Dear Mr. Bressler:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, August 21, 2003 regarding the above matter:
WHEREAS, Wickham, Wickham & Bressler, P.C. on behalf of RICHARD HORSTMANN
applied to the Southold Town Trustees for a permit under the provisions of Chapter 97 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated July
16, 2001, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
August 21, 2002, at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of RICHARD HORSTMANN
to increase the footprint of the existing house and add a second floor, as depicted on the survey
dated February 9, 2001. As referenced in Chapter 97-21J of the Town Wetland Code,
documentary proof that all necessary permits and approvals have been obtained. This is s~icfly
an environmental review based on the merits of the application.
Permit to construct and complete project will expire two years from the date the permit is signed.
Fees mast be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of $5.00 per inspection. (See attached schedule.)

2) Letter from the Suffolk County Health Department which indicates its necessity for a tmstee's permit

health department.
No other permits or consents are required. Accordingly, please issue the permit in this case at your earliest
convenience so that this project may proceed. We note that because of the delays in this matter the cost of the

Dear Mr: Horstmann:
Based on the information you have submitted, the New York State Depat~nent of Environmental
Conservation has determined that: The portion of property which is landward of the functional bulkhead
which is more than 100' in length and was constructed prior to August 1977 is beyond the jurisdiction
of Article 25 (Tidal Wetlands) asper copy of letter dated November 1, 1993 and signed by George A.
Danskin, Chef Permit Administrator.
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661)
no permit is required under the Tidal Wetlands Act. Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional
boundary, as indicated above, without a permit. It is your responsibility to ensure that all necessary
precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground
surface or vegetation within Tidal Wetlands jurisdiction which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a temporary fence, barrier,
or hay bale berm.
Please be further advised that this letter does not relieve you of the responsibility of obtaining any
necessary permits or approvals from other agencies.

was refered to the town attorney on the issue of an improper
survey submission. Curriously, Last year ~ did not receive a
written notice as well. If you check the file you will see that
there lacks affadavits of service, of any kind on the adjacent
landowners, for both 2001 & 2002 hearings. Similarly, this
proposed application and proposed hearing were adverted in the

NASSAU POINT RIGHTS-OF-WAY
The following summary is an abstract fzgm previously published information which was
distributed in February and March of 1976 as well as July, 1983.
The rights-of-way on Nassau Point were acquired by the Nassau Point Causeway
Association from Anna Z. Ungertand and/or the Nassau Point club Properties, Inc..
through the acquisition of the stock of that company. We received fi-om Anna Ungerland
a quit claim deed dated July 7, 1953. the Nassau Point Club Properties stock was
acquired in 1957. The 1974 Southold Town Tax Map on file in Suffolk County Property
Tax Office identifies 37 such rights-of-way. Some rights-of-way may have been sold to
adjoining property owners by the Nassau Point Club Properties, Inc.
In preparing the list of Nassau Point fights-of-way in accordance with the designations
shown on the Southold town tax map of 4-22-74, four rights-of-way shown on the Van
Tuyl map of Nassau Point dated 7-29-22 have not been included as follows:
1. Sunrise Road between lot 111 - 1- 9 and lot 110 - I - 10 which is shown as
"Sunrise Road - Private".
2. A right-of-way near the eastern limit of the old Vanston property (111 - 14 -
11),running fi-om Little Peconic Bay Road to Wunneweta Pond, which was
eliminated in the development of the Sailor's Lane area. A new right-of-way
shown on the tax map in the vicinity of the one eliminated appears to be a private
road for residents of Sailor's Lane.
3. A path between old lot #24 and lot #216 (111 - 14 - 36) which disappeared in
the preparation of the tax map
4. A path between lot 118 - 5 - 10 and lots 118 - 5 - 6 and 118 - 5 - 8 which is
shown on the tax map as a "Private Road'.
The average length of rights-of-way approximates 475 feet and the average width is 25
feet. General access in confined to Property owners on Nassau Point and their guests, and
over the years the maintenance or lack of maintenance of each right -of-way has been
assumed by those whose property borders on such rights-of-way and others who are
regular users, providing application for maintenance has been granted by the board of
directors of the association. Some rights-of-way accommodate motor vehicles and some
are mere foot paths. Some are indistinguishable and of these some are not used. About
one-half of the rights-of-way are used by homeowners as their means of driving to and
from their homes.
The Association includes the areas of our rights-of-way under the public liability insurance
policy which we have been carrying on our Causeway and Meadow Beach properties.
