Dear Assemblywoman Acampora:
This is in response to your recent letter on behalf of Mr. King concerning the requirements for a
Highway Work Permit for the subject site. We have completed our review and offer the
following:
Mr. King contacted our office directly concerning his site in March 2005. He explained to my
staff that he was expanding the business on site and the Town required that he secure approval
for site access from us prior to being issued his C.O. After speaking with Town personnel, it was
noted that the Town informed him of this requirement over two (2) years ago.
A member of my staff met with Ms. King and performed a site inspection with Town of Southold
personnel on March 30, 2005. Our inspection noted that the entire Route 25 frontage of Mr.
King's business is not delineated with curb, the access is not properly delineated, and,
furthermore, the sidewalk is in poor condition. Additionally, wooden planters have been placed
within the State highway right-of-way along the Route 25 frontage.
These wooden planter boxes constitute a safety hazard within the State right-of-way, and we
have requested that they be removed. However, once the planters are removed, the lack of
curbing along the site frontage will allow for head-in parking along the entire site frontage. Mr.
King's property line is located only 9+/- feet off the face of the building so that any type of
parking would encroach upon the State right-of-way, which is not permitted. The parking would
also encourage backing maneuvers onto the busy State highway, creating hazards to ongoing
traffic, bicyclists and to any pedestrians. The site has ample on-site parking and the means to
develop a safe delineated access point to that parking.

Our policy for access to the State highway states that "Frontage of all commercial properties
shall be controlled by positive means such as curbing or ditches which limits access to designated
driveways. The purpose of the access control is to direct entering and exiting vehicles into a
well-defined flow pattern and separate traffic movements on the private property from the
highway traffic. This will provide maximum safety for motorists and minimize interference
between traffic on the highway and on the property."
At the site in question, the conditions as stated above are contrary to our policy for access to the
State highway.
Our May 3, 2005 letter to Mr. King (copy attached) outlined necessary improvements along the
State highway frontage. Mr. King contacted my staff by telephone with his concerns and, in an
effort to minimize the cost of the project, my staff offered to assist him in site plan preparation
waiving formal plans prepared by a licensed architect or engineer.
Our requirements for access and site frontage improvements are consistently applied to all of our
customers pursuant to our Policy and Standards for the Design of Access to State Highways
manual. We understand that site improvements can be financially burdensome; however, in the
interest of highway safety and fairness to other applicants, consistency in the application of our
policy is important. The Town is also in agreement with our proposals for this site.
We hope that our response has satisfactorily addressed the issues presented to us.

This is in regard to the site plans for the referenced project which were submitted to us for
review.
Prior to an approval of the site work and issuance of a New York State Highway Work Permit,
the following items must be addressed:
In recent years, many states have employed access management as a major technique to
address conflicts between through traffic and that generated by developments. The goals
of access management are to limit the number of access points, separate conflict points
and remove turning traffic from through movements. New York State is utilizing this
technique to minimize impacts to State highways. We recommend, therefore, that cross
access to this site be obtained from adjacent properties. If this is not presently possible, it
should be shown on the plans for implementation as part of future redevelopment.
2. Site Plans shall be developed that contain all of the information noted on the attached
checklist.
3. We recommend sidewalk and curb along the entire site frontage. We have enclosed a
publication for your reference in providing the correct specifications.
4. The existing planters shall be removed from the State highway right-of-way.
5. Driveway and pavement repair specifications shall be included with re-submitted plans.

A note shall be added to the plans requiring the contractor to clean existing drainage
basins along and immediately adjacent to the Route 25 site frontage at the completion of
construction.
7. The plan must include the note "Repair existing shoulder, sidewalk and curbing as
ordered by State Engineer."

An inspection was made of the above premise's to determine compliance
with the "as built" site plan.
Mrs. King informed me that the improvements to the parking areas had
not been made because of other business related activity.
I had indicated to Mrs. King, that as a minimum, the Board would require
the parking spaces and handicapped space together with bumper steps
and handicapped logo and sign be installed along the west side of the
building. In addition, several parking spaces with bumper stops should
be installed at the west end of the property.
The existing markings in front should be painted over to eliminate
parking in this area.

Board has indicated that if the concrete building is rented, that a
'v of the curb cut would be required by the New York State

MEMORANDUM TO FILE
In the matter of the change of zone request for Stephen King for a
change of zone from Residential Low Density (R-40) to General Business
(B).

The Planning Board is in favor of this zone change for the following
reasons:
The rear section of this General Business (B) parcel is zoned
R -40, one acre residential. The residential rear lot is .69 of
and acre, thus it is non-conforming as to area.
The use of this parcel for a conforming use ie. a residence is
precluded by its non-conformity.
The business zoned front parcel contains buildings that require
adequate off-street parking. This current parking is in front of
the buildings and close to the Main Road. This has resulted in a
dangerous situation of cars backing onto the Main Road. In order
to correct this condition the applicant has requested the zone
change to use the rear portion of the property for adequate
off-street parking.
The front parcel containing the two buildings is non-conforming
as to area to support two business uses. By rezoning the rear
residential parcel to business the property will be conforming for
two uses.
Because of the lack of adequate of street parking on the business
parcel and the inability to conduct two businesses, the property
has been vacant, allowing the buildings and the property to
fall into disrepair. The zone change will result
in the new owner refurbishing the buildings and restoring the
property to acceptable standards.
