Dear Mr. Hughes:
The following resolution was adopted by the Southold Town Planning Board at a
meeting held on Monday, August 11, 1997:
WHEREAS, Harvey Bagshaw is the owner of the property known and
designated as SCTM# 1000-122-3-6, located on Rt. 25 in Mattituck; and
WHEREAS, Harvey Bagshaw has given his approval to Michael Kevin Hughes
to lease two buildings of 1200 square feet and 1600 square feet apiece on his
property for boat sales and accessory repair; and
WHEREAS, the Planning Board had granted a site plan waiver for this use on
March 3, 1997, subject to a front yard buffer clear of boats and with planters
installed as shown on the site plan dated February 12, 1997, accompanying the
waiver granted on March 31, 1997; and
WHEREAS, the conditions of the waiver have not been met in that the planters
have not been installed and the 20' front yard buffer is not clear of boats; and
WHEREAS, Mr. Bagshaw has not supplied the requested documentation
showing the areas leased by Mr. Hughes; and

WHEREAS, the waiver granted on March 31, 1997 contained the statement that
any changes in the conditions of this waiver resolution and site plan dated
February 12, 1997 may be grounds for rescinding this waiver; be it therefore
RESOLVED, that the waiver granted on March 31, 1997, be rescinded.

reinstating the previous site plan as built.
The only previous Board approval for the above property was a waiver
granted to North Fork Yachts on March 31, 1997. This waiver was
rescinded on August 11, 1997, because the conditions of the waiver had
not been met.
The enclosed letter dated August 27, 1997, was sent to your attorney
requesting a site plan for the property.
The Board reinstates the request in its letter of August 27, 1997, that a
site plan application be filed for the above property.
For your convenience, a site plan application is enclosed.

122-3-5.1) but he does not own the property. He is interested in the Bagshaw property just to
the west (Tax ID 122-3-6).

As discussed at our meeting of August 11, 1997, the Planning Board has
rescinded the waiver granted to North Fork Yachts on August 12, 1997,
and is requesting a site plan for your clienfs property.
The plan should be drawn by a licensed surveyor or civil engineer and
must show the metes and bounds of the property lines.
The parking for all uses shown on the plan must meet the Town code for
parking requirements. No parking should be on the State's right-of-way
or in the front yard area that would block the view of traffic on Route 25
for exiting cars.

Dear Mr. Bagshaw,
The Planning Board has not received a response to its letter to you of
May 7, 1997, (enclosed), requesting a copy of the lease and survey
showing the specific portions of your property that Mr. Hughes of North
Folk Yachts is permitted to occupy.
Further, Mr. Hughes has not complied with the conditions of his waiver,
in that he has not installed the planters as shown on the site pla_n
accompanying the waiver and has not keep the twenty foot (20') front
yard buffer clear of boats as shown on the plan. The parking shown on
this site plan can now be relocated to the rear parking area.
In addition, as mentioned in the letter, an amended site plan is required
now that the Zoning Board has approved parking in the rear of your
property for Blue Water Seafood.
Nearly three months have elapsed since our last meeting. If the amended
site plan is not received and the conditions of the waiver are not met by
August 4, 1997, the Board will have to rescind the waiver and refer the
matter to the Town Investigator for enforcement action.

Dear Mr. Bagshaw:
At the Planning Board's work session on April 21, 1997, we met with you and
your attorney, Eric Bressler. At that meeting, Mr. Bressler explained that under
the terms of the lease your tenant, Mr. Hughes of North Fork Yacht Sales, did
not have permission to use the front portion of the subject property for a depth of
20 feet. A copy of the lease and the nature of this restriction was not revealed to
the Planning Board at the time of the waiver request in March.
Our anticipation was that a copy of this lease and a survey showing the specific
portions of the property which Mr. Hughes is permitted to occupy and use under
the terms of that lease would be submitted. To date, the Board has not received
this material. The Board requests a copy of the lease and a survey delineating
the precise area which Mr. Hughes is permitted to occupy and use. It may be
necessary to revisit the site plan waiver approval in light of this new information.
With regard to the proposed parking to the rear for the use of Blue Water Cafe, if
the Zoning Board should grant permission for this to occur, you will be required
to sut:)mit an application for an amended site plan.

proper~y per use; and
WHEREAS, the subject property is 1.375 acres and is improved with three
buildings: a vacant corrugated metal building, a one-story stucco building

and
WHEREAS, the proposed change from a former use as a pool supply store
to boat sales and accessow repair will not be a more intensive use of this
property; and
WHEREAS, the boat sales and accessory repair would require thirteen (13)
parking spaces; and
WHEREAS, provision has been made for thirteen (13) parking spaces,
including a handicapped space; and
WHEREAS, bumper stops will be placed to define the parking spaces; and
WHEREAS, the applicant has placed a note on the "as built" site plan
dated February 12, 1997, and accepted by the Planning Board, that if the
corrugated metal building presently vacant, is used for any purpose, the ..
property owner will be required to return to the Planning Board for review;//
and
WHEREAS, a lease with Blue Water Cafe to park 22 cars on this property
has been canceled; and
WHEREAS, no boats may be placed in the area reserved for vehicular
parking; and

