The following resolution was adopted: WHEREAS, this proposed site plan to be known as a site plan for Hart's Hardware, in Southold, is to construct a 1,000 square foot addition for retail space and storage space in an existing hardware store in a Business Zone on property located on State Route 25, 95 feet west of Jockey Creek Drive in Southold; and WHEREAS, Lisa Jerome, c/o Hart's Hardware, is the owner of the property known and designated as Hart's Hardware, SCTM#1000-70-5-6.2; and WHEREAS, a formal application for approval of this site was submitted on August 20, 1999; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act (Article 8), Part 617, declared itself lead agency and issued a Negative Declaration on August 12, 2002; and WHEREAS, the Zoning Board of Appeals granted relief from the 35 foot rear yard and 100 foot front yard setback requirements, and further allowed the proposed building to ~xceed 60 feet of linear frontage on one street, on September 30, 1999, Application No. 699; and Hart's Hardware - Paqe Two - 12/17/02 WHEREAS, on September 12, 2002, the Architectural Review Committee reviewed and approved the proposed elevations; and WHEREAS, the site plan, dated February 19, 1999, and last revised November 22, 2002, was certified by the Building Inspector on December 13, 2002; and WHEREAS, the Town Engineer has reviewed the drainage calculations and the Planning Board has accepted his recommendation for approval; and WHEREAS, the proposed site plan application was approved by the New York State Department of Transportation and was issued Permit No. 10 02 0312 on September 24, 2002; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, all the requirements of the site plan regulations of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board grant final approval to the surveys, dated February 19, 1999, and last revised on November 22, 2002, and authorize the Chairman to endorse the final site plan. Since this project is located adjacent to the State Highway, it is recommended that the Dept of Transportation be notified. The modifications to the existing curb cut at this site may require a Permit from their office. Please disregard this item if the DOT has already reviewed the project and given their input. The drainage design for the project indicates that one 8' diameter x 4' deep leaching pool will be installed to contain runoff from the proposed addition. Town Code requires a run-off coefficient of (1.0) for all roof areas. The calculations provided by Item # 4 in the Notes used a (.9) coefficient. However, even with this change to the calculations, the proposed design would still be large enough to comply with the Code. At this time, I would like to point out that no additional provisions were made to contain run-off from the remainder of the site. As proposed by the plan, the existing parking area is to be reconstructed. This item would include new concrete curbs with structured curb cut access to the site and the installation of new blue stone blend surfacing. Please note that the existing drains along State Route 25 adjacent to this site discharge directly into Jockey Creek. The New Stone Blend parking areas may be pervious but significant amounts of run-off will still be generated. It is recommended that additional drainage be provided to contain any run-off that would ultimately drain off the site and enter systems that discharge into Jockey Creek. Roadway improvement plan we will provide a detailed roadway improvement plan. The surveyor will review the site plan check list and show all existing utilities, signs, trees, etc. 3. with respect to the items required in paragraph 3 The requirement that the owner remove the existing curb, sidewalk, asphalt apron for the full Route 25 frontage, and to extend around the radius of Jockey Creek Drive is impossible. We request a waiver of these requirements due to financial hardship. The existing 45 year old business is privately owned and merely wishes to build a 25 x 40 addition to the existing building. The cost to remove and replace the existing curb, sidewalk and apron on Route 25 and on Jockey Creek Drive will far exceed the cost of the small addition. If the State imposes this requirement my client can not proceed with the plans for the addition due to financial hardship. My client will install two standard 24' wide concrete aprons on Route 25 in accordance with your standards, the aprons will control the traffic pattern from Route 25 into the store. The additional internal curbing will cause traffic circulation problems within the parking and driveway areas. The site plan is being modified in accordance with the Town's recommendations. Internal curbs are difficult for North Fork customers who drive large pick-up trucks, the site plan is designed to reasonably control driveway circulation within the existing property lines and location of existing buildings. According to a survey by Joseph Ingegno dated February 19, 1999, it has a total area of 20,264 sq. ft. with a 200 ft. frontage on Main Road and 90 feet on Jockey Creek Drive. The property is improved with a frame building used as a hardware store, and frame shed/garage. It is zoned B General Business. BASIS OF APPLICATION: Building Inspector's April 5, 1999 Notice of Disapproval denying an application to construct an addition to the principal building. The reasons for denial are as follows: (1) Under Article X, Section 100-102, the Bulk Schedule for the B District requires a minimum rear yard of thirty-five (35) f~=et. The proposed rear yard setback is indicated as twenty-six (26) feet. (2) Under Article X, Section 100-103A, structures shall be set back at least one- hundred (100) feet from the right-of-way. The proposed front yard setback from the Jockey Creek Drive right-of-way is ninety-five (95) feet. (3) Under Artide X, Section 100-103C, the project shall be divided into separate structures so that no single structures shall have more than sixty (60) linear feet of frontage. The existing structure is 68.8 feet and the proposed addition is 25 feet. This is a total of 93.8 feet. REL/EF REQUESTED: Applicant requests a variance authorizing construction of the addition as proposed. Applicant's odginal proposal showed the front wall of the addition set back 5 feet from the front wall of the existing store, resulting in a minimum rear yard (east) ~ck of~6 feet. No. 469~ 1000-70-5-6.2 (Jerome) Southold Town Board of Appeals REASONS FOR BOARD ACT[ON, DESCRIBED BELOW: Based on the testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) The proposed addition would extend the hardware store's Main Road frontage by 25 feet, from 68.6 feet to 93.8 feet, and would be 40 feet deep on the north side facing ]ockey Creek Drive. Applicant states that this is the only reasonable and cost-effective way to achieve a needed expansion. (2) The rear of the existing building is 41.6 feet from the rear lot line at the closest point. Although the addition will be less deep than the existing building, the rear yard setback will be reduced to 26 feet at the closest point (under Applicant's odginal proposal) because the rear wails are not parallel to the lot line. The shape of the property is such that applicant requires a rear yard setback variance in order to build a reasonable addition to the store. (3) The Board concludes it is preferable to follow Applicant's odginal plan for setting the addition's front wall back approximately 5 feet from the line of the existing front wall, and at the September 30 hearing Applicant agreed to this. Grant of a rear yard setback variance authorizing 26 feet at the closest point to the easterly lot line will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties because the addition will not substantially change the nature of the building or its appearance in the neighborhood. (4) The requested variance authorizing a front yard setback from Jockey Creek Drive of 95 feet, rather than the required 100 feet, is not substantial. The resulting 5- foot deviation from the requirement is very modest and for this reason will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. (5) There are no factors present to suggest that grant of the vadance relief set forth below will have an adverse effect or impact on physical or environmental condi- tions. The grant of this relief is the minimum action necessary and adequate to enable applicant to have the benefits of an expanded business structure while presen/Ing and protecting the character of the neighborhood and the health, safety and welfare of the community.
