above referenced property at their July 31, 1996 meeting. Please
note, your Board reserved decision regarding the creation of the
deposition basin (and use of the dredge material as beach
nourishment) pending approvals from the NYS DEC and Army Corps of
Engineers. If our memory and file notes are accurate, your Board
suggested we file an application for an amendment once all other
permits were received.
As such, enclosed please find copies of all permits for the
creation of the deposition basin and placement of the dredge
material at spoil site ~2 for beach nourishment. Also enclosed is
a check in the amount of $40.00 representing the application fee.

The New York District, Corps of Engineers has received an application for a Department of the Army
permit pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403) and Section 404 of
the Clean Water Act (33 USC 1344).

A detailed description and plans of the applicant's activity are enclosed to assist in your review.
The decision whether to issue a permit will be based on an evaluation of the probable impact,
including cumulative impacts, of the proposed activity on the public interest. That decision will reflect
the national concern for both protection and utilization of important resources. The benefits which
reasonably may be expected to accrue from the proposal must be balanced against its reasonably
foreseeable detriments. All factors which may be relevant to the proposal will be considered including
the cumulative effects thereof; among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, historical properties, fish and wildlife values, floodplain values, land
use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality,
energy needs, safety, food and fiber production, mineral needs, consideration of property ownership and,
in general, the needs and welfare of the people.
The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies
and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of
this proposed activity. Any comments received will be considered by the Corps of Engineers to determine
whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments
are used to assess impacts on endangered species, historic properties, water quality, general
environmental effects, and the other public interest factors listed above. Comments are used in
preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the
National Environmental Policy Act. Comments are also used to determine the need for a public hearing
and to determine the overall public interest of the proposed activity.
ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE PREPARED IN
WRITING AND MAILED TO REACH THIS OFFICE BEFORE THE EXPIRATION DATE OF THIS
NOTICE, otherwise, it will be presumed that there are no objections to the activity.

Any person may request, in writing, before this public notice expires, that a public hearing be
held to collect information necessary to consider this application. Requests for public hearings shall state,
with particularity, the reasons why a public hearing should be held. It should be noted that information
submitted by mail is considered just as carefully in the permit decision process and bears the same weight
as that furnished at a public hearing.
Our preliminary determination is that the activity for which authorization is sought herein is not
likely to affect any Federally endangered or threatened species or their critical habitat. However,
pursuant to Section 7 of the Endangered Species Act (16 U.S.C. 1531), the District Engineer is consulting
with the appropriate Federal agency to determine the presence of and potential impacts to listed species
in the project area or their critical habitat.
Based upon a review of the latest published version of the National Register of Historic Places,
there are no known sites eligible for, or included in, the Register within the permit area. Presently
unknown archeological, scientific, prehistorical, or historical data may be lost by work accomplished
under the required permit.
Reviews of activities pursuant to Section 404 of the Clean Water Act will include application of
the guidelines promulgated by the Administrator, U.S. Environmental Protection Agency, under authority
of Section 404 (b) of the Clean Water Act and the applicant will obtain a water quality certificate or
waiver from the appropriate state agency in accordance with Section 401 of the Clean Water Act prior
to a permit decision.
Pursuant to Section 307 (c) of the Coastal Zone Management Act of 1972 as amended [16 U.S.C.
1456 (c)], for activities under consideration that are located within the coastal zone of a state which has
a federally approved coastal zone management program, the applicant has certified in the permit
application that the activity complies with, and will be conducted in a manner that is consistent with, the
approved state coastal zone management program. By this public notice, we are requesting the state's
concurrence with, objection to, or waiver of the applicant's certification. No permit decision will be
made until one of these actions occur. For activities within the coastal zone of New York State, the
applicant's certification and accompanying information is available from the Consistency Coordinator,
New York State Department of State, Division of Coastal Resources and Waterfront Revitalization,
Coastal Zone Management Program, 162 Washington Avenue, Albany, New York 12231, Telephone
(518) 474-3642. Comments regarding the applicant's certification, and copies of any letters to this office
commenting upon this proposal, should be so addressed.
In addition to any required water quality certificate and coastal zone management program
concurrence, the applicant has obtained or requested the following governmental authorization for the
activity under consideration:

