Present Were: Absent Were: Doris McGreevy, Member Jack McGreevy, Member Tom Schlichter, Member Jennifer Mannino, Member Jacob Smith, Student Member Lauren Standish, Secretary Don Wilder, Chairman Peggy Dickerson, Trustee CALL TO ORDER Member Jack McGreevy called the meeting to order at 6:00 PM. CHAIRMAN'S ANNOUNCEMENTS Chairman Don Wilder was absent, REPORTS Members Jack McGreevy and Doris McGreevy will write an article about the dangers of pesticides and present it to the Board of Trustees to incorporate into their monthly newspaper informational article. 2 APPROVAL OF MINUTES Moved by Doris McGreevy, seconded by Jack McGreevy, to Approve the Minutes of August 17, 2005. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Jack McGreevy, seconded by Jennifer Mannino, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of LEWIS L. & GRACE R. EDSON to construct a single- family dwelling, attached rear deck, driveway, and sanitary system. Located: 305 Cedar Point Dr., Southold. SCTM#90-2-26 The CAC recommends Disapproval of the application because the proposed dwelling is too close to the wetlands. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Jennifer Mannino, it was RESOVLED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of GRACE R. EDSON to construct a single-family dwelling, swimming pool, attached decking, driveway, sanitary system and public water. Located: 355 Midway Rd., Southold. SCTM#90-2-28 The CAC recommends Disapproval of the application because the proposed dwelling is too close to the wetlands. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Jennifer Mannino, it was RESOVLED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of LEWIS L. & LEFFERTS P. EDSON to construct a single- family dwelling, swimming pool, attached deck, detached garage, driveway and sanitary system. Located: 405 Cedar Point Dr., Southold. SCTM#90-2-27 Vote of Council: Ayes: All Motion Carried Moved by Tom Schlichter, seconded by Jack McGreevy, it was RESOVLED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of OTTO FERCHAU to enclose the existing patio and to convert the existing garage into living space by removing the door and installing new windows and a new floor. Located: 345 Meadow Lane, Mattituck. SCTM#'115-5-4&5 Vote of Council: Ayes: All Motion Carried Moved by Tom Schlichter, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Wetland Permit application of JAMES BROWN to remove the existing 3'X 64' dock and replace with a 3'X 70' open pile dock in a new location with a 3'X 12' ramp and a 6'X 20' floating dock with two (2) dolphin piles. Located: 170 Oak St., Cutchogue. SCTM#136-'J-52&53 The CAC recommends Approval of the application with the following conditions: the new docking facility is in line with the surrounding docks; the docking facility doesn't exceed 1/3 the width of the creek there should be W' spacing between the decking there should be minimal disturbance to the creek and the flora along the shoreline during construction. Vote of Council: Ayes: All Motion Carried Moved by Tom Schlichter, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit and Coastal Erosion Permit applications of D. CLAEYS BAHRENBURG to construct a docking facility consisting of a 4'X 79' fixed elevated catwalk, 3.5'X 15' hinged ramp, and 6'X 20' floating dock. Located: 220 Bay Ave., Orient. SCTM#24-2-21 The CAC recommends Approval of the application with the Condition the docking facility doesn't extend into the water any further than the immediate adjacent docks. Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of JOHN & MARTHA WATTS to re-grade the surrounding property around the existing residence with additional soil brought onto the property. 4 Located: 100 Harbor River Rd., Orient. SCTM#24-2-8 Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of BART & PAT JOHNSON to demolish the existing dwelling and construct a new dwelling, attached garage, sanitary system, and parking area. Located: 860 Bayview Dr., East Marion. SCTM#37-5-7 The CAC recommends Disapproval of the application because of the following: the property was not posted; the house is too close to the water; access was denied onto the property by the property owner. The CAC would like to note for the record that the property owner was extremely hostile to the CAC members during inspection. Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Jack McGreevy, to TABLE the Wetland Permit application of COVE COTTAGE COMPANY, LLC to reconstruct +/-62 linear ft. of existing 4' wide fixed wood pile and timber pier, extend reconstructed pier +/-40' landward to replace existing ramps and platform, elevate pier to clear tidal wetlands and install a new 20' X 3.5' hinged ramp. Located: Peninsula Dr., Fishers Island. SCTM#10-11-2 The CAC Tables the application until an inspection is made. The CAC would like to be contacted by the Board of Trustees to make a joint inspection. