Rodecker 471 Route 25A Rocky Point, NY 11778 RE: JOHN JOY 1330 Deep Hole Dr., Mattituck SCTM#115-12-18 Dear Mr. Rodecker: The Board of Town Trustees took the following action during its regular meet'rog held on Wednesday, April 24, 2002 regarding the above matter: WHEREAS, Randy T. Rodecker on behalf of JOHN JOY applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ord'mance of the Town of Southold, application dated March 15, 2002, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 24, 2002, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of JOHN JOY to install a 16'X 28' in-ground swimming pool 48' from the bulkhead, with the condition that a drywell is installed for the pool backwash, as per survey dated May 14, 1999 with revisions. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency, which may also have an application pending for the same or similar project. Permit to consln~ct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Box 11'79 So~.hoM, Ne,~ York 11971 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL At the meeting of the Southold Town Conservation Advisory Council held Thursday, April 18, 2002, the following recommendation was made: Moved by Melvyn Morris, seconded by Bret Hedges, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the' Wetland Permit Application of JOHN JOY to install an in-ground swimming pool with hot tub 16'X 40', built 24' from the bulkhead, 8' from the south side and 26' from the north side of the property. Located: 1330 Deep Hole Dr., Mattituck. SCTM#115-12-18 The CAC recommends Approval with the Condition that a .200 gallon drywell is installed to contain the backwash and a 10' non-turf buffer landward of the bulkhead.
