Box 1179 Southold, New York 11971-0959 CONSERVATION ADVISORY COUNCIL TOWN OF SOUTHOLD MINUTES Wed., December 14, 2005 6:00 PM A meeting of the Southold Town'Conservation Advisory Council was held Wed., December 14, 2005 at Down's Farm Preserve. Present Were: Absent Were: Don Wilder, Chairman Jack McGreevy, Member Doris McGreevy, Member Jennifer Mannino, Member Jacob Smith, Student Member Lauren Standish, Secretary Tom Schlichter, Member Peggy Dickerson, Trustee CALL TO ORDER Chairman Don Wilder called the meeting to order at 6:00 PM. CHAIRMAN'S ANNOUNCEMENTS None REPORTS The CAC is compiling general information on non-point pollution and will eventually bring this information to the attention of the Town Board. The following recommendation was made to the Southold Town Board: 2 RESOLVED, that the Southold Town Conservation Advisory Council recommends the appointments of James Eckert and Peter Young to the Council. All Ayes: Motion Carried Member Doris McGreevy announced her resignation from the Council. The Council members expressed their sincrere appreciation to Doris for her valuable contributions. APPROVAL OF MINUTES Moved by Jack McGreevy, seconded by Jacob Smith, to Approve the Minutes of November 9, 2005. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of DAVID SHAMOON to construct a 36'X 60' single-family dwelling with 12'X 34' wood deck attached to the east side, install a 20'X 40' pool to the north of the proposed dwelling, construct a 30'X 24' garage, and install a sanitary system with a retaining wall. Located: 2404 Camp Mineola Rd. Ext., Mattituck. SCTM#122-9-7.20 The CAC recommends Approval of the application with the Condition of a 5' non-turf buffer and 10' non-disturbance buffer. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jennifer Mannino, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Wetland Permit application of CARLA STARCIC to construct a single-family dwelling and deck. Located: 205 Private Rd. #3, Southold. SCTM#70-6-9 The CAC recommends Approval of the application with the following Conditions: no fertilized lawn areas all roof run-off must be contained in drywells on the landward side of the road all property drains contained on site save as many 8" DBA trees as possible. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Wetland Permit application of JANET CARRUS to construct first and second-story porch additions and a two-story garage. Located: 7055 Indian Neck Lane, Peconic. SCTM#86-6-26.1 The CAC recommends Approval of the application with the exception of the addition on the east side and there is no change to the natural vegetation on the north and east sides of the house. Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Jacob Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of DARREN PFENNIG to construct a 4'X 100' bluff stairway, including three (3) 4'X 4' platforms, within the northern section of the subject property. Located: Oregon Rd., Cutchogue. SCTM#72-2-2.3 The CAC recommends Disapproval of the application because the bluff has a steep angle and the bluff will not support stairs at this time. The CAC recommends a five-year planting plan with native species. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of ROY R. WARD II to replace the existing +/-105' retaining wall in-place with C-Loc vinyl sheathing, and install +/-8' of retaining wall return along the north property line. Located: 4075 Stillwater Ave., Cutchogue. SCTM#137-1-8.1 The CAC recommends Approval of the application with the Condition of a 10' non-tuff buffer. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was 4 RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of THOMAS & GEKEE WlCKHAM to remove a closed-in 12'X 20' sun porch on the west side of the house and replace it on the same footprint with new walls, windows, floor and roof, and to add a 6'X 7' one-story addition on the southeast angle of the house. Located: 1230 West Creek Ave., Cutchogue. SCTM#103-13-10 The CAC recommends Approval of the application with the Condition drywells and gutters are installed to contain the roof run-off. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of ROBERT & SUSAN TOMAN to construct a 4'X 40' dock 3.5' above grade, a 3'X 8' ramp, and a 5'X 18' floating dock. Located: 3795 Main Bayview Rd., Southold. SCTM#78-2-15.2 The CAC recommends Disapproval of the application because the proposed docking facility is too close to the property line and exceeds 1/3 across the width of the creek. Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Jennifer Mannnino, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit and Coastal Erosion Permit applications of WILLIAM & MARGARET HOWELL to restore and terrace the bluff slope. Located: 9202 Bridge Lane, Cutchogue. SCTM#73-2-3.1 The CAC recommends Approval of the applications with the Condition the bluff is re- vegetated over the next five years with native plants and 6"X 6' timber is used rather than pipes. Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of EUGENE KRUPSKI to install a pervious driveway. Located: S/s Soundview Ave., Mattituck. SCTM#100-2-3 5 Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Jennifer Mannino, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of STIRLING HARBOR SHIPYARD & MARINA to replace approx. 