Dear Mr. Peper,
The following action was taken by the Board of Town Trustees
during its regular meeting held on December 21, 1995 regarding
the above matter:
WHEREAS, BERNARD PEPER, applied to the Southold Town
Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southo~d, application dated November 8,
1995, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEP~FDkS, a Public Hearing was held by the Town Trustees with
respect to said application on December 21, 1995, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFOREBE IT,
RESOLVED, that the Board of Trustees approves the application of
BERNARD PEPER, for an existing house with attached deck,
sanitary system, and existing stone wall and concrete block walk
along property as per survey dated October 7, 1995 and planting
plan to restore marsh between mean high water line and mean low
water line dated
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct project will expire two years from the date
it is signed if not started. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

CONSERVATION ADVISORY COUNCIL
At a meeting of the Southold Town Conservation Advisory Councl held Monday,
December 18, 1995 the following recommendation was made:

Moved by Stephen Angell, seconded by Allan Connell, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH RECOMMENDATIONS of the Wetland Application of BERNHARD PEPER
115-11-6 to obtain a Wetland Permit for and existing house with attached deck,
sanitary system, and existing stone wall and concrete block walk along property
as per survey dated October 7, 1995. Applicant wishes to sell house and is
trying to get all permits

from removing fringe marsh in front of house and a condition of the permit
should be to restore the marsh.

Section 617.10 and Chapter 44 of the Code of the Town of Southold,
notice is hereby given that the Southold Town Trustees, as Lead
Agency for the action described below, has determined that the
project will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar
project.

DESCRIPTION OF ACTION: Applicant requests permit to construct a one

RESOLVED to TABLE the Wetland Application of BERNHARD PEPER 11S-11-6
to construct a single family dwelling with attached deck and sanitary system
and enclosed storeroom under house.
Council tabled the application due to an inadequate project description
and no plans were submitted.
Council also wishes to point out to the Trustees that there has been an
apparent removal of marsh. Owner must be told to stop removing marsh to
allow for a beach.