WHEREAS, any change in the conditions of this resolution and site plan

BASIS AND REQUEST OF APPLICATION: Zoning Code, under Article
X, Section 100-10lB-12 for Special Exception approval specifically
related to the applicant's occupancy of existing buildings for the
purpose of new-and-used-boat sales and related workshop areas.
PROPERTY DESCRIPTION:
This property is located in a B-General Business Zone District,
being situate on the southeasterly side of State Route 25 (Main
Road), with 134 ft. road frontage. It contains a total lot area of
1.375 acres and is improved with the following: (a) corrugated metal
building, (b) one-story stucco building to be used for boat storage
and display in this application, (c) metal building to be used as a
workshop, located in the rear of the buildings (a) and (b). Parking
and landscaping will be as stipulated by the Planning Board under
the site plan regulations, or under any waiver that may be granted
in the future.
REASONS FOR BOARD ACTION, DESCRIBED BELOW:
1) The zoning code provides for authorization of this particular
use, and its accessory uses, in this B General Business District;
2) This requested use is reasonable in relation to the District in
which it is located, adjacent use districts, and nearby and adjacent
uses: fish market to the west and gasoline station within 275 feet,
nearby boat sales establishment to the north, beverage store to the
east.
3) This Special Exception use will not prevent the orderly and
reasonable use of adjacent properties.
4) This use will not prevent orderly and reasonable uses proposed
or existing in adjacent use districts, because there is more than
sufficient land area available.
5) No evidence has been submitted to show that the safety, health,
welfare, comfort, convenience, order of the town would be adversely
affected, and it was decided by the enactment of this Code in
January 1989, and earlier zoning for the B-1 areas, that this type of
use shall be authorized;
6) All units and site access areas shall continue to be open and
fully accessible at all times for fire and police protection, as well

as easement or right-of-way areas, and these buildings must
continue to meet all fire/building regulations.

The Planning Board has received a revised site plan from tile above
applicant, a copy of which already has been sent to you.
The Board finds that the parking on-site is adequate for the potential
boat sales in the two smaller buildings. A note has been placed on the
revised plan, that before the larger building (the quonset hut) may be
used, the applicant must return to the Planning Board for further site
plan review.
Movable planters are shown on the plan to prevent parking in front of the
site.
Enclosed is a copy of a letter from Mr. Bagshaw who is the property
owner to Mr. Suter terminating the lease of the Blue Water Cafe to park
twenty two cars on Mr. Bagshaw's property. Termination of the lease is
necessary in order for the Bagshaw site to accommodate the required
parking for the proposed use of this site as an outdoor sales/storage
display for the tenant North Fork Yacht Sales.
This Board plans to grant the waiver request for North Fork Yachts at
it's next public meeting on March 31, 1997.

The Planning Board has received a site plan waiver request on the above
property. The plan that was submitted with the waiver request was very
preliminary, and did not show many essential details such as the zone line,
parking spaces and calculations, front yard landscaped area etc. In addition, the
property lacks a curb cut to direct safe ingress and egress.
Town Code Section 100-239.7 (Long-term outdoor display or storage) reads in
part, "All uses which seek to display merchandise long-term outdoors must
obtain site plan approval for this activity." Accordingly, the applicant has been
asked to prepare a site plan for the property showing all essential details as
contained in town Code 100-256 (1) technical data.
In addition to the above the Blue Water Restaurant has a lease for customer
parking on the Bagshaw property.
When the Board receives the requested and required information we will send
you the site plan and our review comments.

A request for a waiver under the site plan regulations has been
filed, we understand, by Mr. Hughes in the above r~fereneed
project. The property is located in the B General Business Zone,
and under Section 100-101B(12), the sale of boats is listed by
Special Exception and site plan approval.
In researching the records, there was a prior use dating back to
about 1972 for storage and display of boats. Would you please
confirm your comments or suggestions concerning the proposed
layout of the site, and whether or not there was also a former site
plan approval of record (ref: Lloyd Lindsay, and others), and ff
your file is available for viewing.
Our hearing has been advertised for February 6, 1997, however, if
you feel it is imperative and require more time, we will notify the
applicant.

proposed signs will require Planning Board approval and a permit

Dear Mr. Dart:
I am writing to inquire as to the Tree Committee's response
to the Mattituck Streetscape project, which was outlined in the
November 4, 1991 letter, a copy of which is attached for your
convenience.
Since that letter, the Planning Board has granted
conditional final approval to Village Marine's site plan which
provides for the planting of one street tree on Bay Boulevard.
Planning staff has also met with a representative of the Amerada
Hess Corporation about adding landscaping and street trees on
the gas station property along Bay Boulevard and Main Street.
Finally, the new owner of the Tolendal Inn has submitted a site
plan showing the placing of street trees along Main Road and New
Suffolk Avenue.
As of this writing, the owners of the North Fork Beverage
Store, the now defunct theatre and the Blue Water Cafe have not
submitted any plans for expansion or renovation on their
properties. The Planning Board would like to know if the Tree
Committee can be of assistance in providing street trees at
these locations in the spring?

Dear Mr. Dart:
As a follow-up to our conversation last Friday, I have
enclosed a sketch of the improvements which the Planning Board
hopes to see implemented over the next several years. The
sketch includes all the properties between the Hess Gas Station
(at the corner of Bay Avenue) and the North Fork Beverage
Store. village Marine has already agreed to install one street
tree when they commence construction. If the Tolendal is
renovated, new street trees will be required along both streets.
At this point in time, the Planning Board is trying to
encourage the owners of the North Fork Beverage Store, the now
defunct theatre and the Blue Water Cafe to install some
landscaping and street trees in their front yards. Presently,
this stretch of stores has no landscaping in the front yards
whatsoever. Please let me know if the Tree Committee can be of
assistance. If you have any concerns, please contact Ben
Orlowski, Jr., Chairman, at 727-3595 Monday through Friday
between 7:30 A.M. and 3 P.M.