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Tom Schlichter, it was RESOVLED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of THOMAS J. GORMAN to construct a one (1) story 12'X 25' addition and stairway onto an existing two-story frame house. Located: 1875 Laurel Way, Mattituck. SCTM#121-4-23 The CAC recommends Approval of the application with the Condition drywells and gutters are installed to contain the roof run-of and a line of hay bales is placed down prior to construction. vote of council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Tom Schiichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of ROBERT FOX cio KIMOGENOR POINT CO. to reconstruct 151' of existing timber bulkhead situated along the northern shoreline of subject property, extend the western terminus of the bulkhead by 6' and extend the eastern terminus of the bulkhead by 6', both with vinyl sheathing and recommends DISAPPROVAL of the application to construct an additional Iow-sill vinyl sheathing bulkhead off the northern shoreline measuring 145' and measuring 1.75' in top elevation. Deposit 100 cy. of clean fill within the section of the property directly to the north of the existing frame building to match the top elevation of the bulkhead (4.0'EL). Depoit 40-50 cy. clean fill where necessary along the landward side of the proposed Iow-sill bulkhead and the edge of the existing vegetation therein to provide a more uniform grade, and actively vegetate this area with Spartina altemiflora planted on 6" on center. Located: Kimogenor Point Rd., Cutchogue. SCTM#116-6-24.1 The CAC recommends Approval of the application with the exception of the additional Pow-sill bulkhead and deposit of clean fill behind the proposed bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Tom Schlichter, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of SHIRLEY TUTHILL to construct a single-family dwelling with attached garage, driveway, and sanitary system. Located: 4563 Wickham Ave., Mattituck. SCTM#107-4-12 The CAC recommends Approval of the application with the Condition of a 50' non- disturbance buffer. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Tom Schlichter, to 6 TABLE the Wetland Permit and Coastal Erosion Permit applications of LEWIS L. EDSON to construct a single-family dwelling, deck, and sanitary system. Located: Stephenson Rd., Orient. SCTM#17-1~2.2 The CAC Tables the applications until the stakes are labeled. Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application o fJOANNE & WILLIAM TURNBULL to construct a 14.5'X 19' addition to an existing attached deck. Located: 54005 North Rd., Southold. SCTM#52-1-1 The CAC recommends Disapproval of the application the proposed deck is too close to the bluff and would create a potential erosion problem. The natural vegetation should be restored along the bluff. Vote of Council: Ayes: All Motion Carried Moved by Tom Schlichter, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application o fKEVIN & DOREEN BARR to remove and replace (in-place) approx. 158 linear ft. of existing timber bulkhead with vinyl bulkhead and backfill with approx. 25 cy. of clean sand fill to be trucked in from an upland source. Remove existing beach steps and deck, and construct 4' boardwalk, 10'X 10' deck and platform and steps to beach. Located: 200 Basin Rd., Southold. SCTM#81-1-20 The CAC recommends Approval of the application with the Condition the length of the boardwalk is specified on the plans and no CCA treated lumber is used. Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND PERMITS Moved by Doris McGreevy, seconded by Tom Schlichter, it was 7 RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Amendment application of JOHN & JOY GALLAGHER to Amend Permit #5745 to add a 2'8" X 10' ramp and a 6'X 20' floating dock to the existing fixed dock. Located: 730 Bayview Dr., East Marion. SCTM#37-5-4 The CAC recommends Disapproval of the application because the proposed dock is too close to the neighboring dock, it will impede navigation, and the current water depths are sufficient for the existing structure. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Jennifer Mannino, to TABLE the Amendment application of JOSEPH & THERESE ClAMPA to Amend Permit #5667 to remove the existing rock wall and wire fence, replant designated area, trim phragmites to height of one foot each year, and for the existing jet-ski float at the end of the dock. Located: 650 Beachwood Lane, Southold. SCTM#70-10-56 The CAC Tables the application because the gate was locked and there was no access into the property. Vote of Council: Ayes: All Motion Carried Moved by Jacob Smith, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Amendment application of WILLIAM KELSEY to Amend Permit #5848 to spread excavated soil from the basement down the bank to be graded under the existing stairway down the bank to the beach. Located: 4000 Peconic Bay Blvd., Mattituck. SCTM#128-6-2 The CAC recommends Approval of the application with the Condition there is no run-off into the Bay. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Amendment application of ALEX WlPF to Amend Permit #6024 to increase the height of the retaining wall from 1' to 18", and rebuild the steps down to the beach to accommodate the 18" height and to install a 9.5' step in front of the wall. 8 Located: 940 West Creek Ave., Cutchogue. SCTM#103-13-7 The CAC recommends Approval of the application with the Condition a plan is submitted for the stairs. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doris McGreevy, to TABLE the Amendment application of AUDREY WlGLEY to Amend Permit #995 for the existing 4'X 48' fixed dock, 2.5' ramp, and two (2) 6'X 20' floating docks. Located: 535Westview Dr., Mattituck. SCTM#139-1-22 The CAC Tables the application because the description was vague. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Tom Schlichter, it was RESOVLED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment application of VICTOR AND MARY ZUPA to Amend Permit #-4992 to reconflgure the existing structure as to provide adequate depths so that neither the float nor the boats rest on the bottom at Iow tide. Located: 365 Basin Rd., Southold. SCTM#81-1-13.1 Vote of Council: Ayes: All Motion Carried The next meeting of the Conservation Advisory Council has been set for Wed., October 12, 2005 at 6:00 PM at Down's Farm Preserve.
