Re: Dock Facility with Modifications (Replacing Floats, et~-~
Dear President and Board Members:
With reference to your field visit at my dock on July 18, 2001, we discussed the
changes the Trustees wanted done. i had the changes re-drawn on the plans, exactly as
requested, and resubmitted the changes to Feather Hill in person the following day. What
was agreed upon by all members of the Board at the field visit was to take the first existing
float and turn it to a 'T", push the second float up to it, and extend the stationary dock. I
had a stake in the water 14 feet out as requested, and it was agreed as fine at the site visit.
Before the Trustees left, I reiterated to Mr. Krupski to help clarify our request again - which
Is what the Trustees had requested, to turn the existing first float to a "T" 14 feet out where
the stake is, and then move the existing second float against It, and then extend the fixed
catwalk dock. Everyone wholeheartedly stated that I understood correctly.
To comply with the Board's latest request at the site on 7-25-01, we enclose maps
showing a 'T-Section" after removal of the two existing 18' floats and replacement with a
fixed dock section to the existing fixed catwalk, described in more detail below:
1) Replace existing 44' float sections, with a single 40 ft. fixed-catwalk section and
replacing its existing 4' wood post with an 8' x 20'L timber pile.
2) Place a 'T Float design' at end with utilization/relocation of an existing ramp (up to
4'x12') and one existing float (up to 6'x20') to form the 'T-section' at end of dock, and
with two 8'x20'L piles (includes one pile at each end to secure the end T float
(wost/east ends of float); This will be the only float. Very minimal disturbance for
placement of plies.
3) Place two 6'x6' wood steps, one on each side at shoreline,
4) rebuild In-kind in-placa 6'x15' timber steps along bank; and
5) Transfer Permit #2275 from Bernhard Paper to Jeanne M. Powell.
6) Confirm existing 'as built' upland deck areas aa shown on the enclcamJ B-4 drawing
revised 7/30/01.
7) The existing fixed portion of the dock and its two 4" posts will remain unchanged;

My family and I are trying to improve the dock facility and make it better and safer.
Please understand that we do not wish to go beyond the stake that was visited by the Board
on July 25th and wish to keep within the same range as shown (similar to neighbors' docks
on both sides). We would be glad to replace the floats as suggested and hope that the
enclosed new plan will meet with your approval.

Purpose: To follow the request of Town Trustees; replace existing float structures with
fixed dock structure, and to add T-Float at end similar to those existing in the area;
grandfather or approve "as built" areas of deck, steps and house"; approve mooring for
private boat use similar to the neighbor to the east. The dock extension will not extend
beyond adjacent and nearby dock facilities. This structure is for the owners' private
boating use and upgrade of existing dock facility.

The following action was taken by the Southold Town Board of Trustees at their Regnlar
Meeting held on Wednesday, August 30, 2001:

Remove (2) 6' x 18' floats and a 4' x 12' ramp.
Install a 4' x 40' extension, elevated 4' above
the grade of wetlands, to an existing 4' x 36.5'
pier, a 4' x 8' fixed timber ramp, and a 6' x 20'
"T" float secured by two (2) 2-pile dolphins. The
purpose of this project is to provide a safe
mooring facility for the applicant's vessel.

As this is minor in nature, authorization may be by Letter
of Permission. This is in accordance with current Federal
Regulations governing work in navigable waters of the United
States. To accomplish the coordination required, prior to the
issuance of a Letter of Permission, your review of the enclosed
drawings is requested.
Pursuant to Section 307 (c) of the Coastal Zone Management
Act of 1972 as amended (16 U.SoC. 1465 (c) (3) (A)), the applicant
has certified that the activity complies with and will be
conducted in a manner that is consistent with the approved state
coastal zone management program.
To allow for the timely processing of the subject
application, your comments are requested within 15 days of the
date of this letter.

TO WHOM IT MAY CONCERN:
During the month of April 1987, 35 Individual Department of the
Army Permit Authorizations and 8 Authorizations for work under a
Regional General Permit were issued for work in waters of the United
States, pursuant to Section 10 of the River and Harbor Act of 1899 (33
U.S.. 403); Section 404 of the Clean Water Act (U.S.C. 1344 et.seq.) and
Section 103 of the Marine Protection, Research and Sanctuaries Act of
1972 (86. Stat. 1052, P.L. 92-532), as appropriate, to the permittees
listed on the attached enclosure. During this month, no applications
were denied, 27 applications were considered withdrawn and 38
applications did not require Department of the Army approval or the
proposed work is authorized by a Nationwide General Permit.
Prior to issuance of the individual permit authorizations,
evaluation was made on factors affecting the public interest,
including, but not limited to, conservation, economics, aesthetics,
general environmental concerns, historic values, fish and wildlife
values, flood damage prevention, land use, navigation, recreation,
water supply, water quality, energy needs, safety, food production, and
in general, the needs and welfare of the people.

to remove three (3) existing wood pilings and add five (5) new timber piles 8" rd. 20 ft. in
length, rebuild inkind/inplace 6'X 15' wooden step area along bank, add 6'X 8' and 8'X
30' float at end, for a "T" float (hinged), add two 6'X 6' steps, one on each side at
shoreline, and to Transfer Permit #2275 from Bernhard Peper to Jeanne M. Powell.

Any material dredged in the prosecution of the work herein permitted
shall be removed evenly, withcmt leaving large refuse piles, ricl~es across
the bed of a waterway or floodplain or deep holes that may have a
tendency to cause damage to navigable channels or to the banks of
a waterway
There shall be no unreasonable interference with navigation by the work
herein authorized.
If upon the expiration or revocation of this permit, the proiect hereby
autho'tzed has not been completed, the applicant shall, without expon~e
to the State, and to such extent and in such time and manner as the
Department of Environmental Conservation may ~cluire, remove all or
any portion of the uncompleted structure or fill and restore the site
to its former condition. No claim shall be made against the State of
New York on account of any such removal or alteration.
If granted under Article 36, this permit does not signify in any way
that the project will be free from flooding
If granted under 6 NYCRR Part 608, the NY5 Department of Environ-
mental Conservation hereby certifies that the subject project will not
contravene effluent limitations or other limitations or standards under
5ectlons 301,302. 303. 306 and 307 of the Clean Water Act of 1977
(PL 95-217) provided that all of the conditions listed herein are met.
All activities authorized by this permit must be in strict conformance
with the approved plans submitted by the applicant or his agent as part
of the permit application.
