Box 1179 Southold, New York 11971-0959 CONSERVATION ADVISORY COUNCIL TOWN OF SOUTItOLD MINUTES Wed., November 9, 2005 6:00 PM A meeting of the Southold Towfi Conservation Advisory Council was held Wed., November 9, 2005 in the Conference Room of Southold Town Hall. Present Were: Absent Were: Don Wilder, Chairman Jack McGreevy, Member Doris McGreevy, Member Tom Schlichter, Member Jacob Smith, Student Member Lauren Standish, Secretary Jennifer Mannino, Member Peggy Dickerson, Trustee CALL TO ORDER Chairman Don Wilder called the meeting to order at 6:00 PM. CHAIRMAN'S ANNOUNCEMENTS None REPORTS Member Jack McGreevy reported that he completed his report on "Polluting Town Waters" and distrubed a copy to each of the CAC members for review. Member Doris McGreevy reported that the recent video shown on Channel 22 has been sent to Mattituck High School for their viewing and encourages all schools to recognize the dangers of pesticides. 2 APPROVAL OF MINUTES Moved by Jack McGreevy, seconded by Tom Schlichter, to Approve the Minutes of October 12, 2005. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Doris McGreevy, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit appliation of ANN MARIE NELSON to construct 570'+/- of new bulkhead immediately in front of and within 18" of existing bulkhead. Remove 30'+/- of existing bulkhead and replace in-place with new bulkhead. Located: 1420 Ninth St., Greenport. SCTM#45-6-9.4 Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of JONATHAN ZANG to construct 164' of new bulkhead immediately in front of existing bulkhead, in-kind, using C-Loc 9000 vinyl sheathing. Backfill area behind bulkhead with approx. 225 cy. of clean trucked in granular fill, re- grade and re-vegetate area. Located: 370 Takaposha Rd., Southold. SCTM#87-6-7 Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of JONATHAN ZANG to demolish the existing house and construct a new house, two-car detached garage, sanitary system and retaining wail. Located: 370 Takaposha Rd., Southold. SCTM#87-6-7 The CAC recommends Approval of the application with the Condition of a 30' non-turf buffer. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was 3 RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit GARDINER'S BAY ESTATES HOMEOWNER'S ASSOCIATION to remove existing floats from dock "A" and relocate as part of new dock "B". Install 6'X 30' floating dock and re-use two (2) existing pilings. Dock "B" construct a 4'X 30' fixed dock with a 42"X 12' ramp onto relocated floats from dock "A" continuing onto new 5'X 28' floating dock, ending with 2-4'X 20' floats perpendicular, and install four (4) new pilings. Located: Fox Island, Gardiner's Bay Estates, East Marion. SCTM#37-4-18 The CAC recommends Disapproval of the application because the proposed docking facilities will interfere with navigation. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Permit application of NSHE WlLLIAMSTOWN, LLC to remove wooden deck on the seaward side of the existing dwelling; remove porch on the western portion of the dwelling; remove two +/-23' long concrete walls off the southwest side of the dwelling; remove +/-49.6' section of the dwelling located on the northern corner of the dwelling; remove +/-24.8' section of the dwelling located on the seaward eastern corner of the dwelling, and remove a +/-17'X 1' section of the southern corner of the dwelling. Construct a +/-515' addition off the existing northwestern side of the dwelling; a 725' garage connected to the southwestern end of the extension; a +/-77.18' extension to the southeastern side of the dwelling; and a +/-71.4' extension to the easterly facing notch of the existing dwelling. Located: 220 West Shore Dr., Southold. SCTM#80-5-4.1 The CAC recommends Disapproval of the application because the property was not staked. Vote of Council: Ayes: All Motion Carried Moved by Tom Schlichter, seconded by Don Wilder, it was RESOVLED to TABLE the Wetland Permit application of JULIE TSAI to construct a single-family dwelling and driveway. Located: 310 Lake Dr., Southold. SCTM#59-1-21.1 The CAC Tables the application because there is evidence of a wetland immediately behind the proposed building envelope that was not flagged and/or indicated on the survey. The CAC recommends the wetlands be flagged and included on the survey for a further review. 4 Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOVLED to TABLE the Wetland Permit application of THOMAS & MARY IRENE MARRON to construct an addition to the existing dwelling and to expand the existing deck. Located: 3125 Wells Ave., Southold. SCTM#70-4-10 The CAC Tables the application because the project was not staked, however, the CAC recommends gutters and drywells are installed to contain the roof run-off and a 20' non- turf buffer. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Tom Schlichter, it was RESOLVED to TABLE the Wetland Permit application of CHERYL HANSEN to construct a single-family dwelling. Located: 405 Williamsburg Rd., Southold. SCTM#78-5-17 The CAC Tables the application because the project was not staked, however the proposed dwelling appears to be too close to the bulkhead and at least a 35' non-turf buffer is recommended. Vote of Council: Ayes: All Motion Carried Moved by Tom Schlichter, seconded by Jacob Smith, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Wetland Permit application of 343E18, LLC to demolish the existing dwelling. Located: 115 East Side Ave., Mattituck. SCTM#99-3-19 The CAC recommends Approval of the application with the Condition hay bales are placed down before demolition and during construction and a 25' non-turf buffer is installed. The CAC questions whether or not the existing boat ramp is permitted and recommends a gravel buffer surrounding the boat ramp. Vote of Council: Ayes: All Motion Carried 5 Moved by Don Wilder, seconded by Tom Schlichter, it was RESOLVED to TABLE the Weltand Permit application of DONNA WEXLER to construct an addition to the existing dwelling, repair the existing deck and construct a new deck, relocate the sanitary system, maintain the existing driveway, and construct stone walls at the north entry. Located: 1175 West Hill Rd., Southold. SCTM#70-4-23 The CAC Tables the application because the survey doesn't depict the proposed modifications. More information is required. