Dear Mr.O'Neilh:
The following action as taken by the Board of Town Trustees during a Regular Meeting, held on
January 23, 2002, regarding the above matter.
WHEREAS, VINCENT O'NEILL apphed to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance oft he To[vn of Southold, application dated December 27,
2001
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
January 23, 2002 at which tune all interested persons were ~ven an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code.
WHEREAS, the Board has deten'nined that the project as proposed will not affect the health,

safety and general welfare of the people of the town,
NOW THEREFORE BE IT.
RESOLVED, that the Board of Trustees approved the application of Vincent O'Neill for a
Wetland Permit for existing deck.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Fee must be paid, if applicable and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified when project is started and on
completion of said project.

§ 58-1. Providing notice of pnhlic hearings.

§ 58-1. P'rovtdtng notice of public hearings.
Whenever the Code calls for a public hearing, this section
shall apply. Upon determining ~ha~ an application is complete,
the board or commission reviewing the same shall fix a time
and place for a public hearing thereon. The hoard or commission
reviewing an application shall provide for the giving of notice:
A. By causing a notice giving the time, date, place and
nature of the hearing to be published in the official
newspaper within the period prescribed by law.
B. By requiring ~he applicant to erect the sign provided by
the town, which shall be prominently displayed on the
premises facing each public or private street which the
property involved in the application abuts, giving notice
of the application, the nature of the approval sought
thereby and the time and place of the public hearing
thereon. The sign shall be set back not more. thma ten
(10) feet from the property line. The sign shall be
displayed rot a period of not less than seven (7) days
immediately p~eceding the date of the public hearing.
The applicant or his/her agent shall file an affidavit that
s/ha has complied with this provisien.

of record of every property which abuts and every
property which is across from any public or privste street