165' of partially failed bulkhead with vinyl sheathing. Located: Manhaset Ave., Greenport. SCTM#36-1-1 Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconed by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of RITA MARTIN to construct a fixed open walkway 3'X 42' including steps to grade at the landward end, hinged ramp 3'X 16', and floating dock 5'X 12' to be secured by two piles. Located: 295 Maiden Lane, Mattituck. SCTM#140-1-7 The CAC recommends Disapproval of the application because the docking facility will obstruct navigation. The CAC fur[her recommends removal of the chain-link fence. Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of SALLY GUIDO to replace, inkind/inplace, or repair/reconstruct 100'+/- of concrete seawall plus 24'+/- return on south end by adding 6"-9" thick surface facings of new reinforced concrete on three faces (landward side, seaward side, and top) of existing concrete seawall and return; construct new 4' wide concrete steps to grade on the seaward side. Excavate as necessary on both seaward and landward sides of seawall to allow placement of forms; backfill with excavated material, removing any excess from the site. Located: 4055 Bayshore Rd., Greenport. SCTM#53-6-20 Vote of Council: Ayes: All Motion Carried Moved by Doris McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of STEPHEN MATTEINI to replace, inkind/inplace, or 6 repair/reconstruct 150'+/- of concrete seawall by adding 6"-9" thick sur[ace facings of new reinforced concrete on three faces (landward side, seaward side, and top) of existing concrete seawall; construct new 4' wide concrete steps to grade on the seaward side. Excavate as necessary on both seaward and landward sides of seawall to allow placement of forms; backfill with excavated material, removing any excess from the site. Located: 3855 Bayshore Rd., Greenport. SCTM#53~6-19 Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit and Coastal Erosion Permit applications of PATRICIA SCOTT & RICHARD TERRY to demolish the existing single-family dwelling and rear deck/steps, and construct a new single-family dwelling, front porch/entryway, rear porch, rear deck, swimming pool, and attendant sanitary system and private well. Located: 925 Stephensons Rd., Orient. SCTM#17-1-2.1 Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of OLE JULE, LLC to remove and replace (in-place) approx. 135 linear ft. of existing timber bulkhead with vinyl bulkhead; dredge approx. 30 cy. of sand/silt spoil from an area up to 10' off bulkhead to a maximum depth of-4' ALW; use approx. 15 cy. spoil as backfill; truck remaining spoil to an approved upland location; and restore disturbed portions of existing 50' buffer. Located: 4340 Ole Jule Lane, Mattituck. SCTM#122-4-30 The CAC recommends Approval of the application with the Condition the buffer is maintained and a pervoius wallkway to the water. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of DAVID, PRESTON & MARY MEARS AND THOMAS COUSE to remove the existing wood steps; construct an attached wood deck and steps onto an existing one-story, one-family dwelling; and install drywells. 7 Located: 1050 Dean Dr., Cutchogue. SCTM#116-5-12 The CAC recommends Approval of the application with the Condition ail non-turf areas remain as is. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Jennifer Mannino, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit appliation of KATHRYN A. CAMPBELL to construct a screened porch. Located: 570 Hippodrome Dr., Southold. SCTM#66-2-12 Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jennifer Mannino, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of GIACOMO CHICCO to add a one- story 22'X 11' addition for a sunroom and expand the kitchen by adding a one-story 9'X 14' addition. Located: 2797 Cedar Beach Rd., Southold. SCTM#79-8-15.2 The CAC recommends Approval of the application with the Condition drywells and gutters are installed to contain the roof run-off, to the west of the structure. Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND PERMITS Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the application of W. BRUCE BOLLMAN to Amend Permit #5901 to move the footprint of the dwelling 2.6' to the east, abandon the existing septic system and install a new septic system, and a Coastal Erosion Permit to allow for the construction activity in an approx. 32 sq.ft, section seaward of the CEHA. Located: 1755 Truman's Path, East Marion. SCTM#31-13-4 The CAC recommends Approval of the application with the Condition the seaward side of the house is planted with native species after construction and a retaining wall is installed on the southwest corner of the property. 8 Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Jennifer Mannino, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the application of MARY ZUPA to Amend Permit #5636 to install 1000-1500 lb. rock armor seaward of a section of the new bulkhead from the existing jetty easterly for a distance of 112'. Install 332' timber retaining wall 12' landward of the new (replacement) bulkhead. The area between the bulkhead and the proposed retaining wall will be maintained as a non-turf buffer. Located: 580 Basin Rd., Southold. SCTM#81-1-16.7 The CAC recommends Approval of the application, however observed disturbance to the natural foliage on the property. Vote of Council: Ayes: All Motion Carried The next meeting of the Conservation Advisory Council has been set for Wed., January 11,2006 at 6:00 PM at Down's Farm Preserve.
