Dear Mr. Samuels:
The Southold Town Board of Trustees reviewed the site plan prepared by Thomas C.
Samuels dated March 1,2004 and determined the proposed pool house construction to
be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and
Chapter 37 of the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, without a permit. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and
Coastal Erosion Hazard Area, which may result from your project. Such precautions
may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay b~le berm.
However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion
Hazard Area would require permits from this office.
This determination is not a determination from any other agency.

Dear Mr. Herrmaun:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, October 24, 2001 regarding the above matter:
WHEREAS, En-Consultants, Inc. on behalf of THOMAS & SUSAN MERIAM applied to the
S outhold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town
of Southold, application dated September 30, 2001, and,
WHEREAS, said application was referred to'the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Heating was held by the Town Trustees with respect to said application on
October 24, 2001, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of THOMAS & SUSAN
MERIAM to install a swimming pool and patio; retaining wall and planter; deck addition and
steps; and install a pool drywell to contain backwash, with the condition that the pool dxywell is
moved to the other side, away from the adjacent neighbor, and a row of hay bales are placed
down around the project during construction.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified upon completion of said project.

Dear Mr. Krupski:
This is in regard to the application of Thomas and Susan Meriam of 1335 Marratooka
Road, Mattituck, NY for a permit to construct a swimming pool, pool patio, retaining wall
and planter, deck addition and steps, and a pool drywell.
The above mentioned property is adjacent to our home at 1645 Marratooka Road,
Mattituck, NY. The proposed pool/patio site is adjacent to the northern side of our lawn
ama. We spend a lot of outdoor time, spring, summer and fall, in this lawn area. We have
our lawn furniture there as well as table and chairs for dining. It is very_ quiet and peaceful
and gives us much pleasure.
We are concemed about the noise factor related to pool/patio activities. One of these
concerns is the possible noise from a propane pool heater. We have spoken to Mr. Meriam
about this and he assured us that this noise would not be a problem. Other noise concerns
are from general pool activities as there is not much distance between the pool/deck and our
lawn seating area. Is it possible that sound absorbing material of reasonable height be
provided along the southern edge of the pool area?
Another concern is the distance between the pool drywell and our well and the effect of
the chlorine water from the pool backwash.
We have noted on the plan of the proposed pool/patio that there is no fencing around the
pool.
We sincerely hope you will consider our concerns regarding this proposed addition to our
neighbor's property.

Dear Mr. Krupski:
We represem Susan and Thomas Meriam, who plan to construct a swimming pool and patio; retaining
wall and planter; deck addition and steps; and install a pool drywell to contain backwash on the
captioned parcel, all as depicted on the site plan prepared by Joseph A. Ingegno, L.S., last dated 10
August 2001.
Because all structures will be located 100' or more from the vegetated tidal wetland boundary and
because the ground area within the Trustees' 100' jurisdiction that will be "disturbed" as a result of the
project is already cleared and maintained as a lawn, all work should be beyond the jurisdiction of the
Southold Trustees pursuant to Southold Town Code Chapter 97. Therefore, we respectfully request
that you issue a letter of non-jurisdiction for the project. Should you nonetheless disagree with our
position, please issue a waiver for the project or process the enclosed wetland permit application for a
minor project.
