( �a Fax (631) 765-9064 http://southoldtown.nofthfork.net BOARD OF APPEALS TOWN OF SOUTHOLD DINGS, DELIBERATIONS AND DETERMINATION MEETING OF DECEMBER 16, 2004 �_-ZB Ref. 5604- Peter and Mary Jacobs Property Location: 940 Gillette Drive, East Marion; CTM 38-2-10 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 10,000 sq. ft. vacant lot has 100 feet along Gillette Drive and a depth of 100 feet. The property is referred to as Lot 24 on the Map of Marion Manor filed in the Office of the Suffolk County Clerk in 1953. BASIS OF APPLICATION: Building Department's August 30, 2004 Notice of Disapproval, amended October 20, 2004, citing Section 100-244B, in its denial of a building permit to construct a new dwelling with a front yard setback at less than 35 feet and lot coverage in excess of the code limitation of 20% of the lot size, Subsequently, on November 5, 2004, the Building Department furnished a new Notice of Disapproval, amended November 5, 2004, disapproving the revised location of the dwelling for the reason that the rear yard setback is less than 35 feet (after removing reference to the previous request for a front yard reduction). FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 21, 2004 and December 16, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: In the applicants original application, a new dwelling was proposed at less than the code required 35 feet from the front property line, and meeting the code requirement for a 35 ft. rear yard. Also requested was a lot coverage at 22.3% instead of the code limitation of 20%. AMENDED AREA VARIANCE RELIEF REQUESTED: During the October 21, 2004 hearing, the applicants were requested to consider a possible alternative plan that would be more conforming to the code's front setback requirement of 35 feet, and shifting the dwelling to propose a 4 ft. reduction Page 2- December 16, 2004 v File No. 5604- Peter and Mary Jacobs CTM Id: 38-2-10 behind the dwelling for a rear yard of 31 feet instead of 35 feet. (The lot coverage request remained unchanged with the same dwelling footprint.) On November 17, 2004, the applicants submitted a survey, amended 10-25-2004 by John C. Ehlers, L.S. requesting a 31 ft. rear yard setback, maintaining the 35 ft. code requirement for the front yard setback, and calculating the lot coverage at 22.55% of the total lot size, instead of the previously estimate of 22.3%. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of alternative relief will not produce an undesirable change in character of neighborhood or a detriment to nearby properties. The proposed dwelling measures 33.3 feet depth at its deepest measurement, including the front porch, by 74 feet in length (width) inclusive of the garage. The alternative will maintain the minimum 35 ft. code requirement in the front yard setback and will conform to the code's required minimum side yard setbacks (proposed at 11 and 15 feet). The applicants' proposal for a reduction in the rear setback by four (4) feet, for a 31 ft. setback, and increase in the lot coverage by 2.55%, are both similar to others in this vicinity of this property. 2. The benefit sought by the applicants cannot be achieved by some method, feasible for applicants to pursue, other than an area variance. This lot is wide and narrow, and a variance is necessary to allow for a narrow front porch and 27.3 ft. depth of the proposed home, while meeting all remaining setbacks. Minor variances are necessary for the alternative relief requested for a 31 ft. rear setback and for the 255 sq. ft. increase (2.55%) of lot coverage for the applicant's layout and design of the home with a front porch. 3. The alternative relief is minimal with a 2.5% expansion of the current code limitation of 20% lot coverage and four ft. reduction from the 35 ft. rear yard setback requirement. 4. The difficulty has been self-created and is related to applicants plan to build on a 10,000 sq. ft. lot, without meeting the limitations of the zoning code. 5. No evidence has been submitted to show that the grant of alternative relief will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Acting Chairman Orlando, seconded by Member Goehringer, and duly carried, to DENY, the relief requested with respect to the front yard reduction; and to ALTERNATIVELY GRANT the amended relief for a 31 ft. rear yard setback (maintaining the 35 ft. front yard setback), and GRANT the 22.55% lot coverage, as applied for, as shown on 3— December 16, 2004 No. 5604—Peter and Mary Jacobs M Id: 38-2-10 'm the March 1, 2004 survey, amended 10-25-2004 by John C.
