Dear Mr. Heard,
The Southoid Town Board of Trustees reviewed your request of November 18, 2005 and
determined the proposed construction to be out of the Wetland jurisdiction under Chapter 97 of
the Town Wetland Code and Chapter 37 Coastal Erosion Hazard Areas in the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the Coastal
Erosion Hazard Area (Chapter 37) no permit is required. Please be advised, however, that no
construction, sedimentation, or disturbance of any kind may take place seaward of the tidal
wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated
above, without a permit. It is your responsibility to ensure that all necessary precautions are
taken to prevent any sedimentation or other alteration or disturbance to the ground surface or
vegetation within Freshwater Wetlands, Tidal Wetlands jurisdiction, and Coastal Erosion Hazard
Area, which may result from your project. Such precautions may include maintaining adequate
work area between the freshwater wetland boundary, tidal wetland jurisdictional boundary and
the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay
bale berm.
However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion Hazard
Area would require permits from this office.
This determination is not a determination from any other agency.

Dear Trustees,
This letter is to formally request a determination of jurisdiction from you regarding the
request for a building pe~nit at 1020 Goose Creek Lane, Southold. CTM 1000-78-8-3
The property in question is waterfxont. We are requesting to remove the existing garage
on the property, and rebuild a new one in it's place. We have recently completed a
variance process, and received approval to continue, as the garage is within 40 feet of the
The construction area is approximately 180 feet l~om the waterfront. As per my
conversation with Lauren Standish on Nov. 16, 2005, I understand that your office with
need to inspect the site and assess any jurisdiction in this matter.
I request that such inspection go forward.
Enclosed please find documentation from the owner, Paul Maloney, authorizing me to act
as his agent in this matter.
