Box 1179 Southold, New York 11971 Telephone (516) 765-1892 Fax (516) 765-1823 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD December 28, 1995, Bernard Peper 955 Lupton Point Mattituck NY 11952 Re: SCTM #115-11-6 Dear Mr. Peper, The following action was taken by the Board of Town Trustees during its regular meeting held on December 21, 1995 regarding the above matter: WHEREAS, BERNARD PEPER, applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southo~d, application dated November 8, 1995, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEP~FDkS, a Public Hearing was held by the Town Trustees with respect to said application on December 21, 1995, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 37-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFOREBE IT, RESOLVED, that the Board of Trustees approves the application of BERNARD PEPER, for an existing house with attached deck, sanitary system, and existing stone wall and concrete block walk along property as per survey dated October 7, 1995 and planting plan to restore marsh between mean high water line and mean low water line dated BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct project will expire two years from the date it is signed if not started. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Council tabled the application due to an inadequate project description and no plans were submitted. Council also wishes to point out to the Trustees that there has been an apparent removal of marsh.