c. Significant new information surfaces which this office did not consider in reaching the
original p~hlic interest decision.
Such a reevaluation may result in a determination that it is appropriate to use the suspension,
modification, and revocation procedures contained in 33 CFR 325.7 or enforcement procedures such as
those contained in 33 CFR 326.4 and 326.5. The referenced enforcement procedures provide for the
issuance of an administrative order requiring you to comply with the terms and conditions of your
permit and for the initiation of legal action where appropriate. You will be required to pay for any
corrective measures ordered by this office, and if you fail to comply with such directive, this office
may in certain situations {such as those specified in 33 CFR 209.170) accomplish the corrective
measures by contract or otherwise and bill you for the cost.
6. Extensions: General Condition i establishes a time limit for the completion of the activity
authorized by this permit. Unless there are circumstances requiring either a prompt completion o~ the
authorized activity or a reevaluation of the public interest decision, the Corps will normally 9ive
favorable consideration to a request ~or an extension of this time limit.

at an on-sits upland location, and subsequently placed on a beach northeast of
existing Jetties. All work shall be performed in accordance with the attached
drawings which are hereby made part of this permit.

General Conditions
1. The time limit for completing the work authorized ends on .
~f you find that you need more time to complete the authorized activity, submit your request for a time
extension to this office for consideration at least one month before the above date is reached.
2. You must maintain the activity authorized by this permit in good condition and in conformance with
the terms and conditions of this permit. You are not relieved of this requirement if you abandon the
permitted activity, although you may make a good faith transfer to a third party in compliance with
General Condition 4 below. Should you wish to cease to maintain the authorized activity or should you
desire to abandon it without a good faith transfer, you must obtain a modification of this permit from
I. If you discover any previously unknown historic or archeological remains while accomplishing the
activity authorized by this permit, you must immediately notify this office of what you have found.
We will initiate the Federal and state coordination required to determine if the remains warrant a
recovery effort or if the site is eligible for listing in the National Register of Historic Places.
4. If you sell the property associated with this permit, you must obtain the signature of the new
owner in the space provided and forward a copy of the permit to this office to validate the transfer
of this authorization.
5. If a conditioned water quality certification has been issued for your project, you must comply with
the conditions specified in the certification as special conditions to this permit. For your
convenience, a copy of the certification is attached if it contains such conditions.

Special Conditions:
a. In order to protect piping plovers (Charadrius melodus) and their habitat,
dredging and disposal activities shall not occur between April 1st and September 1st
of any given year for the duration of this permit.
b. The material to be disposed on the beach shall be consistent with the substrata
already on the beach, or consist of material that is suitable for piping plover
habitat,
c. To the maximum extent possible, the beach disposal area shall be finished to the
same grade at that existed prior to beach nourishment in order to maintain suitable
nesting habitat for plovers in the project area.

Dear Ms. Long:
Thank you for submitting your Federal Consistency Assessment Form (FCAF) and supporting
information to the Department of State (DOS) on August 12, 1996. DOS has determined that the
submitted documentation is adequate to commence our review of your proposed project. However,
pursuant to 15 CFR 930.58, the following data and information is necessary to enable the Department
of State to adequately assess the coastal zone effects of this proposed project.
The proposed deposition basin would be excavated directly adjacent to the designated Cutchough
Harbor Significant Habitat and Wetlands. According to the habitat narrative, Cutchogue Harbor and
Wetlands are very productive areas for marine finfish and shellfish. Cutchogue Harbor is one of the
top three areas in Southold for the harvesting of both scallops and clams.
Would the creation and maintenance of the proposed deposition basin interfere with existing
shellfishing opportunities in this area of Cutchogne Harbor? If so, the excavation and biannual
maintenance of the basin would likely result in adverse impacts to shellfi.qh populations in this area.
Please comment.
Please provide the information requested above to the Department of State within thirty days from
the date of this letter. Pursuant to 15 CFR 930.64(d), if this necessary data and information is not
provided, the Department of State may object to your consistency certification on the grounds of
insufficient information.

Any additional information which you believe will facilitate our consistency review of this project
would be appreciated.
You and the Corps of Engineers will be notified of our decision when we have completed our review
of this project for its consistency with the New York State Coastal Management Program. The Corps

Dear Mr. Costello:
The following action was taken by the Board of Town Trustees
during its regular meeting held on July 31, 1996 regarding the
above matter:
WHEREAS, Costello Marine on behalf of BARBARA BRAATZ applied
to the Southold Town Trustees for a permit under the provisions
of the Wetland Ordinance of the Town of $outhold, application
dated July 11, 1996, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recomendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on July 31, 1996, at which time all
interested persons were given an opportunity to he heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation s~,h~itted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
