The v~lidity of this permit is or may be subiect to the approva~ of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Trustees upon receipt by the
Trustees· of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations uncle
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to perso~
and property resulting from such operations. By such acceptance, the applicant also agrees to indemr
fy and save harmless the Town, and its officers, agents and employees from any and all claims arisil
from operations under this permit and any and all acts or omissions of applicant, his agent a~
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized [
tflis permit are being conducted, do, by the acceptance of this permit, give consent to the Town, an
its officers and employees to enter upon the premises where such operations are being conducted'
make such inspections as the Town may deem necessary to insure that such operations are being co
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and veg
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the tow
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the tow

NOTICE IS HEREBY GIVEN THAT A PUBLIC HEARING WILL BE HELD BY THE TOWN
TRUSTEES OF THE TOWN OF SOUTHOLD, AT THE SOUTHOLD TOWN HALL, MAIN ROAD,

FOR A PERMIT UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF
SOUTHOLD.
In the matter of the application of Bernhard Peper by Eh-Consultants, Inc.
to rebuild existing damaged dock consisting of a 4' x 32' fixed elevated
3.5 above grade walkway; 4' x 12' hinged ramp; 6' x 20' float secured by (2) 8"
pilings. Property is located at 955 Lupton Point Road, Mattituck.
Trustee Smith: That is the public notice on this application. Are there
any comments for or against this application?
Mr. Roy Haje, En-Consultants, Inc.: If you visited the property you would have
seen the remains of the what is there now. He just seeks to replace that
structure. It is deteriorated.
Trustee Krupski: Didn't we have a recommendation on this to increase the length
of the catwalk so that it could meet with the stone wall?
Trustee Bredemeyer: Or to provide enough elevation over the marsh so that
the catwalk could meet with the stone retaining wall that is there. We want
steps to provide movement along the beach on town property. We felt that the
hight (3.5') would protect the marsh grass and be good planning for the owner.
Roy Haje: We did leave a gap for access to and from? You want steps on either
side? Rather than up and over?
Trustee Krupski: We would not want to restrict access from the public point of
view. Yes.
Trustee Smith: Are there any othe comments?

Dear Mr. Haje:
The following action was taken by the Board of Trustees during their
regular meeting held on March 26, 1987 regarding the above referenced matter.
WHEREAS, En-Consultants, Inc. on behalf of Bernhard Peper applied to the Southold
Town Trustees for a permit under the provisions of the Wetland Ordinance of the
Town of Southold, application dated January 23, 1987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on March 26, 1987 at which time all interested
persons were given an opportunity to be heard, amd
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE, BE IT
RESOLVED that En-Consultants, Inc. on behalf of Bernhard Peper BE AND HEREBY IS
GRANTED PERMISSION UNDER THE
PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: Rebuild existing
damaged dock of dimensions as follows: 4' x 32' fixed elevated (3.5 above grade or
marsh) walkway; 4' x 12' hinged ramp; 6' x 20' float secured by (2) 8" diameter piling
Property is located at 955 Lupron Point Road, Mattituck. This permit is approved
with the provision that the catwalk is secured to the stone retaining wall and
that steps are provided to allow access along the beach.

This permit will expire on March 26, 1988 if work has
not commenced by said date. There are two inspections required and
the Trustees are to be notified upon the completion of the work.
Prior to the issuance of said permit by the Clerk, the applicant
shall file with the Clerk a certificate that he has public liability
insurance policies insuring against any liability which may arise
in the performance of the operations pursuant to such permit in such
amount as shall be fixed by the Trustees, which said policies shall
name the Town as a name insured. Please take further notice that
this declaration should not b~ considered a determination made for
any other department or agency which may also have an application
pending for the same or similar project.
The following fees are now due and payable:
30' x 4' walkway @ $1.00 per sq. ft.
12' x 4' ramp @ 1.00 per sq. ft.
20' x 6' float @ 1.00 per sq. ft.

Dear Mr. Fiscina:
At their March 26, 1987 meeting the Southold Trustees re-
quested that the fixed section of the walkway be extended
laud~ard to meet the existing steps.
Accordingly, I have modified the proposed plan and have
included the revised work plan for your review. ~he
difference consists of the addition of 28' of fixed Walk
to make the overs1] length 60'. In addition two sets
of steps will be added to allow access along the beach.
By copies of this letter and work plan, I am requesting
other involved regulatory sgencies to take similar action.