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH CONDITIONS of the Wetland Permit application of BRADFORD WINSTON to construct an in-ground swimming pool and wood deck, attached to the existing single-family dwelling. Located: 485 Breezy Path, Southold. SCTM#89-2-8 The CAC recommends Approval of the application with the Condition a drywell is installed to contain the pool backwash and the surrounding areas remain natural. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit appliation of BELVEDERE PROPERTY MANAGEMENT, LLC to dredge the ferry terminal boat basin at the New Suffolk site and the area surrounding the docking facility at the Robins Island site, and maintain for ten (10)years. Located: New Suffolk & Robins Island. SCTM#117-8-19&20 Vote of Council: Ayes: All Motion Carried BELVEDERE PROPERTY MANAGEMENT, LLC to place approx. 375 boulders (2'-6'0 in dia.) along approx. 655' beach for shoreline protection. The boulders shall be placed above the AHWL and aligned to break wave energy, which has caused erosion to the "toe" of the existing bluffs and shoreline. Located: Robins Island. SCTM#134-3-5 The CAC did not make an inspection, therefore no recommendation was made. 6 Moved by Doris McGreevy, seconded by Tom Schlichter, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of SUSAN ROGERS GRUN to replace the steps from the bulkhead, replace the concrete porch with wood, and replace the roof over the concrete porch. Located: 54305 County Rd. 48, Southold. SCTM#52-1-6 The CAC recommends Approval of the application with the Condition the bluff is re- vegetated after it is disturbed and no treated lumber is used. The CAC questions the request for a roof replacement of a roof that does not exist. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of CURTIS & ANGELA DWYER to convert the existing sun-porch into a kitchen, Located: 720 Mechanic St., Southold. SCTM#61-4-11 The CAC recommends Approval of the application with the Condition a drywell is installed to contain the roof run-off. Vote of Council: Ayes: All Motion Carried Moved by Tom Schlichter, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of SUSAN BECKER to construct a 4'X 60' fixed dock with a 4' wide access pathway and 4'X 9' stairs at the seaward end. The dock will extend into the water approx. 29' from the edge of the marsh with no greater than 6" pilings. The docking facility and boat will not extend more than 1/3 across the lateral distance of the creek. Located: 4883 Wells Rd., Peconic. SCTM#86-1-9.6 The CAC recommends Approval of the application with the Condition the docking facility doesn't exceed 1/3 across the width of the creek and there is clearing for the path only. Vote of Council: Ayes: All Motion Carried 7 Moved by Tom Schlichter, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of ALEXANDRA & KEVIN O'MARA to construct approx. 226 linear ft. of rock revetment, consisting of 4-5 ton quarry capstone over 50-100 lb. core stone, on filter cloth; backfill with approx. 60 cy. of clean sand to be trucked in from an upland source and planted with Cape American Beach Grass (12" on center); and re-vegetate denuded portions of bluff face with Beach Grass, Bayberry, and Virginia Creeper. Located: 14345 Oregon Rd., Cutchogue. SCTM#72-2-2.2 The CAC recommends Approval of the application with the Condition the bluff is re- vegetated. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of ROBERT KOEBELE to construct 103.5' of bulkheading immediately in front of the existing damaged bulkhead. Located: 1525 Gull Pond Lane, Greenport. SCTM#35-4-12 The CAC recommends Approval of the application with the Condition of a 25' non-turf buffer landward of the bulkhead. Vote of Council: Ayes: All Motion Carried DAVID JOHNSON to reconstruct an existing 235'X 52" wood catwalk. Located: East End Rd., Fishers Island, SCTM#7-4-7 The CAC did not make an insepction, therefore no recommedation was made. PETER BACCILE to construct 95 If. of 4' wide fixed wood pile and timber pier and install an 8'X 20' float with associated 3.5'× 20' wood ramp and tie off pilings. Located: Equestrian Ave., Fishers Island. SCTM#9-3-11 The CAC did not make an inspection, therefore no recommendation was made. SUSANNA DOYLE to construct 95 If. of 4' wide fixed wood pile and timber pier elevated to clear tidal wetlands. Install a new 3'X 20' hinged ramp and an 8'X 20' float. The total length of the pier is approx. 125'. 8 Located: Peninsula Rd., Fishers Island. SCTM#10-11~5.8 The CAC did not make an inspection, therefore no recommendation was made. DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND PERMITS Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Amendment application of MICHAEL GRIFFIN to Amend Permit fl5252 to re- configure the existing 6'X 20' seasonal float to be straight out from its currently approved perpendicular "T" configuration and supported by (4) 6" dia. piles. Located: 425 Pine Place, East Marion. SCTM#37-4-14&15 The CAC recommends Disapproval of the application because the docking facility will interfere with navigation. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Amendment application of ROBERT LAWRENCE to Amend Permit #5952 to install a timber retaining wall on the south side of the property and modifications to the stone wall. Located: 800 West Creek Ave., Cutchogue. SCTM#103-13-6 The CAC recommends Approval of the application, however questions the use of CCA treated lumber on the retaining wall north of the property line. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Amendment application of DAVID & ELIZABETH SHANKS to Amend Permit #6042 to enclose the existing porch and to amend the proposed second story addition to 1275 sq. ff. Located: 1165 Calves Neck Rd., Southold. SCTM#63-7-34 The CAC recommends Disapproval of the application because the proposed addition is too close to the top of the bluff, Vote of Council: Ayes: All Motion Carried The next meeting of the Conservation Advisory Council has been set for Wed., December 14, 2005 at 6:00 PM at Down's Farm Preserve.
