Moved by Justice Tuthill; seconded by Councilm~'% Demarest;- WHEREAS, the Supreme court of the' United States of ~America has directed the several states to apportion both houses of~their legislatures oB a~ population basis, and " ~ WHEREAS, we believe this decision~ to be an~invasion of the States' rights to determine their own system of representation, and WHEREAS, Senator Dlrksen has proposed an amendment to bhe United' States ConstitutiOn which reserves to the States the sole right to determine thei~ Own system of representation, ' -' NOW, THEREFORE, BE IT RESOLVED: That this Board wholeheartedly supports the DirkSen amendment, and be it further RESOLVED: That the Clerk of the'B~ard b~~ and hereby is authorized and directed to send telegrams to the Hon, Jacob Javits and Hon. Robert Kennedy, our United States Senators, respectfully requesting their complete sdpport of the Dirksen a~endment and that they assist in the memorialization of-Congrees to this effect. "~ Moved by Councilman Demarest; seconded by COUncilman Valentine; BOND RESOLUTION"OF T~E'TOWN~OF SOUTHOLD, NEW YORK, ~DOPTED JULY 13, 1965, AUTHORIZING THE' PURCHASE OF A PAYLOADER TO BE ~SED AT T~HE TOWN REFUSE DISPOSAL AREA IN CUTCHOGUE ~ IN SAID T~VN, STATING THE ESTIMATED MAXIMUM COST THEREOF IS $36,000, APPROPRIATING ~ SAID AMOUNT THEREFOR ~ND AUTHORiZ_ ING THE ISSUANCE OF $36,000 SERIAL BONDS OF THE TOWN TO FINANCE ~AID APPROPRIATION. ~ Section I. ~ue To~n of S~uthold, ih the'~Co~nty of Suffolk, New York, is hereby authorized to purchase a motor' vehicle, described as a Payloader, to be Used at the Town Refuse disposal area, in Cutchogue, in said Town. The estimated m~ximum cost~of Said specific object or purpose, including preliminary costs and costs incidental thereto and the financing thereof, is $36,000 and the said amount ishereby-approp- riated therefor. The plan bf financing'includes the issuance of $36,000 s~rial bonds of the Town and the levy of a tax upon~all'the taxabl~~ real property in 'the Town to p~y.the"pr-inciPal of and interest on said bonds as the same shall become d~e and payable. section II. Serial bonds of the TOWn of Southold in the principal amount of $36,000 are'hereby authorized to be issued pursuant to the provisions of the Local FinanCe Law, constituting Chapter' 33-~of... the Consolidated Laws of the State of'New York, to finance aaid appropr'i-- ation. SECTION iii. The following addit~i~!matters are'hereby determined and declared: (a) The period of probable usefulness of the specific ~object or purpose for which the bonds authorized by this resolution are to be issued, within the limitations of Section ll.00 a. 29 of said Local Finance Law, is five (5) years. (b) current funds are not required by said Law to be provided as a down PaYment prior to the issuance of the bonds hereby authorized or of any notes issued in anticipation of the sale of such bonds, pursuant to the provisions of $107.00 d.5. of said Local Finance Law. ~ ~ (q) The proposed maturity of the bonds authorized by ~his resolut'ion may not exceed five (5) year. Secti6n 4.. Each of the serial bonds authorized by this resolution and any bond anticipation notes issued in anticipation of the sale of said bonds shall contain the recital o_~ validity ~s prescribed by $52.00 of said Local Finance Law and said bonds and any notes issued in antici- pation of said bonds, shall be general obligations of the .Town, payable as to both ~principal and interest by general tax'upon ali the taxable real prope~rty within the Town without limitation of gate or amount. The faith and credit of the ToWn are h~eby irrevocably pledged to the punctual payment of the principal of and interest on said ~on~s and provisionsshall be made annually in the budget of the Town by approp- riation for (a_ the amortiza~i0n and redemption of the bonds and any notes in anticipation thereof to mature in such year and (b) the payment of interest to be due and payable in such year. Section 5. Subject to the provisions of this resolution and of Said ~0cat Fi~nance'..Law, ~nd pursuant to the provisions of ~30.00 and ~ 50.00' and iht 56.00 to 60.00 of said Law, the powers and duties of the Town Board relative to prescribing the terms,' form and contents and as to the sale and issuance of the bonds and any notes issued in ant~ic- ipation of said bonds, are hereby delegated to the Supervisor, chief fis- cal officer of the Town. Section 6. The validity of the bonds authorized by this resolution and of any notes issued in ant_icipation of said bonds, may be contested only if: (a) such obligations are. authorized for an obj~ect or purpose for which the Town is not authorized to expend money (~) the provisions of 1,aw which should be complied with at the date of the publication of suc~ resolution, are not substant-~ ~ ially Complied with, and an action, suit or proceeding 6ontesting such ~alidity, is commenced within twenty days after the date of such publication, ~ (c) such obligations are authorized in violation of the provisions of.' the Constitution. Moved by Justice clark; seconded by Justice Tuthill; WHEREAS, Dr. Schaefer has requested permission to run a water pipe on Town-property, and WHEREAS, the Highway Superintendent has examined ~he situation and re- commends t~e issuance o~ a permit therefore, NOW, THEREFORE, BE IT RESOLVED: That the Town Board hereby authorizes the Supt. of Highways to issue a permit for the placing of a water pipe within the bonds of the Town Highway. Albertson, be and he hereby is authorized to hire Douglas Robertson to supervise the numbering of houses in. the Town of Southo!d at the rate of $2.00 per ~hour. Moved by Councilman D~mare~t; sec~ded by Justice Tuthi~l; WHEREAS, THE Commerce and Industry Fund in the Annual Budget for the current year is $3000.00, and WHEREAS, of such sum appropriated, $3000.00 remains unexpended to date, NOW, THEREFORE, BE IT RESOLVE~: That $500.00 of said unexpended balance be and the same is transferred to Economics Opportunities Committee, other expense, and that the amount heretofore appropriated for said purpose be and the same is increased in the amount of $500.00. Vote of Town Board: Ayes- upervisor Albertson; Councilmen Demarest and Valentine; Justices Tu~hill and Clark. A letter was received from~lr. Arch Davis offering twenty pin oaks for public use. A letter was receive~d~rom Kimogenor Point Corporation, New Suffolk, New York, requesting the Supervisor to have the County consider a dredging project at the north of West Creek. This request was for- warded to the County Superintendent of Public Works. A letter was read from the Mayor of the Town of Southwold, England, thanking the Supervisor for the programs and information concerning our 325th Anniversa~y Celebration. Mr. Knowles and Mr. Prellwitz~were present to thank the Town Board for having the County dredge ~n Richmonds Creek. Adjournment was~h 5:45 P.M. Albert W. Richmond Town Clerk.
