and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD
the pre~nises herein granted unto the party of the second part. the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to
the payment of the cost of the i~nprovement before using any part of the total of the same for any other purpose.
The word "party" ~hall be construed as if it read "parties" whenever the sense of this indenture so requires.

All that certain plot piece or parcel of land, situate, lying and being in the
Town of SOUTHOLD, at SOUTHOLD, County of Suffolk and State of
New York being in the Town of Southold, County of Suffolk, State of New
York, being more particularly bounded and described as follows:
BEGINNING at a point 532.26 feet northerly from the northerly line of
North Bayview Road, said boundary line being also the westerly line of a
thirty foot fight of way over said land of County of Suffolk, said point of
beginning, being the northeasterly corner of land of WENDELL; fi'om said
point of beginning; THENCE along said land of WENDELL, north 73
degrees 01 minutes 10 seconds west, 148.84 feet to the easterly line of a
twenty foot right of way; THENCE along said easterly line north 17 degrees
34 minutes 30 seconds east, 98.08 feet to the southerly line of a thirty foot
right of way; THENCE along said southerly line south 72 degrees 25
minutes 30 seconds east, 149.00 feet to said land of County of Suffolk and
said westerly line of said thirty foot right of way; THENCE along said land
of County of Suffolk being also along said westerly line south 17 degrees 40
seconds 30 seconds west, 96.53 feet to the point or place of BEGINNING.
TOGETHER with a no.n-exclusive easement over a right of way 30 feet
wide fi-om the northeasterly corner of the premises above described
southerly to North Bayview Road, a public highway.
