bsection 5. The construction Inspector shall certify to. the Planning BOard when~all_improvements are completed as required by the regulations and specifications of the Planning...Board.... 10.By amendin~ the section on "IDENTIFICATION AND DESCRIPTION"~ .item ~(_t), as follows: ' ~. ~ "IDENTIFICATION'.~ AND, DESCRIPTION", item (t)~. The minimum .width of any pavement shall be twenty four (24~ feet. ~ 1t. By amending ~ the section on "IDENTIFICATION AND~ DESCRIPT~ON."~, ~.i_ltem (w), as follows: ........ ~'IDENTIFICATI~N- AND ~.DESCRIPTION", item (W) ;. The. minimum .thickness Eor sidewalks.shall be four (4) inches of~..l:2:4 concrete mi~tUre~or~ equal. 12. By amending section 9, "DETAILS OF CONSTRUCTION IMPROV~,MRNTS't'~sub section 1. to read as follows: Section 9 subsection (b-i) The entire sewerag.e .System .amd-the disposal of sanitary and storm sewerage shall be planned and built,to comply with 'the requirements of the New '.~ york .state. Department ~ of,~H~alth and of t~he ,Suffolk County Department of Health., but .in ~all .cases, all liquids- must be returned tO lthe soil except where such system is to.be ~connected to-a municipal sewer system. 13. By amending section 9 '~DETAIL~S OF CONSTRUCTION IMPROVEMENTS" sub- section 2, to read as follows: Section' .9, ~ subsection 2: The ~water distribution,~ system shall comply with the requirements of the New York state Department of Health and the Suffolk County Department of Health .... 169 14. By amending section 9 "DETAILS OF CONSTRUCTION IMPROVEMENTS'~ ~c~h~:~!~¢ding a new section '3; and thus moving all Other subsections -up one number. Newsections3 to read as follows: Section 9, subdivision 3:'All man-made waterwaysand/or canals must have the approval of the Planning Board. 15. By amending~'Section 9, "DETAILS OF CONSTRUCTION IMPROVEMENT" subsection 3 through-5 inclusive, by: subsection 3--to be renumbered subsection 4 - - " 4 " ...... 5 " 5 ........... 6 16. By amending section 9 '~DETAT?.E OF CONSTRUCTION IMPROVEME~", subsection 6 by adding a new'phrase: section 9, subsection 6, -~Inllieu of making the 'improvements as specified ......... of the parties thereto. ~f the Planning Board shall decide at any~t~e during the term of the performance Bond, (upon inspection 'by it's construction inspector) that the extent of the building development that has taken place in the subdivision is not sufficient to warrant ~ .................. of such procedes. Moved by Justice Tuthil't; seconded by Councilman Demarest; WHEREAS, Martin Fitla~applied to the Town Board for a single~trailer renewal permit dated November 5, 1965, NOW, THEREFORE, BE IT RESOLVED: That the application of Martin Filla to locate a single trailer on his property at Oregon Road, Mattituck, N.Y. be and ~hereby is granted for a six (6) month period. Moved by Councilman Valentine; seconded' by Councilman Demarest; WHEREAS, Isadore Krupski has applied to the Town Board for a single trailer renewal p~rmit dated November 3; 1965, NOW, THEREFC~E, BE IT.RESOLVED~'~That the application of Isadore Erupski ~o locate a single trailer on his property at Peconic, N2Y~ be and hereby is granted for a six (6) month period. Tasker, Esq,,. presented to the Board a signed copyjof ~ resolution of the Board of Commissioners of the Fishers Island Ferr~y District adopted at a special meeting of the ~Commissioners o~ November 1, 1965, entitled "Resol~ution Reco~amending and Approving~ ~n increase and Improvement of the 'Facilities of the Fishers Isled Ferry DiStrict of the Town of. Southold, New York" together with a petition of~ the Commissioners of the Fishers Island Ferry District, dated Nowember~ 4, 1965, requesting that the Town Board adopt an order calling a meeting of said Board ~or the purpose of holding a public hearing, upon due notice, ~to consider acquiring an additional ferry boat for use on the authorized routes of said ferry district at an estimated cost of $165,000., and approving the retainer of Blount Marine, Licensed naval Architects, and Robert W. Tasker, E-~_q., as counsel to said district for said increase and improvement of facilities, b~.
